RE: Proposed Text Amendment (#20-25P):
Section 4.2 Buckland Road Gateway Development Zone
Costco Wholesale
Dear Planning & Zoning Commissioners:
Please consider my request for denial of the text amendment to Article 4 Section 4.2.11.F.2
proposing to modify the noise and time restrictions for pickups, deliveries and loading in the
Buckland Road Gateway Development Zone.
The proposed zoning regulation should be denied for the following reasons:
1. A truck routing plan is practically unenforceable once vehicles enter the public right-of-
way. The Zoning Enforcement Officer will not be available to monitor trucks entering
and leaving the site, leaving that burden on the residents affected by the truck traffic.
2. The restrictions allow for only the greatest offenders, which are big box retailers, to
benefit from the expansion of hours for night deliveries.
3. The regulation will harm nearby residents by removing protections from noise
generated by delivery vehicles and loading during typical sleeping hours of 10pm to
midnight and to 4am to 7am.
4. The regulation will harm nearby residents living on or near truck routes by increasing
the likelihood of noisy tractor trailer trucks and other delivery vehicles traversing roads
through residential zones during typical sleeping hours.
5. The regulation directly violates the South Windsor Plan of Conservation and
Development which states that the Town should protect established neighborhoods by,
“[minimizing] impacts from potential incompatible activities (such as traffic, noise,
lights, etc.) through the zoning regulations and a careful review of proposed
developments.” (Ch 11. Sec. A. pg. 74)
Thank you for your consideration.
Sincerely,
Marek Kozikowski, AICP
