AA-30 zone The five regular members acted on this appeal. Town Attorney Dennis, representing the Town, said on Felt Road the Town is now establishing street lines and intends to widen and improve the road. The house at 209 Felt Road, owned by the Livermeres, is presently approximately 30 feet from the paved por- u tion of the road. He presented a copy of a map drawn by the Town- ''i Engineering Department and said when the street line is establis the house will be 16.7 feet from the street line, 27 feet from tb edge of the pavement. Therefore, they are requesting the Board grant a variance of the front setback requirement because this P, hardship is being created by the Town. IIr. Dennis said the ". approximate street line on the map was obtained by measuring 25 .-� �I! feet from the center line of the paved portion of the road. Neal questioned why the owner of the property did not apply for the variance. 1r1r. Boucher said in this case the property owner is the I W- aggrieved party because the Town is taking the Property. Mr. 7,varren questioned the grounds for granting a variance in this case. The Board discussed the circumstances and the reasons for the request for a variance. 14r. 'Marren moved we table Appeal rr'911 to give the C;�airman an oppor- tunity to clarify the Toun's position, the format of the application and the grounds on which we can approve the application. The motion ;;I was seconded by Air. Pierce. h;r. Boucher said he didn't see anything wrong with the application, the Town applied on behalf of the Livermores to asp fora variance. Nir. i,yette suggested approving the application subject to obtaining the necessary information. Mr. I:arren said he wanted to table the appeal because he was not sure that the format of the application �r is appropriate, and he would have to vote a ;ainst it until we :ind some grounds for granting a variance. 14Ir. Fierce said is should be clearly shown where the Town gets the authority to act on behalf of the Livermores. " X,r. Clinton said one of the reasons they are doing this is to avoid any problem in the future if Livermore wants to sell the property. k. Mr. Meal said it is clear what the hardship is, if the Town takes the land, he has to have a variance. Air. Clinton suggested that the appeal be granted subject to the condition that the Town is acting on behalf of the Livermores and they are aware of the request for a variance. F. Mr. Pierce withdrew his second and the motion was lost for lack of a second. I-:r.
