Under federal firearm law and regulations the applicant must be in compliance with state and local law which includes zoning. The applicant advised he wished to engage in firearm transfers and gunsmithing. I informed the applicant that under federal firearm laws and regulations the transfer of the firearm and gunsmithing must occur at the licensed premises (i.e. 17 Spinners Run)and the required paperwork must be executed at the premises,which seems to conflict with the minor home occupation permit that he was issued. After a discussion on the limitations of the minor home occupation permit he has elected to withdraw his application for the federal firearms license. We advised him he could reapply in the future if he is granted the appropriate zoning approval for foot traffic and to execute the transfers at the premises(i.e. a major home occupation permit). However, 1 made it clear to him at that time that there could be no clients coming to his house. Under our regulations, minor home occupations do not allow for clients coming to the home. If that is what the business requires, it would have to be 2 permitted as a major home occupation,which requires a public hearing with the Planning&Zoning Commission(PZC) approval. Mr.Shea told me he would adjust how he met with clients,having them come to his place of business rather than his home. If that is changing, he will have to apply for the major home occupation permit,and receive PZC approval before he could conduct the business.
