Re: Unpermitted dwelling unit in commercial building
Dear Mr. Valvo:
I received a telephone call on January 27, 2016, with a caller alleging that
there is a dwelling unit being utilized within the Lots & More building. A
review of-the files for this property showed that you were issued an
Enforcement Order on January 24, 2007 for this same concern. It does not
appear that an approval for the dwelling unit at this site was ever sought
or granted.
Table 4. 1. 1A Permitted Commercial and Industrial Uses of the Town of
South Windsor Zoning regulations allows for a single residential dwelling
unit for the owner of the facility by site plan approval of the Planning &
Zoning Commission, provided the dwelling meets all of the regulatory
requirements. A copy of the regulation is included for your information.
If you are currently occupying the dwelling unit within Lots & More, and
you wish to continue the use, you must apply for a site plan approval with
the Planning & Zoning Commission. I have included a copy of Section 8.5
Site Plan Standards and Procedures for your use in preparing the
application, as well as an application form. The plans must demonstrate
compliance with the Fire and Building Codes, and a building permit will
need to be obtained if the plans are approved.
Please submit the application by February 29, 2016 to avoid enforcement
action from this office. If you have any questions, you can contact me at
