Re:Appl 19-37P.The Leaming Experience Review Comments
Following are review comments from the Planning Department. Please make appropriate
revisions and submit seven complete sets (including landscaping and architectural elevations)
to the Planning Department prior to the scheduled hearing (scheduled for August 20).
Engineering comments will be sent separately.lf you have any questions.please call.
l.A narrative of the project including such items as total number of children.employees.
hours of operation, etc is required (See Section 8.7).This narrative should also address the
Special Exception requirements specifically for daycares (Section 7.4).and the generalspecialexceptionrequirements(Section 8.7).
2.A deed for the property is required for Special Exception applications.
3.Section 7.4.l 8 requires day cares that are separate building be screened from adjoining
uses to the standards established in paragraph 6.2.4.B.2 Buffer Standards and Design. Can
you demonstrate compliance with his section?
4.The dumpster location appears to be in a location that required backing up through the
parking area to service the site. Our concem is that the dumpster area abuts a residential
use and would be requesting arrangements be made to have trash picked up during nonnal
working hours. Will this create a conflict because of the dumpster location??
.A lighting diagram shall be provided. Can arrangements be made to have the lighting
level reduced during hours the business is not in operation due to its proximity of the
residential use?
6.Will children be brought to the site by school buses? If so.will the buses enter the site or
drop off along Tamarack Road.
7.The ADRC review comments include:provide additional treatment to soften the six foot
solid fence with a lattice treatment or some other fence aesthetic and landscaping
treatment

Re:RespOnse to Comments
The Learning Experience,Evergreen Walk
App.#19—37P
Dear Michele.
I am in receipt of the review comments from the Town Engineer dated August 8)2019)and yourcommentsdatedJuly28,2019 regarding the proposed Site Plan and Special Exception for The
Learning Experience (TLE)at 10 Sedona Circle in Evergreen Walk.Attached are seven sets of
revised plans addressing these comments. In addition,a discussion of each of your comments
follows.
Engineer’s Comments:
1.Provide a 6”stub in SMHI for the second building to be built in this area, that is
capped outside the MH.A callout for a stub has been added to SMHI.
How would 2 inside drops fit in SMHI?The town prefers to use outside drops and 2
could tit in a standard MH.Otherwise,a larger manhole may be needed. The plan has
been changed to call for an outside drop in SMHI.The inside drop detail has been replaced
with the Town’s standard outside drop detail.
Show the proposed location of the second future building in this area, north of the day
care, according to the approved general plan (attached). The future building has been
added to the plans.
The second clean-out from the building in the parking lot should be a manhole for
better access and inspection of the sewer lateral. The clean—out has been changed to a
sanitary manhole as requested.
The existing storm drainage near the existing entrance drive off Tamarack Ave should
all be relocated from the Existing DMH south of this drive to proposed DMHI.The
existing storm drain pipes can be plugged in these manholes and abandoned in place for
now.The 2 existing DMH should be removed, but the frames and covers can be taken
off and concrete slabs placed over them for now.The plans have been revised to connect
ED
a new pipe from the existing DMH to the new DMH.The 2 existing DMH structures to the
north are called to be removed and the pipes are called to be plugged and abandoned.
Isuggest YDI TF be raised 3-6 inches. The TF has been raised 3 inches as suggested.
The Proposed Type C DBL CB in the parking lot should have a 5 or 6 foot round
concrete structure t0 accommodate the proposed large drainage pipes in and out.The
DBL CB structure has been replaced with a 6’diameter round structure with a grate inlet.A
new detail for the new structure has replaced the former DBL CB detail.
Will there be any underdrains or yard drains in the playground area? There will be no
drains in the playground area.It is sloped at 2%to facilitate sheet flow of runoff out of the
area.
Change the detail for a sidewalk and integral sidewalk and curb to use Class F,4000 psiconcreteasthismixisreadilyavailableandwillbemoredurablethana3500psiconcretemix.The details have been revised to change to the specified concrete mix as
recommended.
10.WPCA review and approval is needed for this proposed plan. This is understood. An
application will be submitted t0 the WPCA shortly.
Planner’s Comments:
l.A narrative of the project including such items as total number of children, employees,
hours of operation, etc.is required (See Section 8.7).This narrative should also address
the Special Exception requirements specifically for daycares (Section 7.4),and the
general special exception requirements (Section 8.7).Attached to this letter is the
Operational Description for TLE which provides the information requested. Please note that
the TLE description is for a 10,000 square foot facility with a capacity for 180—185 children
with 24 employees.Based on code requirements specific to Connecticut, the proposed10,000 square foot facility at Evergreen Walk will be limited to 153 children with 26 staff
members. Thus, traffic generated at this site will be less than that discussed in the
description.
Below is a brief discussion of how the proposed project complies with the Special Exception
requirements of Sections 7.4 and 8.4.
7.4.1 No safety hazards are created, particularly with respect to access into and out of
the site and building. The proposed parking area and surrounding sidewalk network
provides safe access into the site and site building. The location of the playground adjacent
to the site building,in combination with the fencing and controlled access also ensure safety
of the site.
Page 2 of6
7.4.2 Any outdoor play area must be substantially level and suited t0 playground use.
The proposed playground will be graded at a slope of 2%,suitable for the use yet sufficient
to facilitate stormwater runoff
7.4.3.Any outdoor play area must be located on the site in an area that is removed
from any possibility of encroachment by vehicular accidents on adjoining streets. The
proposed playground is separated from adjacent parking and drives by sidewalks and
curbing. In addition, the playground is located at the end of the parking lot where it is
unlikely that an accident would occur that would encroach into the playground.
7.4.4 There must be adequate parking to accommodate any anticipated heavy
patronage functions,such as open houses,recitals,or plays.The proposed 40 stall
parking lot meets the Town’s parking requirement and that required by TLE for the capacity
of the building In addition, there is a large parking lot located across Tamarack Avenue at
The Shops at Evergreen Walk that can be utilized for overflow parking should the need ariset
7.4.5 A school bus turnaround must be provided if any children will be brought to the
Center by school bus.Transport of children to the site via school bus is not anticipated.
7.4.6 The surrounding environment must be reasonably free of industrial/commercial
pollutants and excessive noise at the time of application;and there must be a reasonable
expectation that the surrounding area will remain free of pollutants in the future. The
neighboring commercial uses include a hotel and parking lot associated with The Shops at
Evergreen Walk. These uses are not anticipated to generate any significant pollutants or
noise impacts that would negatively impact the site.
7.4.7 The surrounding environment must be reasonably physically and verbally non-
threatening to children and staff at the times of application, and there must be a
reasonable expectation that the surrounding area will remain non-threatening in the
future. The abutting commercial and residential uses are not anticipated to pose physical or
verbal threats to the children and staff. This conclusion is supported by virtue of the priorapprovaloftheGeneralPlanofDevelopmentbythePlanningandZoningCommission.
7.4.8 lf the Day Care Center is to be a separate building, the site must be screened from
adjoining sites to the standards established in paragraph 6.2.43.2 Buffer Standards
and Design.Screening may be located within the required yards. If the Day Care
Center is located within a multiple tenant facility, any outdoor play area must be
screened from adjoining uses to the standards established in Sections 6.2.4.B.2.A white
solid fence is proposed to screen the outdoor play area from adjoining sites. In addition, the
plan calls for proposed evergreen and deciduous trees to supplement existing trees along the
western property line to provide additional screening. The proposed screening measures are
consistent with existing and previously approved screening between other commercial uses
(such as Cambria Suites to the south)and the residential apartments.
8.4.1 The proposal is consistent with the goals and objectives of the Plan of
Conservation and Development.By virtue of the prior approval of the General Plan 0f
Development by the Planning and Zoning Commission, the proposal appears to be consistent
with the Plan of Conservation and Development.
8.4.2 The application has met the requirements of the zoning regulations It is the
applicant’s belief that the proposed Site Plan meets the applicable zoning requirements
8.4.3 The land is physically suited to the purpose 0f this use.The existing size and
topography of the site are well suited for the proposed development as demonstrated on the
Site Plans
8.4.4 Minimal,if any, adverse environmental impacts are created. The existing site does
not contain any significant environmental features, and the proposed development is not
anticipated to create and adverse environmental impacts.
8.4.5 No traffic or other hazards will be created. The proposed use does not generate a
significant amount of traffic and is not anticipated t0 create any hazards or adversely impact
traffic on the surrounding roadway network.
8.4.6 The impacts on the capacity of the present and proposed utilities, street, drainage
systems, sidewalks, and other elements of the infrastructure will be minimal. The
surrounding infrastructure within Evergreen Walk was designed and sized in anticipation of
the development of this site. Therefore, negative impacts to infrastructure are not
anticipated.
8.4.7 There will be minimal or no adverse effects on existing uscs in the area.Due to the
low intensity of the use and location of this site within the previously approved development
of Evergreen Walk, impacts to surrounding property values are not anticipated.
8.4.8 Surrounding property values will be conserved.Due to the low intensity of the use
and location of this site within the previously approved development of Evergreen Walk,
impacts to surrounding property values are not anticipated.
8.4.9 The character of the neighborhood will be maintained or minimally disrupted.
Due to the low intensity of the use and location of this site within the previously approved
development of Evergreen Walk, the character of the surrounding neighborhood is not
anticipated to be adversely impacted.Similarly,by virtue of the approval the General Plan of
Development by the Planning and Zoning Commission,it appears that the proposed use is
consistent with the character of the Evergreen Walk development.
8.4.10 The general welfare of the community will be served.By virtue of the approval of
the General Plan of Development by the Planning and Zoning Commission,it appears that
the general welfare of the community will be served by the proposed project.
8.4.11 There is a balance between the neighborhood acceptance and community needs.
By virtue 0f the approval 0f the General Plan of Development by the Flaming and Zoning
Commission,it appears that the proposed project will provide the required balance between
the neighborhood acceptance and community needs.
8.4.12 Historic factors are adequately protected;or due consideration to preservationofhistoricfactorshasbeendemonstrated. To the best of the applicant’s knowledge, there
are no historic features in the vicinity that would be impacted by the proposed project.
8.4.13 The overall physical appearance of the proposed development is compatible with
surrounding development and the Commission’s goals for neighborhood/corridor.The
proposed building and development have been designed to be compatible with the
surrounding mixed use development which is Evergreen Walk. The application has
presented their plans to the Architectural Design Review Committee and, with modification
of the proposed fence to include a lattice top,we believe that we have satisfied their concerns
regarding the appearance of the site and building.
8.1.14 The architectural design is aesthetically pleasing and blends well into the
surrounding area.As discussed above, the application has presented their plans to the
Architectural Design Review Committee and, with modification of the proposed fence to
include a lattice top,we believe that we have satisfied their concerns regarding the
appearance ofthe site and building.
A deed for the property is required for Special Exception applications.A copy of the
current deed is attached.
Section 7.4.1.8 requires day cares that are separate building be screened from adjoining
uses to the standards established in paragraph 6.2.4.B.2 Buffer Standards and Design.
Can you demonstrate compliance with this section. As discussed above,a white solid
fence is proposed to screen the outdoor play area from adjoining sites. In addition, the plancallsforproposedevergreenanddeciduoustreestosupplementexistingtreesalongthe
western property line to provide additional screening. The proposed screening measures are
consistent with existing and previously approved screening between other commercial uses
(such as Cambria Suites to the south)and the residential apartments.
The dumpster location appears to be in a location that requires backing up through the
parking area to service the site. Our concern is that the dumpster area abuts a
residential use and would be requesting arrangements be made to have trash picked up
during normal working hours. Will this create a conflict because of the dumpster
location? As detailed in the attached Operational Description.there is a large chunk of time
during the middle of the day (between 9:30 am and 3:30 pm)where the traffic within the
parking lot will be minimal, ifany.Arrangements can be made for dumpster pick—up during
this time so as not to conflict with the operation of the day care.

6.Will children be brought to the site by school buses? If so,will the buses enter the siteordropoffalongTamarackRoad? As discussed above, transport of children to the siteviaschoolbusisnotanticipated.
7.The ADRC review comments include:provide additional treatment to soften the sixfootsolidfencewithalatticestreatmentorsomeotherfenceaestheticandlandscapingtreatment. The proposed fence will include a lattice top.A photograph of the desired fenceisattached.
