BUILDING DEPARTMENT
Dear Mr. Collins,
We are hoping that between now and March 15, 1995 we will be able
to resolve all problems regarding foundation cracks at Dart Hill
Estates.
We are scheduling a meeting with the homeowner's to answer some
of their questions.
Thank you.
Yours truly,

RE: Cracked foundations at Dart Hill Estates
DATE: November 2, 1994
John Hogan and I met with Mike and Murielle Jacques, Jeanne
Huppe, and Attorney John Kindl on November 1 , 1994 to discuss the
issue of cracked foundations at Dart Hill Estates, and to help
facilitate a resolution to the problem that would be mutually
agreeable to all involved parties.
After considerable discussion, an agreement was reached between
Mr. Jacques and Attorney Kindl as to a proposal to put forth to
the attorney representing the complainants.
This proposal consists of an inspection of each foundation in
question by a Stuctural Engineer (Jim Thompson of Buck and Buck
Engineering was recommemded) for structural integrity. Testing
via the Windsor Probe method would be done to confirm compressive
strength of the concrete.
Once this inspection has taken place, and a report generated as
to the structural integrity of the foundations, work will
commence to effect a repair of the cracks, both inside and
outside the foundation wall. All work for the crack repair will
be done by an independent contractor qualified for such repair
(Violette & Sylvester Waterproofing Co. was the recommended
contractor) . All warrantees for this work would then be between
the independent contractor and the respective homeowner.
I have since talked to Leo Belval of the Manchester Building
Department regarding this problem in his jurisdiction. He
indicated to me that a similar problem exists, and he shares my
belief that the problem could be directly related to the product.
We are planning to discuss this with other municipalities to
confirm similar problems, and then discuss ways to deal with this
as a consumer issue jointly.

Dear Jean Marc :
I am writing this letter as an addendum to my letter of
January 8, 1995 after further discussions with the town of
South Windsor building officials . I understand that an
independent engineer was hired by your company to certify
that the repairs were done properly to the cracked and
leaking foundations of other property owners in Dart Hill
Estates . I am requesting not only a written warranty of the
repairs , but also a written verification from an independent
engineer that certifies the worthiness of the foundation for
future resale purposes .
While some repairs have been made, there are unfilled cracks
that still have not been repaired in my basement and garage.
Please contact me so that those repairs can be scheduled. In
addition, please contact me at 648-1503 to arrange for the
engineer to have access to basement .
Sincerely,
Jean Egan

Re: JMJ Construction
Dart Hill Estates
Dear Atty. Kindl:
At your request we have inspected 10 house foundations of the
subject subdivision and herewith report on that inspection.
• The purpose of the inspection was to catalogue cracking of the
concrete foundation walls and concrete floor of each house,
supervise the strength testing of the concrete by an independent
laboratory, report on the nature of the cracking and its
structural significance, and provide recommendations or remedial
action.
The house foundations inspected are as follows:
No. 10 Carson Way
Nos. 3, & 14 Jared Court
Nos. 71, 104, 135, 136, & 152 Rimfield
Nos. 135, & 150 Heatherwood
The strength of the concrete in the foundation and floors was
tested by PROFESSIONAL SERVICE INDUSTRIES, INC. (PSI) using the
WINDSOR PROBE METHOD. The tests were performed on the concrete
areas that appeared to be weak and subject to cracking. Not all
foundations and floors were tested. The test results, as shown on
the attached PSI report, indicates the concrete exceeds the
minimum required, 28 day strength of 2500 psi.
Cracks in concrete foundations and floors are normal for all
construction except that which has been heavily reinforced with
steel. Most unreinforced walls will have a vertical crack near
their center. This cracking is due to shrinkage of the concrete
A during the curing process. All concrete shrinks after it is
placed in the forms, with the amount of shrinkage largely
determined by the water-cement ratio of the concrete mix as
placed. Minimum shrinkage is produced by a low water-cement
ratio. A high water cement ratio produces excessive shrinkage.

•
Long walls will have vertical cracks at 20 foot intervals.
Commonly floor cracks occur at midlength of the long dimension of
rectangular floors, and at changes in size of the floor slab.
The inventory of foundation cracks for each house is shown on
the attached LIST OF FOUNDATION CRACKS and sketch of the
FOUNDATION PLAN. Photographs were taken of typical cracks in
several houses and said photographs are included in the report
with Foundation Plans of the house in which they were taken.
STRUCTURAL CONSEQUENCES OF CRACKING
In general, all the foundation wall cracking can be attributed
to SHRINKAGE OF THE CONCRETE. Most of the wall cracks are of the
hairline form, most start at the top of the foundation wall and
tend to get finer toward the bottom of the wall and most cracks
tend to radiate from built in areas of weakness, such as basement
windows.
The floor cracking is also due to CONCRETE SHRINKAGE except in
three locations, where the cracking is due to settlement of the
underlying soil backfill. These locations are as follows:
• No. 71 Rimfield
The garage floor slab in the southeast corner, has
settled, causing structural cracks in the easterly half of
the garage floor slab.
No. 3 Jared Court
The garage floor, in a small section next to the south
wall of the garage, has a crack that indicates slight
settlement of the underlying backfill.
No. 104 Rimfield
The basement floor slab, in front of the sanitary sewer is
severely cracked, and has a definite hollow sound,
indicating loss of support from the underlying backfill.
The foundation wall SHRINKAGE CRACKS do not represent
structural problems, however, where they penetrate the full depth
of the wall, they become potential wall leaks, and from the inside
of the wall they are unsightly.
The FLOOR SHRINKAGE CRACKS, do not represent structural
problems, nor do they represent potential water leaks due to the
fact that the basement of each house is protected by a perimeter
foundation drain.

• SATE January 13, 1995 COMM. 7218-30
The floor cracks, located in isolated areas of three houses
are due to settlement of the underlying backfill.
RECOMMENDED CORRECTIVE ACTION
It is recommended that the following procedures be used to
correct the various concrete crack problems found. The
recommended scope of the work to be performed in each house is
listed with the individual House Sketch and its list of cracks.
1. Floor crack caused by backfill settlement.
a. Remove section of concrete slab affected.
b. Recompact backfill of the floor and adjacent
foundation wall.
c. Replace section of removed floor with new concrete.
2. Internal Basement Wall Crack
• a. Chip out, in a vee shape, cracks with widths greater than
hairline, and fill with a repair mortar, such as
"THOROPATCH" .
b. Grind off all rough wall tye patches on the basement wall
and any other rough spots.
c. Reparge interior basement wall surfaces that contain
cracks to produce a uniform wall surface.
3. Exterior Wall Cracks
a. Basement wall cracks, below grade, that have not been
repaired.
1) Chip out cracks in vee shape.
2) Patch cracks with a hydraulic cement, or thoropatch
containing a bonding agent.
3) Waterproof crack and 4" on each side of crack with a
bituminous, trowel applied, waterproofing material,
reinforced with a fiberglass mesh. Cover entire patch
with 6 mil polyethylene film, backfill excavation and
restore surface of excavated area.
• b. Basement wall cracks above grade
1) Chip out cracks in vee shape.
BUCK&BUCK ENGINEERS
TO Mr. John Kindl, Esq. PAGE 4
DATE
January 13, 1995 COMM. 7218-30
2) Patch cracks with a hydraulic cement, or thoropatch
containing a bonding agent.
3) Remove and replace parging at least 6," on either side
of crack, and extend resurfacing to blend new work in
with existing parging.
4. Basement and Garage Floor Cracks
Seal cracks with a two part epoxy, after thoroughly cleaning
the crack. Seal or paint the entire floor slab to produce a
uniform finished surface.
It is recommended that the repair work be done during the cool
months of the year, when the concrete shrinkage is at a maximum
due to low temperatures, and thus the shrinkage cracks are at
their maximum width. It would be appropriate to do the interior
basement work as soon as possible with the exterior work
following in the early spring, after the danger of freezing has
passed.

hammer. It is most probable that the soil backfill under this
portion of the garage floor slab has consolidated, after the
installation of the slab, and caused the portion of the slab next
to the house to settle.
