Know all men by these presents,that Robert Oliveira of South Windsor,
Connecticut (hereinafter Grantor)for ONE DOLLAR ($1.00)AND OTHER VALUABLE
CONSIDERATIONS,received to her/his/its full satisfaction of THE TOWN OF SOUTH
WINDSOR (hereinafter Grantee),a municipal corporation chartered under the laws of
the State of Connecticut,do give,grant,bargain,sell and conhrm unto the said TOWN
OF SOUTH WINDSOR,its successors and assigns forever,a perpetual right to lay,
install,maintain,inspect,operate,construct,use,alter,repair,replace,and remove
storm water or storm drainage systems and appurtenances thereto,in,through,upon
and over a portion of property in said Town as described on the map indicated below in
which each of the undersigned Grantors has‘an interest as described in a deed
recorded in Volume 957,Page 85 of the Land Records of said Town to wit:
Said easement shown as “Drainage Easement in favor of the Town of South
Windsor ”of approximately 712 square feet along 853 Strong RoadHon a mapentitled853StrongRoadDrainageEasment,dated September 7,2010 which map
is to be filed in the South Windsor Town Clerk’s Office.
Within said piece(s)shown on the map listed above,the Grantee,her/his/its
successors and assigns,shall have the right to cut trees and bushes as may beconvenientornecessaryandtoremovestructuresthereon,and to pass and repass with
men and equipment,to survey,to operate equipment,to store,stockpile and installmaterialsrequiredforandincidentaltotheconstructionofsaidstormwaterorstorm
sewer lines,storm water or storm sewer pipes,culverts,or storm water or storm
drainage systems and to excavate and fill,and,if necessary,to alter existing water
courses or form embankments over said storm water or storm sewer lines,storm waterorstormsewerpipes,culverts,or storm water or storm sewer drainage systems.
The Grantor herein,for herself,himself/itself,hers/his/its successors and
assigns,shall not erect or allow to be erected any immobile structures on said
easements and/or rights—of—way and shall not plant or allow to be planted or grown anytreesthereonorperformanyworkthereonwithinsaideasementsand/or rights-of—way
which may endanger or interfere with said line,pipe,culverts or drainage systems.
The Grantor herein for itself,its successors and assigns,reserves the right toherself/himself/itself,her/his/its successors and assigns,to continue to use the land
within which the aforesaid easements and/or rights-of—way have been granted for anyusesandpurposeswhichshallnotinanywayinterferewiththeusethereofbythe
Grantee,its successors and assigns,in fulfilling the purpose for which these easementsand/or rights—of—way are granted.
The Grantee herein,for itself,its successors and assigns,agrees to restore andmaintainsaidpremisesintheiroriginalconditionasnearlyaspossiblecommensurate
with the above use upon the completion of any maintenance,operation,construction,replacement or repair work in said easement and/or right-of-way areas.
The Grantee agrees to hold the Grantor,hers/his heirs and assigns,harmless
from and against any and all damage to property or person caused by the construction
and/or maintenance and repair of said storm drainage system.
