After reviewing your research, this office concurs that this property is eligible for a "free split" to create a building lot based on it being the first created by deed since 1943. A mylar establishing the lot must be filed on the land records. The issuance of a building permit will be dependent on meeting all other zoning requirements at the time of the application. Dzen,Jr. &Jennifer M.Dzen 275 Barber Hill Road, South Windsor,CT 06074 Dear Mr.O'Brien: I represent John and Jennifer Dzen. They live at 245 Barber Hill Road, South Windsor, CT. They own farmland designated as 275 Barber Hill Road, South Windsor,CT. The farmland is currently being used as a Christmas tree farm. You provided assistance to the Dzens back in November,2015 to allow a farm road to pass through the aforementioned right-of-way. The Dzens are desirous or erecting three(3)greenhouses on the farm property. The greenhouses will be of a hooplfabric design, with steel hoops and covered by plastic. The greenhouses will be secured to the ground by the ends of each hoop being driven into the dirt. The greenhouses will not be open to the public. The greenhouses will be similar in appearance to "PHOTO#5" included for your reference. The Dzens applied for a building permit with the Town of South Windsor. The building permit was denied due to the fact that portions of two of the greenhouses encroach into the CUP rigltt- of-way. I have included a copy of the right-of-way for your reference. The building permit will not be issued until such time as the Dzens can provide the Town with documentation that Eversource is not opposed to the structures. In light of the above, the Dzens are requesting documentation from Eversource that it is not opposed to the construction of the greenhouses. If Eversource is not opposed to the construction of the greenhouses, and they are built, the Dzens are very much aware of the fact that upon the request of Evcrsource, those greenhouses may have to be removed at Dzens' sole cost and expense. The Dzens are willing to assume this risk given the temporary and portable nature of the greenhouses. Eversource Energy Alt?,: Hank O'Brien January 27, 2017 Page 2 oj2 I have included a map showing the proposed location of the greenhouses. The map is to scale. ts are to scale, and accurate to approximately the nearest foot. I have included two photographs for your reference as well. Photograph 41 is a view of the area facing West. The black `X' indicates the closest point of any of the greenhouses to the structures/poles. Photograph#2 is a view f the area facing East. Again, the black XI indicates the closest point of any of the greenhouses The Dzens believe that,if built, the greenhouses would not impede any access or activities on the part of Eversource, and that their request is not inconsistent with other permitted uses/encroachments in Eversource rights-of-way. Again, the Dzens realize that if their request is granted, there remains a risk to them in having to comply with a request from Eversource to take such actions as may be necessary to accommodate Eversource access and activities. The Dzens are asking that their request to encroach and erect greenhouses partially within the right-of-way be reviewed and granted, and that Eversource provide some type of documentation evidencing the granting of their request. Your attention to this request is appreciated. If you need anything further, please let me know. Vc-ry truly your 4)4-Bond,Jr. JAB/jab Encls.
