In accordance with Section 29-296 of the Connecticut General Statutes, this request seeks to permit existing double hung windows to remain as the Secondary Means of Escape Windows from the bedrooms of Apartment 1 and Apartment 3 within this Existing Two Story, Four Dwelling Unit Apartment Building. This request seeks to permit an existing window from each of the effected bedrooms to have a clear opening height of 20 inches where a minimum height of 22 inches is required and that provides a clear width of 28 inches with a building opening height of 43 inches is ACCEPTABLE. This decision is based that the clear and building openings exceed the minimum square footage criteria for Secondary Means of Escape Windows. T4-71-DI5 DATE; MARCH 15,19T4 MAY 17 Zoning Board of Appeals South Windsor Town Hall May 8. 1974 8:00 P. M. MEMBERS PRESENT: Messrs. Archer, Devney (sitting in for Clinton) , Warren, Mrs. Murray and Chairman Eriksson Chairman Eriksson waived reading of the Legal Notice since it was quite lengthy, and instructed the Secretary to attach.a copy of it to the Minutes. He announced that all of the applications, Nos. 983-74 to 1005-740 concerned the widening of Buckland Road and were in the same area. Mr. Eriksson asked if anyone in the audience intended -to speak about any of the applications and the following persons res onded: . Mr. Richard Davis, 544 Buckland Road (App. No. 985-74 ; ,Mrs. Pauline K. Fox, 490 Buckland Road (Appp. No. 989-74) = Mr. Alex Sele, 350 Buckland Road (App. No. 991—Ms Mr. & Mrs. Suita, 206 Buckland Road (App. No. 997-74) ; Mr. William F. Perrotta. 114 & 116 Buckland Road (App. No. 998-74) and Mrs. Patricia LaFleur, 326 Buckland Road (App. No. 993-74) . Other than the above, no one was present to speak in favor or opposition to the other applications. Attorney Thomas G. Dennis of 656 Ellington Road, South Windsor, appeared on behalf of the Town of South Windsor and said that the Town is going to widen Buckland Road, but as yet no street line has been established. He stated they wished to establish a width of 50 feet from Oakland Road to the intersection of Deming, and from there to the Town line a width of 40 feet. The paved portion won't be those widths, but that is what the right of way will be. He stated that parcels must be acquired from each of the abutting properties and in some cases it will result in lots being less than the required area in the zoning regulations, and some structures will be located less than the minimum distance from the street line. He further stated that many of ,the properties are already non-conforming primarily because they were built long before building lines were established. Attorney Dennis went on to ,say that since the Town was making them more non-conforming. the Town felt it should apply for variances for these properties and is proceeding under Section 48-24 of the Connecticut General Statutes. Mr. Dennis presented copies of the statute in question to the Board members. The Statute gives the condemning authority the right to apply for variances on behalf of property owners when they are taking part of the land. By taking part of the land the condemning authority will l render it non-conforming. If a variance is not applied for, the property owner can require the Town to buy the whole parcel of land and the town does not need the entire parcel, just the strip to widen the road. L484 Attorney Dennis stated that this is a classic case of hardship as outlined in the Statutes. The property owners are the victims of governmental activity and through no fault of their own are being rendered in violation of the Zoning Ordinance. Attorney Dennis then asked the audience if anyone had any questions and Mr. William Perrotta of 114 and 116 Buckland Road, asked about compensation for the land. Chairman Eriksson stated that it is not this Board's function to discuss compensation for the land, or whether or not it can be taken, but merely to grant or deny a variance since it will be non-conforming. A lengthy discussion ensued among Messrs. Dennis, Perrotta and Chairman Eriksson about whether or not compensation should be dis- cussed at this meeting. Mrs. Pauline Fox of 490 Buckland Road, Mr. Alex Sele of 350 Buckland Road, and Mrs. Patricia LaFleur of 326 Buckland Road joined in the discussion. Another lengthy discussion ensued as to whether or not a munici- pality can take land, and Mr. Dennis explained the law to the parties, and Mr. Eriksson explained the function of the Zoning Board. Mr. Warren asked Mr. Dennis.if he understood correctly, that if the variances were not granted the Town could acquire the entire• parcel of land. Mr. Dennis stated yes, and further stated that this hearing had no effect whatsoever on whether or not the road is widened, and that the road was going to be widened. After another discussion, Mrs. LaFleur, of 326 Buckland Road decided to take back her objection to the granting of the variance on her property (App. No. 993-74)• Chairman Eriksson stated for the record that the properties in question are in three zones, which have the following requirements : AA-30 30,000 sq. ft. 50 foot setback RC 30,000 sq. ft. 65 foot setback RR 40,000 sq. ft. 50 foot setback It was noted for the record that the dimensions and figures shown in the surveys or maps attached to the applications are correct and shall be made part of the record.
