Re: November ZBA Applications
1. Appl. 2756-11 — Todd Waterman — request for a 10 foot variance to Table
3.1.2A to allow the placement of a storage shed 10 feet from side property
line (20' required) on property located at 258 Abbe Road, RR zone.
The applicant is proposing to locate a ten (10 foot by sixteen (16 foot shed on the rear
property.
The applicant has indicated that he needs this variance due to the location of trees and the
topography of the rear yard.
2. Appl. 2757-11 — Deborah L. Cortese — request for a 21 foot variance to
Table 3.1.2 to allow the installation of a pre-manufactured house 29 feet
from front property line (50' required) on property located at 22 Main
Street, RR zone.
The applicant is proposing to locate a pre-manufactured house twenty-nine (29 feet from the
front property line.
The research of this property shows that a variance to the minimum lot area footage requirement
was granted in 1957 (see attached letter and minutes of the 8/1/57 action). At the time, it
appears that the minimum lot area required for a building lot was twenty thousand (20,000)
square feet with 100 foot of frontage. A map was filed in the Town Clerk's office showing the
proposed lot which created this as a building lot.
In 1989, it was discovered that there had never been a record of the variance filed in the office of
the town clerk (see attached variance form and minutes from 2/2/89). The ZBA re-issued the
variance for filing. The lot was subsequently sold to the current owner and the property has been
assessed as a building lot since that time.
The applicant has indicated that the property contains a portion of land that is within the one
hundred (100) year Flood Zone, which limits the location of the house on the property.
Please call me at 644-2511, ext. 252 if you have any questions.
