Know all men by these presents,that Richard E.Watson and Lauren R.Watson
of South Windsor,Connecticut (hereinafter Grantor)for Zero Dollar(s)and other
valuable consideration received to their full satisfaction of THE TOWN OF SOUTH
WINDSOR (hereinafter Grantee),a municipal corporation chartered under the laws of
the State of Connecticut do give,grant,bargain,sell and confirm unto said TOWN OF
SOUTH WINDSOR,its agents and assigns,a Temporary Construction Easement upon a
portion of the property known as 80 Quarry Brook Drive in said Town as described on
the map indicated below in which each of the undersigned Grantors has an interest as
described in a deed recorded in Volume 1907 Page 270 of the Land Records of
said Town,to wit:
Said Temporary Construction Easement is shown as “Temporary Construction
Easement Area”on a map entitled “8O OUARRY BROOK DRIVE,TEMPORARY
CONSTRUCTION EASEMENT",by Town of South Windsor Enqineerinql Dated October 9.
2009,Scale:1 inch :40 feet which map is to be filed in the South Windsor
Engineering Department.
Said Temporary Construction Easement hereby being granted is for the purposeoftheGrantee,its agents and assigns for the improvements within said easement.
The Grantors grant to Grantee,its agents,and assigns,for the above-described
purpose:
1.The right to enter upon the herein above described easement area and to
drive vehicles and construction equipment on and across same;
2.The right to remove and trim trees,shrubs and other vegetation from,
remove fences from,excavate in,and to disturb the surface of,said
easement area;
3.The right to install drainage pipes and structures within said easement;
4.The right to store and stockpile surplus or excavated material within said
easement area during construction;
5.The right to survey said easement area and mark the location of the
above described easement by suitable markers;
6.The right to do all other acts upon said easement area necessary for the
efficient completion of the purposes stated herein.
The Grantee,for itself,its successors and assigns,covenants and agrees with the
Grantors,their heirs and assigns:
1.To indemnify and save Grantors,their heirs and assigns,harmless from
any and all damage to property or person caused by the exercise of any
of the rights granted hereunder,or by any negligent act or omission of itoranyofitsagents,servants and/or employees in the course of theiremployment;
2.To restore the land within said easement to as nearly its present conditionaspossiblecommensuratewiththeaboveprovideduses;
3.To restore any lawn areas disturbed by this work with sod and to repair orreplaceanysidewalks,paved driveways or lawn irrigation systemcomponentsdamagedbythiswork.
4.All rights granted to Grantee hereunder shall be temporary and shallterminateOneYearafterCompletionofConstruction
