RECEEVEQ
Dear Mr.Roberts:
We are writing regarding a complaint concerning the South Windsor Health Department. We
purchased our home in May 2016 and since then our neighbor,Mr.Gary Rizza of 25 Marilyn
Road, has had an ingound pool that is not in operation and contains standing water. We had
asked Mr-Gary Rizza in the past about his plans for the pool and he has indicated that he treats
the pool but had no plans to fill in,drain or remove the unused pool.
In August 201 8,we heard on the news and saw on the South Windsor Health Department
website that there was a positive test for the West Nile Virus in South Windsor as of August 21 ,2018.Out of concern not only for our own family and pets but the neighborhood,we decided to
contact the town to see if any action can be taken against Mr.Gary Rizza’s pool.We contacted
the town hall on August 24,2018 and we were advised that we needed to speak with the Health
Department.
Messages were left on the below dates with the Health Department staff:
o Friday August 24,201 8 with Ms.Heather Otis
o Wednesday August 29,201 8 with Mr.Luigi Sartori
0 Thursday August 30,20 l 8 with Mr.Luigi Sartori
o Friday August 3 l ,201 8 with Mr.Luigi Sartori
Since we never heard back from either Ms.Heather Otis or Mr.Luigi Sartori,we reached out to
the Town Manager’s office on Friday August 31,2018 to make a verbal complaint. We spoke
with an Assistant Town Manager who confirmed that Mr.Luigi Sartori and Ms.Heather Otis
were required to check their voicemail and to return calls. When asked why no calls had been
returned, the Assistant Town Manager indicated that she would look into the issue. To date,we
have never heard back from Mr.Luigi Sartori.
On Friday August 3 1 ,201 8 Ms.Heather Otis contacted Piero only after she was contacted by the
Assistant Town Manager.Ms.Heather Otis spoke with Mr.Gary Rizza and after meeting with
him,she had told Piero that Mr.Gary Rizza would have 30 days to take action.
Since no action had been taken to the pool,Piero went to the South Windsor town hall on
September 28,201 8 to speak with the Town Manager,Mr.Matthew Galligan.Piero was advised

that Mr.Matthew Galligan was mt available and to address any concerns in writing to Mr.ScottRoberts.
Still not seeing any action being taken regarding Mr.Gary Rizza’s pool,a message was left withMs.Heather Otis on October 3,2018.She returned our call on October 4,2018 and indicated
that she would contact Mr.Gary Rizza on either Friday October 5,2018 or Tuesday October 9,2018.
We 0nd it unacceptable that as taxpayers of this town that Mr.Luigi Sartori and the entire SouthWindsorHealthDepartmentdoesnotreturncallsunlessrequestedbytheAssistantTownManager. If Mr.Luigi Sarton'cannot fully perform his job duties which are paid for by the tax
payers of this town, then Mr.Luigi Sartori should be removed n‘om his position as the South
Windsor Director of Health.NO follow up action was taken by Ms.Heather Otis until promptedbyourvoicemailonOctober3,2018.As tax payers,we should not need to micromanage Ms,Heather Otis to ensure that her job duty to fully investigate and resolve the issue regarding thestandingpoolwateriscompleted.
What has started as a health department concern is also a public safety concern. The pool is notcompletelyfencedin;the only fencing is in the front of the yard.Any neighborhood child oranimalcaneasilyfallintothepoolduetothelackoffencing. How is Mr.Gary Rizza allowed tohavehispoolnotfencedinalltheseyears? Why has the town of South Windsor not taken anyactiononthisissue?
We are requesting that Mr.Gary Rizza be required to fill in his pool or drain his pool in order toremoveallstandingwateraswellasproperlyfenceinthepool.
Thank you for your time and consideration regarding this important issue. If any additional
information is needed, please feel free to contact us.
Sincerely,
Casey Miranda and Piero Uribe

Re:Unmaintained Pool on Propertv
Dear Mrl Rizza,
On August 31,2018 the Town of South Windsor Health Department, received a compiaint concerning the above
referenced property owned by vou.The complainant reported the following:
Property owner of 25 Marilyn Road haS an inground pool that is not being maintained;the pool is hoiding stagnant
water The neighbors are concerned about the standing water offering a breeding ground for mosquitoes and
other bugs.
The report was confirmed with a site visit by Heather Oatis on the same date. You indicated that you are worKing
with a contractor to remove the pool from your property.in the meantime, you have been treating the pool with.
a Iarvicide to prevent the breeding of mosquitos. An extra sheet of mosquito larvicide dunks was also left with you
to ensure that the treatments would remain consistent.
The CT Public Health Code section 19—13‘bl lg)states that ”stagnant water likely to afford breeding piaces for
mosquitoes within a residential district“is a condition that specifically is declared to constitute a public nuisance.
Please be aware that you are expected to continue treating the pool to prevent mosquito breeding while you are
making plans to remove the pool from your property.lt is expected that this will be completed by the next
mosquito season,April 15,2019,
Please contact me at 8603316173 upon completion to schedule a confirmatory inspection.Thank you for your
attention to this matter,
Sincerely,
