Appl 24-39P. Larivere Detached Accessory Apartment 10/22/24
1. Request for a site plan approval for a detached accessory apartment on the second floor of an
outbuilding on property located at 374 Abbe Road Extension, RR zone.
2. In 2023. the PZC revised the accessory apartment regulations – this is the first application
that we have seen for a detached apartment. Section 3.2.3.1 outlines the criteria and process
for detached in-law apartments. These criteria include:
The usable floor area of the accessory apartment shall be no more than 30 percent of the
usable floor area of the primary dwelling unit and/or shall be no more than 1,000 square
feet (whichever is smaller). These areas shall be exclusive of garages, porches, or
basements.
The accessory apartment shall have no more than two bedrooms;
The accessory structure shall be located no closer than 30 feet from the property line;
landscaping treatments may be required to provide a visual barrier along the property line
to any adjacent residence located with 50 feet.;
adequate water and sewage disposal must be provided; and
the owner of the dwelling unit must occupy either the accessory apartment or the main
dwelling unit
3. This in-law apartment is proposed to be 785 square feet: approximately 30% of the house. A
small deck with stairs is proposed deck off the rear of the building.
4. The existing structure is approximately 35 from the property line. A picture has been
provided of the existing structure and its relationship to the abutting property. There is a
fence and existing mature vegetation.
If this application is approved, all owners of dwelling units with approved accessory
apartments shall reaffirm every 4 years to the Planning Department that 1 of the dwelling
units is occupied by an owner of the property.
There are no engineering comments on the plans.
