If PS are not available, then soils testing, code—complying areas, etc.will be needed. It may be possible to tie the pumphouse into the existing septic system (if not already done),but an evaluation of the existing system will be needed. If the existing system is within the well arc and/or limited in leaching capacity, then a central system connection will not be allowed, and a new system for the pumphouse may have to be installed. If PS are available, then a 8100a review may not be applicable, but connecting the pumphouse into the existing system would depend on the well location relevant to the existing system —meaning that it would have to be a minimum 75 feet away. And as mentioned, its not clear if the property owner will be able to connect into the public sewer line. That issue would have to be clarified. Either case will likely require that a site assessment be performed by a qualified individual locating any private wells (owners, neighbors),and determining where the building sewer from the pumphouse is going.lt is important to note that your office has no information on the existing septic system serving the pumphouse building, and therefore should not provide any opinions on its adequacy or how its functioning. The property owner does have several options to pursue obtaining approval for the proposed use of the pumphouse building (if allowed by zoning)-but with limited information on the existing system, site conditions, and public sewer access —its difficult for me to provide any more information based on assumptions. When you return i would be happy to discuss this matter further with your,or it may be useful to arrange a meeting with other interested parties. Bye. TO the west of the home, along Ferry Lane,is a large historic wooden barn, circa 18 l 3,which contains another ll carriage stalls. On the north side of the property is a garage building, circa 1923 (foundation reads 1918),containing another three carriage stalls and workshop. To the west of that garage building is the historic brick “Pump House”building, also 200 years 01d next year, approximately 22 feet from the closest property line (as measured by the applicant and witnessed by a DPI staff member). The pump house is the location of the detached accessory apartment. It contains an existing studio apartment, created around 1992 and occupied for most of the intervening years, with 580 square feet of finished floor space.Features are high wooden ceilings, ,some brick and sheetrock walls, multiple windows,a deck,a wood stove,a kitchen area,a living room area,a bedroom area, closet space, and a full bathroom. It is in need of attention, but nothing maj 0r.Also on the property and on the south side of the pump house are four old square foundations (bases)for an old windmill, now gone, which powered the well in the pump house. The well served multiple East Windsor Hill properties and residences with running water. To the west of the pump house is the shell of an old house relocated there hom offsite many years ago. The property contains other outbuildings, all of which purportedly date back to 18 l 3. All driveways on the property are on Ferry Lane (two curb cuts). The easterly driveway is gravel. The westerly driveway, which is paved and then tums into gravel, serves 1891 Main Street, the pump house, many of the outbuildings, and the two residences to the west at 35 and 47 Ferry Lane (Cohn and St.Cyr).Along the westerly side of the driveway is an arborvitae hedge and fence, which ends where the paved driveway enters the Cohn property. The driveway then tums to the west until it enters the St.Cyr property.Along the north side ofthe Cohn property are three large white pine trees and a long shed. The tenant for the pump house apartment will have use of a garage space(s)in the adjoining garagebuilding. When reviewing this application, please note that the existing primary dwelling contains two large dwelling units, each of which are larger than most houses in this community.Nowhere in the detached accessory apartment regulations is there language which precludes a property owner from securing approval for a detached accessory apartment if the main house is a two—family residence. This has been confirmed by Flaming Department staff.Another noteworthy consideration is that the subject property contains approximately three acres, which is more than three times the lot size in the A-40 zoning district (40,000 square feet, which is less than one acre). As required in the regulations, the applicant has provided a class D survey plan, which, under state code, does not require fleld work or measurements.Obviously the Planning &Zoning Commission did not want to burden applicants with the expense of higher level surveys for an accessory apartment.Elevations of the pump house and a floor plan have also been provided. The purposes of the special zoning regulations for accessory apartments are to:“1)Encourage the provision of moderately priced housing by allowing accessory apartments by Special Exception in all single-family residential zones.”And “2)Allow temporary apartments (in-law apartments)for family members”.The latter provision does not apply in this application, but the former certainly does apply,in that the applicant will be providing a moderately priced studio apartme the A— G:\Jobs\3l 42\Docs\Applications\3l42 ,PZC Narrative Statement .2—21 -201 2.doc ni 40 residential zoning district, which is a single-family residential zone, which is consistent with the Planning &Zoning Commission’s intent. In reviewing the accessory apartment regulations under Section 7.1 .2,the applicant has researched the assessor records for all properties within a 1,000 feet radius, and found that no “accessory apartments”exist per the assessor records (no more than 10%allowed).There is an apartment in the East Windsor Hill Post Office building, however, which is listed in the assessor records as“mixed use office/apartment”.This application thus conforms with this requirement. Pursuant to the other review criteria for approval of accessory apartments under Section 7.1.2,the proposed detached accessory apartment will not exceed 700 square feet (40%of both units is far greater than that). The main dwelling unit was constructed prior to 1990.The main dwelling and the pump house maintain the appearance of a single-family dwelling.Off-street parking for at least three vehicles must be provided, and the subject property has garage spaces for at least 18 vehicles. The owner of the dwelling units does occupy a dwelling unit on the property. The property has adequate water and sewage disposal.Public utility services are in Main Street (sanitary seWer is stubbed at the comer of Main Street and Ferry Lane, and public water is available at the intersection of Main Street and Sullivan Avenue). Addressing the five approval criteria for in—law apartments under Section 7.l .3,the proposedapartmentislessthan900squarefeet,both dwellings maintain the appearance of a single-family dwelling,off-street parking for more than three vehicles is provided, adequate water and sewage disposal is provided and utility services are nearby in the street, and the owner will occupy the main dwelling unit. Addressing the approval criteria under Section 7.1 .4 for detached accessory apartments, the conversion of the pump house to an accessory apartment does not include any building footprint expansion, the accessory building observes all setbacks required of a principal structure 0n this corner lot,and the apartment has living space between 500 and 800 square feet (actual is 580 square feet of floor area;somewhat more if measured on the outside of the structure). The commission has the authority to waive any of the provisions of Section 7.1.2 A or 7.1.3A,but we do not see any need to request a waiver based on our reading of the regulations. The applicant or his agent will address the special exception review criteria (l4 items)under Section 8.4 B.at the hearing. Mr.Laflamme thanks you for consideration of his application for a detached accessory apartment.
