Re: In-law apartment and potential rental unit
Dear Mr. & Mrs. Brin;
It has come to my attention that you have built an in-law apartment in the
lower level of your home, and possibly a rental unit as well. The permit for
the addition was for a garage and a room, with no mention of an in-law
apartment.
The Town of South Windsor regulates in-law apartments through Section
7. 1.3 In-law Apartments of the zoning regulations. A copy of the relevant
regulations is included for your reference. Section 7. 1. 1.2, Purposes
stipulates that in-law apartments are for family members only. If you are
using the addition as an in-law apartment, as it is noted on the Town
Assessor's card, you need to file a permit immediately, demonstrating
how you comply with the regulations.
Based on the building plans submitted for the addition, and information
we have received, it appears that you may be using a portion of your
lower level as a rental unit. Please be advised that such a use is not
permitted for this property. As noted in Section 7.1.2 Accessory
Apartments, the main structure must have been constructed prior to
September 1, 1990 for such an apartment to be allowed. As your home
was constructed in 2009, it does not allow for such a use.
There may also be a question as to whether any additional volume would
be able to be handled by the existing septic system. Adding one or two
additional bedrooms and bathrooms could have an adverse impact on
the entire system, and should be addressed by the Town Health
Department.
If you meet the requirements established for an in-law apartment, please
submit the attached permit application by July 31, 2017. If you do not
meet the requirements, you must remove the kitchen and return the
space to a single family dwelling. In addition, you must cease using any
rental units on the property immediately. Contact me at (860) 644-2511,
extension 251 if you have any questions. Thank you for your attention to
this matter.

Appl#17-32P-Brin accessory apartment inspection:
1 accordance with approval conditions#3 and 4 of the Brin Accessory Apartment Application#17-32P
Chris Dougan,Chief Building official and I conducted an inspection of the basement bedroom of the Brin
main dwelling at 244 Smith St on September 28.2017.
We entered the main portion of the dwelling at 9AM and entered the area currently used as a bedroom
on the ground floor of the house. This area is not located within the accessory apartment in question.
The room contained a bed, occupied by an adult female, and two dressers on the left side of the room.
The right side of the room contained several cabinets,a counter with a sink and a refrigerator. A door
exiting to the outside was present as well.as a large window.
The result of the inspection was that only one accessory apartment was found on the property.
