The following is a plan for control of erosion and sedimentation
during the development of phase II of this subdivision. Reference
should be made to the Subdivision Plans, in particular the Erosion and
Sedimentation Control Plan and detail sheets showing the designs and
locations of the proposed facilities. The proposed stormwater drain-
age facilities are discussed in the attached "Drainage Design
Statement".
DIRE EMERGENCY SPILLWAY, OUTLET
Staked haybales will be placed immediately downhill of the areas
wh re the emergency spillway and the three outlet pipes are to be
constructed. Drainage will be maintained through the existing outlet
pipe. Material excavated from the existing dike for construction of
the spillway and the outlet pipes will be stockpiled to the east of
the dike. A line of staked haybales will be placed along the downhill
side of this stockpile. The stockpile will be seeded or heavily
mulched. Gravel sub-base and rip-rap will be placed in the emergency
spillway immediately following excavation. Similarly, placement of
the three outlet pipes, backfilling and placement of gravel and rip-
rap will be done immediately after excavation for the pipes. Rip-rap
will be placed at both the inlet and discharge ends of the outlet
pipes.
Haybales will be placed downhill of areas where trees are to be
removed from the back of the existing dike. These areas will be loamed
and seeded or heavily mulched following tree removal.
DETENTION POND EXCAVATION AREA
Material excavated from this site will be stockpiled to the east
of the pond, and staked haybales placed along the downhill side of
this stockpile. The stockpile will also be seeded or heavily mulched.
ROADWAY NEAR LOTS 46-50
Because of the relatively steep slope in this area, an interceptor
dike and level spreader will be constructed in the roadway near
the cul-de-sac as shown on the Erosion and Sedimentation Control Plan.
The temporary dike and level spreader will be constructed parallel to
grade.
Staked haybales will be placed on the downhill sides of Lots 46
and 50, and on the uphill side of the cul-de-sac as shown. Staked
haybales will also be placed in other areas of Lots 46 - 50 where
necessary to control erosion and especially to prevent deposition of
sediments in the adjacent wetlands.
Jute netting will be placed on disturbed areas of steep slopes,
particularly on Lots 48 and 49 where steeply graded to the cul-de-sac,
following seeding. This netting will remain in place until vegetation
has been established.
Runoff from downspouts and driveways from Lots 44 through 48 will
be directed into the stormwater drainage system and away from the
1
adjacent wetlands area.
MAIN STORMWATER TRUNK LINE
A grass-lined ditch will be constructed on the north side of Dart
Hill Road to route stormwater into the new 54" trunk line. This ditch
will be loaned and seeded immediately following - excavation. Rip-rap
will be placed around the area of the pipe inlet. A baled hay check.
dam also will be placed at the inlet to the pipe.
Throughout construction of the 54"/60" trunk line, excavated
material will be replaced in the trench as installation of the pipe
progresses. No more than two pipe sections will be left exposed at
the end of any work day. Construction of this line will proceed as
rapidly as is practicable, and the backfilled trench will be graded
and seeded with quick growing cover or heavily mulched as required.
Any extra excavated material from the trench will be used for fill
material, and graded and seeded or mulched.
The outlet of the 60" pipe will have a flared culvert end, and
rip-rap will be placed all around the area of the outlet. Three baled
hay check dams will be placed in the grass-lined channel leading from
the pipe to the detention pond as shown on the plan. The channel
itself will be loaned and seeded with quick growing cover immediately
after construction.
OTHER STORM DRAINAGE STRUCTURES
Construction of the new 18" drainage pipe designed to discharge to
the south end of the detention pond will proceed as rapidly as is
practicable. The trench will be backfilled with excavated material as
construction progresses, and the backfilled trench will be graded and
seeded or heavily mulched as required. Any excess material excavated
from the trench will be used as fill, graded, and seeded or mulched.
The discharge end of this pipe will be a flared culvert end and rip-
rap will be placed in the discharge area.
All inlets and catch basins will be raised and surrounded by
staked haybales to limit intrusion of sediment into the storm drainage
system.
HOUSE CONSTRUCTION
Disturbed areas will be minimum practical for the size and site of
the building. After the foundation is in place the area will be rough
graded and seeded with a temporary cover.
Surface waters flowing to the disturbed area shall be diverted to
flow over undisturbed soil.
Lopcations where flow from the undisturbed area concentrates shall
be stablized by seeding and mulching. Baled hay erosion checks shall
be installed if necessary.
Specific plans will be varied to suit lot conditions.
2
Staked haybales will be placed along the rear of lots 32-39, 41
and 42.
SEEDING
Where cut slopes exceed 3 feet in height, they will be seeded for
permanent cover (season permitting) or heavily mulched immediately
after excavation. Permanent seeding will be done at the earliest
possible date.
Fill slopes will be topsoiled and seeded immediately after
construction and shall be protected with hay mulch.
As the binder course of pavement is placed, adjacent cut or fill
slopes and disturbed areas shall be topsoiled and seeded to permanent
cover as soon as possible.

I. INTRODUCTION
The T & M Building Company of Torrington, Connecticut has proposed the
second Phase of an Open Space Subdivision on a parcel of land lying to the
south of Dart Hill Road and to the west of Avery Street as shown on the
subdivision plans. This "Drainage Design Statement" summarizes the proced-
ures and criteria which were used in the design of the proposed drainage
facilities.
The main features of the proposed Phase II development consist of 40
residential lots, approximately 2,350 ft. of roadway, a stormwater detention
basin, and designated open space areas.
The drainage from Phase II of the proposed subdivision flows into the
area designated as Open Space. The drainage through the open space leaves
the site at the southwest corner of the subdivision into an unnamed stream
tributary to Avery Brook.
The proposed storm water collection system for Phase II consists of
storm sewers and diversion swales which intercept and direct stormwater
runoff into a storm water detention pond. The storm water collection system
is designed to moderate flows during storms of 2, 10, 25, and 100 year
frequencies.
II. DRAINAGE DESIGN PROCEDURE
The design procedure was carried out in four basic steps:
a) Assessment and analysis of existing and proposed drainage area
tributary to the collection system and detention basin.
b) Design of a stormwater collection system to collect and carry
runoff from tributary areas to the detention basin.
c) Design of a stormwater detention basin to minimize potential
flows downstream with as wide a range of recurrence frequency,
duration, and character as practicable without the use of
operator-controlled outlet works.
d) Design of an emergency overflow spillway to pass a possible major
flood of rare frequency of occurence in excess of the maximum
that would be passed through the normal detention basin outlet in
as safe a manner as practicable.
1
III. DESIGN CRITERIA
a) Stormwater inlets and collection facilities draining subareas
within the Phase II developmenmt area including swales, inlets
and smaller diameter piping were designed to carry flows with
recurrence frequencies of 10 years. Determination of inlet flows
and pipe capacties were based on inlet and gutter flow analysis
procedures contained in the Connecticut Department of
Transportation (D.O.T.) Highway Drainage Manuals.
b)The main trunk line crossing Dart Hill Road was design-ed to
carry estimated flows with recurrence frequencies of 50 years.
c)The detention pond was designed to reduce anticipated flows at
its outlet to levels equal to or less than the estimated flows
that occurred under natural conditions, which existed prior to
agricultural development of this land, for recurrence frequencies
ranging up to 100 years and with storm durations of up to 24
hours. The Soil Conservation Service tabular method contained in
SCS publication "Urban Hydrology for Small Watersheds (TR-55)"
along with National Weather Service (NWS) precipitation data for
storms of various durations was used in the inflow hydrograph
analysis and reservoir routing computations in the detention
basin design as well as determining flood flows to be passed by
the emergency spillway.
d) The emergency spillway was designed to satisfy Corps of Engineers
National Dam Safety Inspection Program Criteria. The range of
flows that the spillway was designed to be capable of safely
passing are those with recurrence frequencies of 100 years to
over 1/2 the recurrence period of a probable maximum flood (1/2
PMP).*
IV. DETENTION BASIN DESIGN
The existing irrigation pond located in the westerly portion of the
subdivision will be converted into a detention pond. The normal water surface
elevation in the pond is between elevation 320 and 321 during the winter
months when the pond is not in use. When used for irrigation, the pond is
allowed to fill during the spring and spills over the depressed area at the
eastern end of the dike. During the summer months stop logs are used to
block the outlet and water is pumped into the pond from a nearby well.
Corps of Engineer Preliminary Guidance for, Recommenmding
Mamimum Probable Discharges in Phase I Investigations.
2
The results of the analysis indicate that the following improvements
to the irrigation pond are required in order to optimize its use as a
stormwater detention pond:
modify the existing outlet pipe to a triple 36" outlet
pipe with a 26' wide emergency spillway
marginally increase the storage capacity
remove tree growth from the embankment and regrade where
necessary to maintain 3:1 slope
The emergency spillway crest elevation was set at elevation 324.00 and
the top of the embankment at elevation 326.00. Based on the above elev-
ations, it was found that the proposed detention basin is capable of detain-
ing a 100 year 24-hour design flow with a maximum outflow of 144 CFS.
representing 81% of the flow resulting from "natural" original conditions).
Table I below summarizes the estimated flows entering and being
discharged from the proposed detention basin.

The area of excavaton required for storage 'is limited to the eastern
edge of the pond which presently has grass and brush groundcover. The
wooded areas west and north of the pond will not be disturbed except for a
grassed lined channel into the northerly end of the detention basin.
3
Soil borings taken along th center line of th xisting embankment
indicate that the embankment is made of medium fine sand with traces of
silt. An embankment of this type is classified as "Homogenious" based upon
citeria contained in the Bureau of Reclamation Publication 'Design of Small
Dams".This type of embankment requires a slope not to exceed 3:1 and a top
width of 14' as shown on the plans. Due to the- relatively small head behind
the embankment and infrequent filling of the water, well draining materials
on the site may be used to fill in any slopes of the dike. All fill mater—
ial must have a maximum of 10% by weight passing the No. 200 sieve to
protect against sloughing during rapid drawdown. All brush and trees and
roots are to be removed from the embankment prior to regrading. The slopes
of the embankment shall have 6" of top soil and be fertilized and seeded.

Dear Madam Chairman:
Mr. John Dabrowski and Mr. Abraham Temkin of T & M Builders,
and Mr. Ray LeFoll , representing Pleasant Vally Homes, attended the
Park & Recreation Commission meeting on March 17, 1983.
We were shown blueprints of both projects, and the areas of open
space were particularly noted. All the gentlemen were most helpful
and cooperative in answering the questions of the Commission. At
the conclusion of the presentation, a discussion was held by the PARC
nd the following motion made by Thomas Breen, seconded by Joseph
Sterling, was passed (with one abstention) .
The PARC recommends that the Country View Estates proposal by T & M
Builders, concerning open space, be approved with the following provisions:
1 ) trees are needed every 10-12 feet to mark the access to open space
play areas, and the corners should be planted; (2) the 1 .7 acres of
open space area bordering on Dart Hill Road should be graded suitable
for field play.
The PARC recommends that the Pleasant Valley Homes subdivision be
approved with the same provision (1 ) as above, and (2) that the proposed
300' x 165' play area be leveled and seeded. (End of Motion.)
Recommendation (1 ) above will allow ready access and recognition of
open space areas, should the Town decide upon uses for these areas.
The PARC further recommends that the PZC refer any future subdivisions
to the Commission prior to the completion of the site plans, so that re-
commendations can be made as to site of open space areas to make them
realistically useful for Town recreation purposes.
We trust that this is the information you desired from the Park &
Recreation Commission in regard to these projects.
Si cerely yours,
Ralp McCarroll , Chairman

PLANNING AND ZONING COMMISSION MAY 10, 1983
PUBLIC HEARING & SPECIAL MEETING SOUTH WINDSOR TOWN HALL
MEMBERS PRESENT: Sorenson, Conde, Montana, Hallowell, Evans and
Sorosiak
ALTERNATES PRESENT: Mainelli (sitting for Norman)
PUBLIC HEARING
1. Application of T & M Building Company for an open space
subdivision of 40 lots west of Avery Street, south of Dart
Hill Road, known as Phase II of Country View Estates, in A-30
and AA-30 zones.
Attorney William Grace was present on behalf of the applicant and
stated that they had asked for a delay in the public hearing about
a month ago so that they could fulfill all the conditions of
approval for Phase I,as well as Inland Wetlands. Drainage work
has been done, as well as seeding, grading and landscaping.
As of today all of the 29 lots in Phase I have been sold and will
be occupied sometime this summer. The plan is the same as the
one presented in 1981. There will be no driveways onto Dart Hill
Road and just one entranceway.
Mr. Grace then introduced John Dombrowski, an engineer with
Lombardi Engineers, who gave the following report: The second phasewillbeservicedbypublicwater, sewers and storm drainage.
The storm drainage will be routed through a proposed detention basin
which is an existing farm pond. The outlet structure will be modified
so that it will hold storms up to a 100 year, 24 hour storm. The
flow will be less than what is currently there. Of the 100 or so
acres in this parcel, 43 acres will either be open space or easements
and will be left open.
Mr. Grace went on to say that the engineering department has been
concerned with seeding and planting for months, but much of that has
been accomplished. There is still some to do, but weather has been
a factor, and they hope to finish it by July of this year.
Mr. DeMallie, Planning Director, reported that for the total 100 lot
subdivision, 90 acres are in the A-30 zone and 9 . 9 acres at the westerlyendoftheroadtobecalledPaperchaseisintheAA-30 zone.
Paperchase was planned with consideration for a future road on the
opposite side of Dart Hill Road for land which is also under the
control of T & M. They have done an excellent job on the street
layout, and it is up to the Commission to decide if it wants CadburyandPaperchaseconnected. They could have had 46 lots in this phasebutareaskingfor40. They are required to have 22. 5 acres of
open space and they provide 27 . 8 acres. They have submitted an A-2
certified map of the open space (sheet #14) which the Commission did
not previously have, however, Mr. DeMallie said he thinks they should
have an open space landscaping plan as well which will define the
types of vegetation to be established, types of trees to be planted,
and access points which should be properly defined. Regarding the
small piece of land to the west of the CL & P easement, Mr. DeMallie
said he feels it should be conveyed to the Town and the applicant' s
attorney agreed.
Planning & Zoning Commission 2- 5/10/83
Mr. DeMallie said he thinks the realignment of the Lawrence
Road intersection should be done with the final phase of this
subdivision.
He further said the building located between Lots 61 and 62 on
Sheet #6 should be removed prior to filing the final plans, and the
other buildings on the lot with the renovated house should be looked
at to see if they conform. Mr. Dombrowski said he checked this
out and they do conform. Mr. DeMallie said the average lot sizes
are 20 , 250 s. f. in Phase I; 23, 000 s. f. in Phase II and 20 , 000 s. f.
in Phase II.
Mr. DeMallie concluded that he recommends approval of the entire
40 lots with the modifications mentioned above, however, building
permits should only be issued for the 21 lots fronting on Cadbury.
When the remainder of Phase I and these first 21 lots are finished
and look good, then the Commission can authorize issuance of permits
for the remaining 19 lots on Paperchase.
Town Engineer Page then gave his report as follows : A. R. Lombardi
has done a fine job on engineering on paper. They have worked with
the Town for a number of years on the watershed, drainage, sewers
and a lot of thought has gone into the design. However, performance
in the field by T &- M in the past years has given the Town a lot of
problems. Under their present organization, T & M may not be able
to handle a 40 lot subdivision without tearing up the entire landscape
and then taking months and months to fulfill their obligations. Many
meetings have been held out in the field with representatives from
T & M, and none of the people seem to have any authority and
the Engineering Department ends up calling Mr. Temkin to try to get
things done. T & M has now hired Ed Waltman and we have seen an
improvement in the field work, but on a scale of 1 to 10 they' re at
a level of 2-1/2 or 3. There ' s a lot of land that should be, and
could be graded and seeded. Unless T & M shows more improvement in
the next few weeks, Mr. Page said he ' d hate to see them tear up more
land out there. Mr. Page concluded that he is taking a wait and see
attitude before recommending approval of 40 more lots.
No one from the public spoke in favor of, or in opposition to this
application.
Upon questioning by Mr. Mainelli it was stated that this is the
parcel which was the subject of a zone change from AA-30 to A-30
a couple of years ago, and the length of the cul-de-sac streets
do conform to the 600 ' limit. Mr. Mainelli asked Mr. DeMallie
about the comment he made concerning Cadbury and Paperchase, and
Mr. DeMallie said originally they planned the two roads to connect
which would provide a through street in the subdivision.
Mr. Sorenson raised a question about the future road opposite
this development on Dart Hill Road, and Mr. DeMallie said it would
not line up with the. road from this development which is between
Lots 54 and 55. Mr. Sorenson noted the future road does not pertain
Planning & Zoning Commission 3- 5/10/83
to this application and Mr. DeMallie agreed it should not be
shown on tie plans.
Commissioner Conde asked how many of the homes had basements
and how many were on concrete slabs, and Mr. Grace said he really
didn' t know but would guess the ratio is about 60% on slabs.
He then asked if the square footage of the homes conforms to the
A-30 zone or if they were larger, and Mr. Grace said that many of
them are larger. The use of solar energy is optional and adds
about $5,000 to the price of the homes.
Commissioner Hallowell said that he would like to give the representative
from T & M an opportunity to respond to the comments made by -the
Town-Engineer. Mr. Waltman stated that it is not the house
construction that has been a problem, but the landscaping. He
said they probably tackled too many homes at one time because they
figured the weather would be better. They feel they will have all
the seeding done by June 1st, and if it isn't done by then they will
use sod which would be an additional cost to them, and not to the
homeowner. He said the only problem has been with the site work,
and they now have additional landscapers and are hoping for better
weather.
Commissioner Hallowell said that since he has been on the Commission
the only time new residents of Town came before the Commission as
group was-- in connection with T & M' s other development off
Beelzebub Road. There seem to be problems concerning completion
of the homes such as final grading, sidewalks, trees and final
coat of pavement on the street. He noted he recalls there' s always
a lot of pushing and shoving to get T & M to do what they're
supposed to do. Mr. Waltman said that in the past perhaps they've
tackled too much, but they've learned a lot and have learned to
cooperate with the Engineering Department and he feels there will
be a definite improvement.
Mrs. Montana asked Mr. DeMallie if he really felt the Commission would
have sufficient control if it approved the entire 40 lots and authorized
issuance of permits for only the first 21, and Mr. DeMallie replied
he thought it would.
Mr. Page said in his opinion the Commission needs all the control it
can get, and he feels approvals should be granted for 0 to 20 lots,
and the applicant should be required to return for further approvals.
Mrs. Evans raised a question about the open space, and Mr. DeMallie
confirmed that the CL & P easement would be dedicated to the Town
resulting in another 11 acres of open space, and the triangular piece
on the other side of the easement would also go to the Town.
Mrs. Evans asked about the 1. 7 ac. of open space on Dart Hill Road
which is to be dedicated to the Town in Phase III, and Mr. Dombrowski
explained that in order to meet the open space requirements and
also so that there are no cuts to Dart Hill Road, this parcel has been
designated open space. Mrs. Evans said that in addition to planting a
border of trees around open space areas, she also feels merestones
should be installed.
Planning & Zoning Commission 4- 5/10/83
Mrs. Montana referred to a letter from the Park & Recreation
Commission dated March 25, 1983 which stated "trees are needed
every 10-12 feet to mark the access to open space play areas,
and the corners should be planted; and the 1. 7 acres of open space
bordering on Dart Hill Road should be graded suitable for field
play. "
She then referred to a letter dated March 23, 1983 from Inland
Wetlands which stated there are serious questions about Phase I
concerning its impact on Phase II, specifically relating to work not
done in Phase I. Mr. Page said that IWA has not approved this
application since they are waiting for more information onthe grading.
Mr. Grace concluded by stating that they asked for 40 lots because
a great deal of the work has already been done. Water and sewers
are in. He said if the Commission wants Cadbury and Paperchase
to tie in they' ll revise the plan.
2. Application of J. E. Shepard Company for a resubdivision on
the northwest side of Bidwell Road, in an I zone.
Mr. J. E. Shepard was present and said the parcel in question is
2. 2 acres and he referred to a plan prepared by Gardner & Peterson
Associates, dated 4/14/83, Map No. 6178.
Mr. DeMallie reported that the utilities were installed and
approved 10 years ago, and before another application is submitted
he would like to see a conceptual plan and would like to know what
they plan to do with the street stub.
Mr. Page reported that the subdivision is just another lot in the
Shepard Industrial park and the Engineering Department has no
problem with it.
Mrs. Evans asked how far back the road will be extended, and Mr.
Shepard said the road is existing and they do not intend to continue
it as part of this application.
3. Application of Edward J. O'Leary and Raymond Vincunas,
Partnership, for a special exception to Article 4 . 7 . 2. 8 a and e, and
site plan of development for property located on the northwest
side of Bidwell Road, in an I zone.
Mr. Raymond Vincunas was present and stated he is a building contrac-
tor and developer and plan to construct a building for Chemlawn
which will house fertilizer and chemicals. He distributed copies of
a revised site plan to tie Commissioners which he said contains
recommendations of DEP. They have built five -similar buildings
for Chemlawn in different areas. Chemlawn has 160 of these facilities
and services 1, 500 , 000 customers and has about 3,000 employees.
The proposed facility will be 18, 000 s. f. , two stories, and cost
about $725, 000 . The vehicles to be stored in this building are
worth about a quarter of a million dollars. The building will be
Planning & Zoning Commission 5- 5/10/83
masonry, and Mr. Vincunas said he believes it will be the most
attractive building onthe block. He referred to a letter dated
May 9, 1983 from Stanley Alexander, Senior Sanitary Engineer,
DEP, which stated "it is my opinion that adequate safeguards
against environment contamination have been incorporated into the
design of this facility. "
Mr. Ken Peterson of Gardner & Peterson Associates stated that the
storm drainage will tie into an existing system on the southerly
boundary. They will install a drywell and catch basin . The site
is fairly flat and they have taken into consideration the
existing grades.
Mr. Vincunas informed the Commission that Chemlawn has expanded
into the carpet cleaning business, and materials for that operation
will be stored at this facility also.
Mr. DeMallie said that the site plan conforms to the regulations
and the special exception application seems to be in order. He
noted that he counted 69 spaces for parking and the data block
indicates 70.
Mr. Page reported that all the Engineering Department's concerns
have been addressed concerning storm water and sewers.
Upon questioning by the Commissioners Mr. Vincunas said there
are 30 trucks that are very expensive and carefully maintained.
They are stored indoors. There are four liquid storage tanks
in a diked area and the trucks. are filled with hoses. The chemicals
are put into the tanks on the trucks and then they are filled with
water. No carpeting or rugs will be cleaned on the premises.
4. Application of Ernest E. Reichle for a zone change from A-30
to A-20 for approximately 17 . 10 acres located north of Sand
Hill Road, west of Carriage Drive.
Attorney James Throwe was present on behalf of the applicant and
pointed to the parcel in ,question. He said he represented Mr. Reichle ,
who ,as trustee , is the owner of the property in question and is
requesting a zone change from A-30 to A-20 . This parcel ,together
with the adjoining land owned by CL & P, and also the land that is
Sand Hill Estates, was all owned by Leo Lichtner. He sold a portion
to CL & P, and reserved for himself two rights-of-way under
the utility right-of-way that went into the new development that was
call Lipman Estates, so that he could have access to Ellington Road
for the 17 acres he retained. He said they are considering a 20 lot
subdivision in an A-20 zone. Originally they considered a multi-
family development but finally decided on a subdivision with
an exit to Sand Hill Road going across land owned by the Town of
South Windsor. Last June the Town Council adopted a resolution
approving the right to put a road across the Town property, at
the owner' s expense. That resolution refers to a multi-family
zone, and to clarify it, if this application is approved, the
Planning & Zoning Commission 6- 5/10/83
applicant will return to the Town Council and ask them to change
the term "multi-family" to "an A-20 zone" subdivision.
Mr. Throwe said the Comprehensive Plan of Development shows high
density housing in this area in excess of A-20 and could be considerec
for multi-family housing so they are asking for a less dense use
of the property contained in the Plan of Development. Mr. Throwe
pointed out Lipman is A-30 , and then there would be a natural buffer
of the utility right-of-way, and then an A-20 zone, and continuing
to the Town recreation areas. He noted there are MF, A-20, A-30
and AA-30 zones surrounding the area.
The right-of-way closest to Sand dill Road will be given up, except
for a utility right of way to bring inv/water and sewer, and possibly
electric. That way the homeowners in Sand Hill Estates will be
protected from any future development. Mr. Throwe said he thinks
it is important to avoid bringing any more traffic onto Ellington
Road since it is a narrow street with sight-line problems. Sand
Hill Road is much more desirable, even though the developer will
have to spend much more money. Mr. Reichle will not build these
homes himself and U & R Construction Company has expressed a desire
to develop this area, and they have a letter of intent and U & R is
ready to move as soon as an approval is granted.
The difference between A-20 and A-30 is relatively slight in the
building size and the big difference is the lot size - 20,000 s. f.
as opposed to 30,000 s. f. They would be able to get 7 or 8 additional
lots which makes a difference in good use of this land because of
its particular shape.
Mr. Ken Peterson of Gardner & Peterson Associates stated that although
this is an application for a zone change, they have spent a lot of
time in developing a subdivision plan also. An A-20 zone permits
100 ' wide lots, however, they are planning on lots in the vicinity
of 130' to 150 ' in width, but the depth would be reduced. All
of the grading on this site flows from a northerly to a southerly
direction except for one small corner at the northeasterly corner
which is a wetland area. The closest road to that wetland would
be about 200 ' . No storm drainage will be discharged into that
wetland area. All storm drainage would be taken down through
the proposed road which goes through the site and along the 1600 '
of road, and at the southerly end of the proposed road there will be
a retention basin on the Town' s property. The outfall of that basin
will be to the existing brook which will cross the road at the
most southerly end. It will continue to flow in the same direction
that it does today, and there will be no increase in the peak run-off
rate.
Sanitary sewers, water line and utilities will come in from Carriage
Drive. They will come through a 60 ' right-of-way and across the
CL & P right-of-way. Mr. Petersen said Messrs. DeMallie and Page
suggested a pedestrian right-of-way opposite Lipman Drive be retained
r
Planning & Zoning Commission 7- 5/10/83
so that the residents of the proposed subdivison can walk to the
Town' s recreation area, and the applicant is willing to do this.
Attorney Throwe said they would be willing to deed the right-of-way
ownership to the abutting owners on Carriage Drive. He also thinks
it would be good to deed the open land at the stubs to the adjoining
owners.
Mr. DeMallie, Planning Director, reported that the ' 68 Plan of
Development shows a road extension to Lake from Sand Hill Road.
Part of this road was constructed as part of Windshire Abbe. The
Comprehensive plan shows medium to low density use in this area.
This subdivision would abut the Town Park which is in the
planning stages, and half-acre - lots abutting a park would be
very desirable. There are A-30 zones to the east, the future Town
park is to the -west zoned RR, and A-30 land to the north is owned by
Ireland. Mr. DeMallie said he thinks A-20 in this area is
compatible with the adjoining areas. The area is wooded, no
flood plain and only a small corner is wetlands. The plan on
file for Lipman Estates shows both the 60 ' and 50 ' strips as being
reserved for future roads. Mr. DeMallie said hemDuld prefer access
to this site via the new Abbe Road Extension, and if the Commission
goes along with the proposed plan he would recommend abandoning the
rights-of-way except for a pedestrian walkway.
Town Engineer Page said the applicant has addressed the problems
of Engineering, but more work is necessary on the sewers. They
could go through Lipman, or possibly down the proposed 1600' road
to a manhole from Parkview South. Whether the property is developed
A-30 or A-20 does not mean much in the way of storm drainage, and
Engineering Department does not have any great concerns whether it is
developed A-20 or A-30.
Chairperson Montana then read the following resolution which was
adopted by the Town Council on June 7, 1982:
BE IT RESOLVED that the proposal of Ernest Reichle, trustee,
to construct a road to Town specifications from the north
side of Sand Hill Road to the site of a proposed new condominium
development, located west of Sand Hill Estates, is approved
subject to the following conditions:
1. The Town of South Windsor will provide to Ernest Reichle,
Trustee, a right-of-way for the construction of the
road on Town property.
2. The proposal for the layout, design, and construction
of the proposed road must be approved by the Planning
and Zoning Commission.
Planning & Zoning Commission -8- 5/10/83
3. There is no obligation upon Ernest Reichle, trustee,
to construct the proposed road, unless approval is
obtained for the proposed condominium complex from
all relevant boards and commissions.
4 . This action by the Council in way prejudices, nor should
it influence any action or consideration of the proposal
by other boards or commissions. This action is to meet a
legal requirement in order to allow the proposal to be
presented to the Planning & Zoning Commission for its
consideration.
5. The Town shall receive a hold harmless and indemnity
agreement from Ernest Reichle and be named as an additional
insured upon a general liability policy to the satisfac-
tion of the Town Attorney and at no cost to the Town of
South Windsor.
No on in the audience spoke in opposition to, or in favor of the
application. Mr. Alan Ober of 156 Carriage Drive stated that he
was representing all the neighbors who have formed a neighborhood
group , and submitted a petition which he said was signed by 1000
of the residents in the neighborhood, which reads as follows:
We, the undersigned, as residents of the Lipman Road/Carriage
Drive neighborhood, do hereby oppose the plan to use either
of the two rights-of-way bordering the properties of Messrs.
L. Ingalls, R. Mansfield, A. Ober and R. Shakdr as roadways
to the adjoining seventeen acre parcel of land owned by
Messrs. R. Sheridan and E. Reichle. This opposition is made with
the intent of maintaining neighborhood pedestrian safety
by minimizing the traffic on Lipman Road --and in consideration
of the possibility of Lipman Road' s eventually becoming a
heavily traveled thoroughfare from State Route 74 (Ellington
Road) and the adjacent neighborhoods, to Nevers Road, Abby
Road and the South Windsor High School.
Furthermore, regarding the above-mentioned seventeen acre parcel
of land, the undersigned do accept the proposed zone change from
A-30 to A-20 only on the condition that neighter of the subject
rights-of-way is used as a roadway to this property.
The aforesaid petition was signed by 66 persons residing on Carriage
Drive and Lipman Drive.
Commissioner Hallowell raised a question about the fact that the
proposed Abbe Road Extension to Sand Hill Road may be on top of an
area that used to be the town dump. There was a brief discussion
and Mr. Reichle said the dump was further to the west, and he would
guess about 100 ' away. The Town Engineer stated that recently test pits
were dug in this area for proposed ball fields, and they went down as
far as 14 ' in six different locations and there was no evidence of a
dump.
Planning & Zoning Commission 9- 5/10/83
Commissioner Conde asked if it was the intent of the applicant
to continue the proposed road beyond the development and Mr. Throwe
replied no, that he would go to within 50' from the Ireland property.
Mr. Mainelli asked if the road could be constructed on the CL & P
right-of-way, and Mr. Throwe said he wasn' t sure, but they preferred
to put the road further to the west so that it could serve the Town' s
recreation area. Ownership of the road will be deeded to the Town.
He then asked if the retention basin had to be on Town- property,,
and Mr. Page said not necessarily, but he felt it was more desirable
to locate it there.
There being no further comments the public hearing was adjourned
at 10: 30 P. M.
SPECIAL MEETING
1. Brian Hermes, Lot #3 at corner of Graham & Nevers (Holcombe
Subdivision
Mr. Hermes was present and said he proposed to build his house
facing Nevers Road rather than Graham. The Commissioners reviewed
the plot plan, and Mr. Page said he had no problem with this proposal.
Mr. Hermes said from an aesthetic point of view it would be more
attractive, and also afford him more privacy from the house on Lot #2,
and also he felt traffic would be lighter on Nevers Road.
Mrs. Evans made a motion to approve the loccation of the house and drive-
way on Lot #3 of the four lot subdivision at the intersection of
Graham & Nevers Roads, in an A-20 zone, as shown on a plan prepared
by Emil W. Lucek Associates, dated 3/19/83, Project 83-18. Mr.

PLANNING AND ZONING COMMISSION inn 12, 1983
PUBLIC HEARING AND SPECIAL MEETING SOUTH WINDSOR TOWN HALL
MEMBERS PRESENT: Sorosiak, Evans, Montana, Hallowell, Conden, Sorenson
ALTERNATES PRESENT: None
PUBLIC HEARING
1. Application of J. H. C. Construction, Inc. , for a S2ecial Exception to
Section .7.2. j of the Zoning Regulations to permit a veterinary hospital
on property of David R. Burnett, etal, located on the east side of Patria
Road, 'in an I zone.
Mr. Kent Carney of J. H. C. Construction Company, and Mr. Don Wright, the
architect were present to present this application. Mr. Carney said that
they are basically continuing the application which was started in 1980
with the concept of having a veterinary hospital and kennel side by side in
one area. The proposed building is a 4,000 s. f. metal building. Mr. Wright
produced a sketch of the proposed building and pointed out the parking areas.
He said the building is similar to the existing building and there will be
a walkway tying the two building together. The reception area and lobby
portions will have cathedral ceilings.
Town Engineer Page reported that all the concerns of the Engineering Depart-
ment have been met and he has no problem with this application.
Planning Director DeMallie reported that in 1980 the Industrial Zone regulations
were changed to allow kennels and veterinary hospitals in an 1 zone providing
a special exception is granted. The plans have been amended several times,
and they have done a substantial job on the landscaping. Lots #6 and #7 were
combined and the line was removed.
No one in the audience spoke in favor of, or in opposition to this application.
Commissioner Sorenson questioned whether the retention pond is in, and Mr.
Carney said it is, and it will be able to handle the additional run-off from
this building.
Commissioner Conde raised a question about the cul-de-sac., and Mr. Carney said
it is a temporary cul-de-sac, and it is in and will remain as is.
Mrs. Montana suggested they consider moving some of the flowering trees which
are ?.ocated in the rear to the front where they will be seen. Mr. Carney
said they have no objections to moving the plantings if the Commission so deems.
Mrs. Evans-asked what type of services will be performed in this building,
and Mr. Carney said that anything that is presently being done in the building
on Sullivan Avenue will be moved to this location. Mrs. Evans asked if they
had suitable arrangments'for disposal of deceased animals, and Dr. Burnett said
they have an arrangement with a man who buries the animals, and also have
access to cremation facilities, when necessary.
SPECIAL MEETING
1. Indian Ridge Condominium - Ellington Road
Attorney Arnold Sbarge was present and stated that when they secured their
approved on March 8, 1983, they indicated they would only be applying for
building permits for Phase I - 56 units, which has been engineered. They
Planning & Zoning Commission 2- 7/12/83
understood they would not be applying for building permits on future phases -
until the Commission was satisfied that all its conditions had been complied
with and Phase I was built and in accordance with the approval. For that
reason, they did not make an effort to develop the plans for subsequent phases.
Since they have become aware of the Commission's interest in seeing how
these conditions would be met, they have prepared some plans, and will
present them tonight.
Mrs. Montana said she understood there was some contemplation on Indian Ridge's
part not to file the zone change which was approved last week for the 6.5 acres.
Mr. Sbarge said the reason that subject came up was that they understood
the Commission was considering altering the approval they secured on March 8th,
in a way that may have been harmful to them since they relied on the approval.
Mr. Sbarge said it occurred to him that the subsequent application for the
zone change for the 6.5 acres might have furnished the forum for contemplating
the changes on the entire approval, and if that's true, that might simply
withdraw the application for the 6.5 acres since it's not really that important
to them. However if the Commission doesn't want them to withdraw
this application, they won't as long as they can be assured that the original
approval which they have relied upon will stand.
Mr. Sbarge said he feels the crucial thing is to give the Commission what it
asked for, being the items listed in the March 16th letter of approval.
Mr. Sbarge said he and Tom Bazzano met with the staff a couple of days ago
to go over this, and he believes they comply with what the Commission wanted.
Commissioner Hallowell said he doesn't think they should go through the plans
until Mr. Sbarge knows what the concerns are. Mr. Hallowell said he is
speaking for himself, and mt the Commission, and his concern is that Phase I
is the only phase that met the conditions of approval. He said it is his
feeling that the subsequent phases, which might take as long as three or four
years to complete, as far as construction and approval, should not be filed
until they are modified as the approval goes. When a subsequent Commission
sits here and some of these Commissioners are gone and things are forgotten,
the subsequent phases could be built in accordance with the plans that have
been filed which do not have the modifications which the Commission wanted.
Mr. Hallowell said he doesn't care if they wish to file just Phase I, or all
Phases, but the modifications should be incorporated at the time of the filing.
Mr. Sbarge said he didn't think that was the original deal. He referred to
the approval letter which said 258 units were approved, but that building
permits would only be issued for 56 units in Phase I. He said they will
abide by that, and will not come back and ask for any building permits beyond
Phase I, but that it is crucial to them, as the Commissioners understood
when this was approved and the Minutes will verify this, that the approval
be for the entire site.
Mr. Hallowell said that they can file the plans for Phase I and get their
building permits, and when the modifications are made for Phase II and approved,
they can be filed. He said the point is that the Commission does not want all
these sheets filed which do not meet the zoning regulations of the Town and
approval of the Commission.
Mr. Sbarge said it was his understanding that they would file the plans as is,
with the letter of March 16th as well as the Inland Wetlands approval letter,
which contained all the conditions. Then, prior to filing for anything to do
with Phase II or subsequent phases, they would file amended mylars showing
the changes as described in the March 16th letter.
Planning & Zoning Commission 3- 7/12/83
Mr. Sbarge said in view of the Commission's concerns that future commissions
may not know what was intended, as well as their own concerns about having
an approval upon which they have relied, and in order to reach a compromise,
that it might be good for the Commission to take a few moments and review
the modified plans., He said they have met all the conditions stated in the
March 16th letter.
Sets of the amended plans were distributed to the Commission, and Mr. Tom
Bazzano produced a copy of the original plans with an over-lay showing the
modifications.
Mr. Sbarge said that if the modified plans are approved, they are preia red to
be bound by these modifications, and the record can show that. He said they
plan to comply with all other conditions of approval, such as posting
a letter of credit for $345,000, plus paying the drainage fees, and giving
the Town the $35,000 to hold in escrow for a traffic signal should one be
necessary, within the next few days, so that the mylars can be filed.
Attorney Wayne Gerlt was present and he asked Mr. Sbarge if he understood
correctly that they were not asking the Commission to be bound by these
modified plans, but simply saying that this is what they will submit unless
they are asked to do otherwise by the Commission. Mr. Sbarge said that is
correct, but that if the Commission finds these plans satisfactory they will
commit themselves.
Mr. Tom Bazzano, the architect for the project, referred to the letter of
March 16th and noted it referred to certain sheets which must be filed. If
the Commission approves the modified sheets he is presenting this evening, he
will submit those modified sheets on mylars for filing.
Town Engineer Page noted that only Phase I has been approved by Inland Wetlands
or the Water Pollution Control Authority. The modified planssubmitted this
evening are certainly a step in the right direction, but they will have to
go back to TWA and WPCA for approval.
Mr. Tom Bazzano then reviewed the plans as follows:
Sheet #1 is the title sheet and indicates the land use data, and various
changes will have to be made to that land use data block because of the reduc-
tion in the number of units. It affected the density, type, etc. Originally
there were 15 buildings with flats, and that has now been reduced to 11,
deletl 48 units of flats. The remaining number of units are made of smaller
town house units, with 4 or 6 units. These changes will be shown on the
data block. Upon questioning by Mr. Conde, it was determined that the data
block at the moment shows 258 units, and includes the 6.5 acres. Density
is 6.41 per acre. If the 6.5 acres is removed, then the density will be
8 units per acre.
Sheet #2 is for the letters of approval.
Sheet #3 shows the phasing.
Sheet #18 shows the accessory structures. They have incorporated a storage
garage, and removed the sewer pump house from that building. The trash
enclosures have been changed to provide for completely enclosed structures
Planning and Zoning Commission 4- 7/12/83
with gates and landscaping, and these are for either one or two containers.
Sheet #19 reflects some changes. Building #2 and Building #3 did not
have garages for the end units, and garages have now been furnished. The
positioning of those buildings have been changed so that garages could
be added to these four end units. The parking has been changed to reflect
four additional garages in Phase I. In addition to that, Sheet 19A, which
is an overlay, also shows changes in Buildings #+, 5 and 6. Because of
the reduction in the number of units, two 12-unit buildings have been
deleted. In their place there will be 6 townhouse units, and 4 townhouse
units. This is all part of Phase II. Phase I does not change except
for repositioning some units to provide for the extra garages.
Sheet #20 is the original plan, and there is very little change except for
Building #7, which now has its own drive. Sheet #20A shows the main parking
off Building #20 and 21.
Sheet #21 was of major concern because of the cul-de-sac and parking.
With the reduction in the number of units, Building #23 was eliminated.
The cul-de-sac was placed where Building #23 had previously been located.
Buildings #23, 27 and 28 are now off the cul-de-sac with their respective
parking areas. Building #24 has 8 units, #25 has 8, #26 has 8, #27 has
8, and #28 has 4 units.
Planning Director DeMallie noted that Buildings #26 and #27 were moved away
from the pond, where grading work had been necessary .
Sheet #23 shows the realignment of Foster Road. Attorney Sbarge noted that
they have the deed from Mrs. Ericson, which the Town Attorney has reviewed
and approved, subject to a couple of minor changes. Mr. Sbarge further
noted that Sheet #2 3A shows some minor changes which were requested by the
State Traffic Commission because they wanted longer sight-line.
Sheet #24 has been changed from the original plans to reflect changes in
the garages. Buildings 44, 5 and 6 have not been changed because they are in
subsequent phases.
Sheet #25 and all the other sheets are the same as originally submitted.
Mr. Bazzano said that if the Commission approves these modifications, these
are the sheets that will be filed.
Mr. Conde raised a question about the pumping station, and Mr. Bazzano said
it is shown on Sheet #19A, and Mr. Sbarge added that it is in Phase II.
Commissioner Hallowell said that the Commission wants a complete set of the
plans showing these modifications.
Mrs. Montana said she thinks there should be some recreational area where
kids could play baseball, etc. Mr. Bazzano noted that Sheet #20 shows a
30,000 S. f. flat area which could be used for this purpose.
Town Attorney Gerlt said that the original approval letter should not be
modified. A discussion ensued as to whether or not the 6.5 acre parcel
should be changed from MF-A to RR. Attorney Sbarge said that they have
Planning & Zoning Commission 5- 7/12/83
absolutely no plans for this parcel whether it is MF-A or RR zoned. If
it stays MF-A it will be declared part of the condominium. Mrs. Evans
said that she does not want to ever see any development on that side of
the ravine. Mr. Hallowell again expressed concern about future Commissions
permitting development on the parcel if it remains MF-A. He noted
it should be designated on the data block if it stays MF-A, and Mr. Bazzano
suggested showing it as open space.
Mr. Hallowell said it should be understood that site plans must be filed
for subsequent phases, and these subsequent phases must be approved by this
Commission.
Attorney Sbarge then submitted a letter stating that they wished to
withdraw the pending application for a modification of the Special Exception
and Site Plan which was approved on March 8th. He further stated that
they wished the Commission to nullify and rescind the approval granted for
the zone change from MF-A to RR for the 6.5 acre parcel.
Mr. Conde moved that the applicant be permitted to withdraw its application
to modify the Special Exception and Site Plan which was approved on March 8,
1983 by reducing the size of the site from 43 to 36.E+2 acres. Mrs. Evans
seconded the motion, and it was unanimously voted in favor and so ordered.
Mrs. Evans then made a motion to nullify and rescind the approval granted
by this Commission for a zone change from MF-A to RR for approximately
6.58 acres located on the south side of Ellington Road, as shown on
a plan dated March 31, 1983, Drawing No. 1824, prepared by Igor Vechesloff,
P. E. and L. S. for Indian Ridge Condominium. Mr. Conde seconded the
motion and it was unanimously voted in favor and so ordered.
Attorney Sbarge then submitted a letter requesting a 30 day extension of
time in which to file the final plans. Mrs. Evans moved that the applicant
be granted a 30 day extension of time in which to file the final plans.
The extension is from September 4, 1983 to- October 4. 1983. Mr. Sorenson
seconded the motion and it was unanimously voted in favor and so ordered.
Mr. Hallowell made a motion to modify the March 8th, 1983 approval of the
Special Exception and Site Plan of Development for Indian Ridge Condominium,
as follows: The approval letter dated March 16, 1983, is amended as follows:
Paragraph 13 is hereby deleted.
The last paragraph is amended to read as follows:
Black and transparent mylars for Sheets 1, 2, 33, 19A, 20A2
21A, 22, 23A, 24, 25, 33, 34. 36, 37 and 38 shall be submitted
to this Commission prior to October 4, 1983 to be stamped and
signed. Sheets 25 and 34 shall indicate that they will be
modified prior to approval of Phase II. The letter of approval
dated March 16, 1983, as well as the approval letter of the
Planning & Zoning Commission 6- 7/12/83
Inland Wetlands Agency, and the letter outlining this
modification, must be reproduced on said mylars before filing.
All other terms and conditions of said approval will remain
in full force and effect."
Mr. Conde seconded "the motion and it was unanimously voted in favor and so
ordered.
2. -Compr6hensive Plan of Development - Update
Planning Director, Peter DeMallie, and his assistant, Edesse Sloan, were present,
as well as Colby Harmon, who is an intern from UCONN. Mr. DeMallie said that
Mr. Harmon has been working on the Land Use element of the Plan. Mr. DeMallie
produced a number of maps which have been prepared by the Planning Department
and explained them as follows:
A map portraying all significant residential subdivisions in Town.
This map will be made into part of the Plan.
A map depicting multi-family projects in Town, including condominiums
and the the senior citizens complex, Wapping Mews.
The property line base map which was updated along with the Assessor's
maps. The Commission allocated $500 for this, and in addition Ms. Sloan and
Mr. Harmon have spent weeks working on this maps so that a good base map
could be prepared. Eventually there could be as many as 80 maps in conjunction
with the Plan, and a good base map is essential.
The 1982 Zoning map. The map presently in circulation is the 1981
map. This map has been updated to include electric lines, zone changes,
and a number of modifications to the streets, etc.
A buffer map portraying all areas in Town where there are potential
use conflicts where buffers may be required.
Mr. DeMallie then outlined some other tasks performed by the Planning Department
including preparing a check list for site plans and subdivision; new IP
regulations incorporating noise standards, landscaping and buffering provisions;
amendments to the RR zone allowing two-family dwellings on 12 acre lots;
regulations for an A-15 and DA-15 residential zone; a new fee schedule;
noise regulations applicable to all zones; organized a tour of innovative
residential developments in the area; edited the zoning regulations to
incorporate all amendments; prepared a report on population projections -
and projected a population of 18,800 by 1985; prepared an open space
and subdivision report outlining the status of deeds for open space; and
also prepared a map of Town owned lands.
The Planning Department also prepared a summary report of all the Town owned
land including approximately 74 parcels and 700 acres. Mr. DeMallie said he
also assisted the Public Facilities Task Force in everything from Minutes to
research and prepared the final report.
Under the land use element they prepared a zoning map including the current
flood plain. They also determined exactly how much land is in each zoning
district. Mrs. Montana said that she suggested this be expanded to show
exactly how much is built upon in each zone, and Mr. DeMallie said this
Planning & Zoning Commission 7- 7/12/83
will be done at some future time. He then introduced Mr. Harman, who has
been working as an intern in the Planning Department this summer.
Mr. Harmon pointed to the land use map he has been working on, and said the
finished map will have 12 categories in all, including three residential
categories, utilities, agricultural, vacant land, public schools, open and
recreational areas and government. They are now ready to add the industrial
areas to the map. There are approximately 422 acres in industrial use and
182 acres in commercial use. That's an increase of 25% and 2916 respectively
from 1976. They relied heavily on the Assessor's office and the grand list
as a source. They also used aerial photos, filed site plans and the yellow
pages, as well as a field check in Town. They are also preparing a comprehensive
listing of commercial and industrial properties by street address, listing
the owner and tenant and acreage of the property.
Mr. Harmon said that by the time he leaves within the next couple of weeks
all components except for agricultural and vacant land will have been
completed.
Mr. DeMallie then continued outlining projects completed by the Planning Dept.
The Transportation Study was completed last summer. As part of the I-284
effort, Mr. DeMallie said he was tied up from September 1982 to February 1983
in preparing submissions, and organizing various parties in fighting I-284.
They also assisted the Avery Street traffic study which was done by CRCOG.
He said he is involved with the Public Healty & Safety Committee which is
studying sidewalk improvements and intersection improvements. He said
he understands the Public Works Department will be inventorying all the
streets and sidewalks in Town so that a foundation upon which to develop
a sidewalk policy plan can be developed.
Mr. DeMallie said he's still in the process of developing information for
a Mass Transit Plan, and is developing reports on current traffic volumes.
They have a report depicting traffic accidents over the past three years.
The worst accident intersection in Town, which is listed at number 80 out
of the top 500 in the State, is the intersection of Sand Hill Road and
Sullivan Avenue. Pleasant Valley Road over the three year period had the
highest number of traffic accidents - 43. Dart Hill Road, Buckland Road
and Chapel Road were next highest. They also identified road classifications
throughout the Town such as arterials, major or minor collectors, etc.
As part of the environmental area they have a wetlands inventory based on
the imagery done by NASA. The next step would be a field survey, but the
cost would be in the area of $10,000 and this probably won't be done.
Mr. DeMallie said he would like some feedback from the Commission on how
other boards and commissions should be approached since feedback from them
is necessary. After a discussion the Commissioners suggested a list of all
the various boards and commissions be prepared, and meetings be arranged
with these commissions beginning in September, so they can let the PZC know
what their goals are.
Mrs. Evans asked Mr. DeMallie if he was on schedule with the timetable that
was set up some months ago, and Mr. DeMallie said pretty much so. He noted
that he hoped to have a draft of the Comprehensive Plan ready to go to
public hearing in about 18 months from now.
Planning & Zoning Commission 8- 7/12/83
3. Windshire Abbe Estates, Phase II, App. #907
Attorney Harold Cunnings was present and produced a map showing the proposed
1.8 acre parcel located to the north of Lot #29 which would be given to the
Town for open space in lieu of Lot #29. A 50' right-of-way was located
in the center of the open space, and the Commissioners said they didn't
think a right-of-way was necessary. It was finally agreed it would be moved
to the westerly boundary. The open space deed would be held in escrow for
two years; and if the applicant couldn't come up with an acceptable plan
for Phase III and other open space land, this deed would be recorded.
Mrs. Evans made a motion to amend the May 17, 1983 approval in the above matter
as follows:
Paragraph 1 is amended to read as follows:
l. This approval is for 15 lots, numbered 15 through
and including 29, as shown on the aforesaid plans."
Paragraph 2 is deleted as written, and shall now read as
follows:
2. An open space deed for 1.8 acres located north of
Lot #29, with a 50' right-of-way on the westerly
boundary, shall be held in escrow for a period of two (2)
years from the date the final plans are filed. Said deed
is subject to approval by the Engineering Department
and Town Attorney.
The plans shall be modified to portray this parcel."
Paragraph 18 is amended to read as follows:
18. A drainage assessment fee in the amount of $750
shall be submitted to this Commission prior to
filing the final plans."
All other terms and conditions of the approval letter dated
May 23, 1983 shall remain in full force and effect. The
original approval letter as well as the letter reflecting this
change shall be reproduced on the mylars before filing same.
Mr. Conde seconded the motion and it was unanimously voted in favor and so
ordered.
4. App. #906 - T & M Building Co. , Country View Estates, Phase II
f Attorney William Grace was present, and stated that the areas which the
Commission previously questioned have been graded and seeded. All the
v houses have been sold.
Planning & Zoning Commission 9- 7/12/83
Mrs. Montana noted that the Commission has previously discussed approving
only a portion of the lots requested. Attorney Grace suggested all the
lots be approved, but the Commission could withhold issuing building permits
on some of the lots.
Mr. Hallowell asked the Town Engineer how he felt work was progressing on the
site. Mr. Page said that since this development started there have been nine
different superintendents on the job, and in his opinion T & M has a real
problem. He said the right hand doesn't know what the left hand is doing.
He noted that they know how to build houses, but have a hard time putting in
drainage and seeding.
Mr. Hallowell- indicated that during the past six years, there have been
problems with T & M, and at one time they even built houses on lots which
Inland Wetlands hadn't approved.
Commissioner Conde suggested that they be required to install sidewalks on
just one side of the interior street, and construct them on Avery Street,
and the other Commissioners agreed.
The Commissioners. agreed to approve the 21 lots around Cadbury Street rather
than the 40 lots .requested.
Mrs. Evans made a motion to approve Phase II of an.open space subdivision
known as Country View Estates, on property located west of Avery Street and
south of Dart Hill Road, as shown on plans prepared by A. R. Lombardi
Associates, Inc. , dated Feb. 1983, Comm. No. 77-469, consisting of 14 sheets,
subject to the following modifications:
1. This approval is for 21 lots, numbered 30 through and
including 39, and 59 through and including 69, as shown on
the aforesaid plans.
2. An open space deed for the area designated "Connecticut
Light & Power Company Easement" on Page 14, together with a
triangular parcel located in the southwest corner of the
site adjacent to the easement, shall be submitted to this
Commission prior to filing said plans. The deed shall be
held in escrow after it has been approved by the Town Attorney
and Town Engineering Department until the subdivision is
completed and this Commission can recommend acceptance by the
Town Council.
3. A deed for the roadway must be submitted to this Commission
prior to filing said plans and must be approved by the Town
Engineering Department and Town Attorney, and will be held
in escrow until acceptance of the roads by the Town Council.
4. Concrete sidewalks, built to Town specifications and in
accordance with Section 2.5.h of the Subdivision Regulations,
must be installed on the west side of Cadbury Lane to a point
approximately half-way around the cul-de-sac.., and on the west
side of Avery Street beginning where a proposed road in a
future phase intersects with Avery, and continuing in a southerly
direction for approximately 1200 feet.
Planning & Zoning Commission 10- 7/12/83
5. Street lighting shall be installed at the intersection
and cul-de-sac and shall- be in accordance with the policy
established by the Town Manager.
6. All disturbed areas in Phase I shall be stablilized, subject
to approval of the Town Engineer.
7. The building located between Lofts #61 and #62 shall be removed
prior to filing the final plans.
8. The data block shall be modified to show all open space, as
well as the correct number of lots approved.
9. A drainage assessment fee of $1,050.00 shall be submitted to
this Commission prior to filing the final plans.
10. The surety bonds totalling $255,000.00 currently being held
by this Commission shall be amended to indicate that Phase II,
as well as Phase I of this subdivision, is covered.
11. A liability insurance policy shall be submitted to this
Commission naming the Town of South Windsor as an insured with
a combined single limit for bodily injury and/or property
damage in the amount- of $1,000,000.
12. If, for any reason, finished grading and other site work is
not completed, the Town Engineer shall determine the amount
of a cash bond to ensure final grading and site work. This
cash bond shall be submitted prior to the issuance of a
Certificate of Occupancy.
13. This approval is subject to the conditions of approval of the
Inland Wetlands Agency.
14. No building permits will be issued until the aforesaid conditions
have been complied with and the final plans have been filed
in the office of the Town Clerk.
15. Street names and locations of fire hydrants are subject to
approval of the Fire Marshal of the Town of South Windsor.
Street name signs and supporting posts shall be installed
by the developer in conformance with the standards of the Town
of South Windsor and at no expense to the Town.
16. Drainage for this subdivision is subject to the approval of the
Town Engineer.
17. All lots shall be connected to the Town of South Windsor sanitary
sewer system and are subject to approval of the Water Pollu-
tion Control Authority.

setting up a separate bond for Section II of Country View Estates. He
established a sum of $115,000.00 as the amount he felt was adequate to finish

Dear Mrs. Reinhard:
Re: Street name
This will acknowledge receipt of the petition signed by residents
of Cadbury, requesting that "Lane" be added to the name Cadbury.
The Planning & Zoning Commission has no objection to the addition of
the word "Lane" , since the Town of South Windsor has not yet
accepted the street.
However, the subdivision mylars which the builder (T & M) filed in
the Town Clerk' s Office must be corrected, and new street signs
should be erected on the street. These costs must be borne by
the residents requesting the change. There is also a fee to file
the mylars in the Town Clerk' s Office, which I believe, we may be
able to waive.
If you wish to pursue this matter, please contact the Commission' s
secretary, Mrs. Graney, in the Town Hall and she will explain to
you the process of obtaining new mylars and the necessary street
signs .
Yours very truly,

Dear Mr. Gilligan:OCT 30 M
We, the residents of Cadbury, respectfully request y ur c%q th Windsor
sideration in the addition of the word "Lane" to Cadbury. PINhing & Zoning COmft,.o,ao
Many places of business now using computers demand a Lane,
Rd. , etc. behind the street name, and we have found the lack of one to
be an enormous problem and a constant source of aggravation. We have
chosen "Lane" as a suitable, complete street name.
You may contact either Carol Reinhard (644-9089) or Carol
Mamlok (644-3666) concerning this matter.
We look forward to hearing from you at your earliest conven—
ience.
Sincerely,
