Re:Approval of Plans for K—F Brick Company Proposed Plant ExpansiOn,
John Fitch Blvd.,South Windsor
Dear Mr .Deptula:
We have reviewed plans for the subsurface sewage disposal system for the
proposed plant expansion at K—F Brick Company on John Fitch Boulevard,South
Windsor. The plans were prepared by the consulting firm of Design
Professionals,Inc.and were submitted to this office for approval pursuant to
Section l9-—l3-BIO3d(c).The plans bear a revision date of November l4,1988.
These plans were found to be satisfactory and in accordance with the
requirements of the Public Health Code. They are hereby AFPROVED by this
office with the following conditions:
l)System must contain a minimum of 391 feet of 3 foot wide trenches.
2)Sewer line must be 6"diameter centrifically cast iron pipe,or equal,
because 4"pipe at 1/4 inch per foot pitch would lower the septic tank
below the indicated 70.0 inlet elevation.
3)Clean outs to grade required for all changes of direction of more than
1+5 degrees on the sewer pipe.
4)2,500 gallon septic tank shall consist of two compartments with each
compartment having a manhole extended to grade.
5)All catch basins less than 50 feet from the proposed septic tank and
primary/reserve leaching systems shall be of watertight construction.
6)Pump cycle per dose shall be set at a minimum of 128 gallons (50%of
the volume of the proposed distribution piping)a maximum of 256
gallons.
With all of the above conditions met,it is our recommendation that the plans
be approved by the Director of Health of South Windsor.

RE:K—F Brick Company
Dear Bob:
In response to your Ietter of November 7,1988 regarding K-F Brick Company
and the issue of the avaiiabiiity of the sewer Iine, based on review of the
appropriate sections of our Charter,as weli as the correspondence from K-F
Brick's attorney,I am of the foiiowing opinion:
1.It appears that in order for K—F Brick to get access to our
sewer iine it wouid have to obtain an easement from an intervening propertyowner,Conraii.
2.It appears that such an easement is not forthcoming.
3.Under the appropriate sections of our Charter,K—F Brick wouid be
requiredixihook up to the sewer if,in fact,it were avaiiabie.
4.Because access to the sewer is not avaiiabie over the Conraii
Iand and because it appears from my conversations with you that there is
no other access point for K—F Brick to our sewer Iine, that K—F Brick,in
fact, does not have sewer avaiiabie to it at this time and, therefore,
is not required to hook up to the sewer Iine under our Charter.

Re:Sanitary Services for the K—F Brick Company,Inc.'sPlantExpansion
Dear Mr.Deptula:
After consultation with the South Windsor Town Attorney,Ralph Alexander,I am writing this letter to you.As you know,K—F Brick Company,Inc.originally planned to install a sanitarysewerlineunderConrail's railroad bed and hook into the town'ssewersystem. However,on behalf of our client,K—F BrickCompany,Inc.,we are advising you that,at present, the K—FBrickCompanydoesnothavedirectaccesstothetownsewersystembecausetheinterveningpropertyowner,Conrail, has not
yet granted the appropriate easement to install a sewer lineunderneathitsrailroadbed. It appears unlikely thatAConrailwillgrantsuchaneasementinthenearfuture, and it is
possible that Conrail ultimately will refuse to grant such aneasement.
The second reason for not installing the sewer line is thatitisprohibitivelyexpensive. The construction of a holdingtankwhilewaitingforanapprovalofaneasementfromConrail isalsoprohibitivelyexpensive.Even if an appropriate easementeventuallywereobtainedfromConrail, the cost of installing thesewerlinehasbeenestimatedbyconsultantstotheK—F BrickCompanyatapproximately$150,000.00.
For all these reasons, the K—F Brick Company requestspermissiontoinstallapermanentsepticsystemandleachingfield.

Dear Ralph,
As you are aware,K—F Brick Company has requested permission to
install a subsurface sewage disposal system on their propertylocatedonJohnFitchBlvd.(letter to myself from Robinson &
Cole dated 10/28/88).
Section 154—4 of the code of the Town of South Windsor states,in
part, that it shall be unlawful to construct a septic system in
an area having public sewers available to it.
There is a public sewer in John Fitch Blvd.which passes in front
of K-F Brick. This sewer line however is seperated from K—F
Brick property by the Conrail railroad bed.
I am requesting an interpertation of section l54—4 of the Town
code as it pertains to K-F Brick Company’s request in their
attorneys above refered letter to me.
Very truly yours,
ni’
