Items still needed to be completed at 236 Kent Lane, South Windsor 1) Lower metal piece of window well in back of house. 2) Properly correct white fascia on gables of house so buckles are no longer evident. 3) Secure loose vinyl siding on front of house underneath far left master BR window. 4) Clear weeds, grade, rake & seed approximately 15 foot wide section of lawn between garage side of house and swale. New Items that need to be completed at 236 Kent Lane South Windsor 1) Properly secure small shingled roof above bay window in rear of house. 2) Grading of lawn directly in front of house from edge of driveway to left side of house needs to be built up to proper height for sufficient water drainage. Water is currently being forced toward foundation of house due to incorrect initial grading of lawn.) 3) Sidewalk in that area will need to be removed and a new one poured to the correct new grade with expansion joints. (expansion joints do not exist in the current sidewalk and cracking would probably occur in the winter thaw.) 4) There are also a couple of areas in back of house that need to be properly graded to drain the water away from the house where puddles are currently accumulating. 5) Cracks in foundation walls need to be repaired as advised in report from engineer. 6) Remove temporary wood & staple supports in foundation with the proper permanent supports for the main support beam. Anthony Bianca, Jr., ATB Construction From: Rick Sheehan Date: September 28, 1993 S EP 2 9 1993 Re: Follow up of our Meeting on September 24, 1993 South Windsor 13UILDING DEPARTMENT Tony, Just to follow up and confirm what was discussed and decided on when we met at my house last Friday, September 24, and walked through the punchlist items (see attached) which you recieved the week of 9/20. After talking with you and John Miller last Friday, it was my understanding that begining today (9/28) John would begin tearing up the existing sidewalk from the front steps to the driveway. This was being done in order to lay additional top soil to correctly raise the level of the grade in front of the house so that water can sufficiently run away from the house rather than towards the foundation as it is now. Once the additional top soil was added, a new sidewalk would be poured with expansion joints so that cracking would not occur after the winter thaw. Cracks in the foundation was another major concern coupled with the grade of the front lawn because every time it rains, we get a substantial amount of water in the basement. I spoke again with you at home on Monday night (9/27) because of my concern with the amount of water we had in the basement from Monday's rain and you reassured me that your understanding was somebody would be out on Tuesday (9/28) to fix the cracks in the foundation. My wife then received a phone call this morning from you delaying this fix until Thursday at the earliest. I would think a more responsive action would be taken to alleviate this problem because of its severity and some of the water damage we've already incurred to items in the basement. As far as the remaining items go on the attached punchlist, I was left with the impression from our conversation that those would also be completed by the end of this week, October 1, 1993. Sheehan, Jr. OCT 2 1 1993 Date: October 19, 1993 Re: Our Conversation on October 13, 1993 South Windsor BUILDING DEPARTMENT Tony, I want to thank you for your promptness in getting back to me last Wednesday, October 13, (after our October 12 telephone conversation) telling me that you had put a phone call into Violette Silvester & Sons waterproofing contractors for them to schedule a time with me to come out and look at our foundation cracks and other areas of water leakage into our basement. I understand John Miller also put a telephone call into them the morning of October 14 to have them contact me to schedule an appointment to view the problem areas. I appreciate your original effort on September 30 to attempt to repair some of the foundation cracks from the inside by applying Waterplug. Since that didn't work as we found out with the heavy rains on October 12, I value your decision to have Violette Silvester & Sons professionally repair our foundation cracks as well as additional water leakage areas, through the window wells and hatchway door. On Friday October 15, I spoke with Bill Silvester, Sr. and scheduled Saturday morning October 16 for Bill to meet with me at my residence to view the above mentioned areas inside and outside of the basement. After meeting with Bill he was going to have an estimate or proposal for the work sent to your office and a copy sent to me. I then received a phone call from Diane at Violette & Silvester's office on Monday, October 18 to confirm my mailing address and to get your address so you could receive the proposal. Diane also told me they were going to schedule the work to be done on November 1. I asked her if it would be possible to move that date ahead for fear of more water problems due to rain before that date. She was going to check on that and get back to me. When she asked about payment, I told her she would be best off talking to you or John Miller about that since I wasn't sure how you wanted to handle that matter with them. If you have any questions regarding this matter, feel free to call me or Violette Silvester & Sons at 289 - 3466. Sincerely, 4 1 C IG SHe:eW14 cc: Kevin Rennie, Atty. Sheehan, Jr. Li `l 6 7 S`1 OCT1 4Date: October 13, 1993 199j Re: Follow up of our Conversation on October 12, 1993 South Win Cls or Tony, BUILDING DEPARTMENT I'd like to reiterate my concern over the attempted repairs to the cracks in our foundation walls as I expressed to you in our conversation on Tuesday evening, October 12. With the heavy rains we had on Tuesday night, it was the first opportunity for me to see first hand how the recent repairs to the foundation walls would hold up. As I told you on the phone, the result was not very good. We still experienced excessive water entering the basement through the same (now patched) cracks and through the window with the window well and plastic well cover and three new additional areas. Through the hatchway door in the basement, through the base of the rear door between the kitchen and laundry area and also through the lower corners of the rear garage door. I expressed to you my interest in again repairing these problems in a prompt manner in order to avoid further water problems. I would also be more than happy to go over these problem areas with you should you wish to see them, especially the new areas mentioned above. You had also mentioned the idea of having someone other than your own people look at and correct the problem. I think a reliable waterproofing contractor would be an excellent idea. However, there is probably still an issue that needs to be looked at, the grading of the lawn immediately around the house. If not done properly, that would also attribute to water getting into the basement. It appears that the window well in the back is not quite working out as originally planned. Rather than keeping the water away, it's accumulating the water and allowing it to rise to the level of the window and enter the basement. I think it may be best if the window well was removed altogether and top soil with grass seed added. At least this way, the water should not accumulate to the level of the window. I look forward to your timely response in handling these items. Please feel free to call me with any questions or to set a date for repair work. Sincerely, rim cc: Kevin Rennie, Atty. More than 3 months has since past and we are still waiting for this item to be fixed. During one of our telephone conversations during the past 4 or 5 weeks, you told me that someone would be out within a week or two to take care of this. It has now been a few weeks since that conversation and the item still exists. This piece of siding was nearly torn off by the blizzard we had back in March and with winter quickly approaching, I'd like to have this piece of siding corrected as soon as possible to avoid any further damage to this or other connected pieces of siding. As of today, we are now into the 4th day of having no water in that bathroom because of the frozen pipes caused by the frigid outside temperatures. This is the same occurrence we encountered last winter shortly after we moved into this new house at which time the plumber was called in and we were told the problem had been resolved. Which we can now see is not true. After I left four messages beginning on Monday morning (12/27) to the plumber who originally laid the pipe, I finally received a phone call back from him Monday evening around 9:00 pm. He told me then that last year he thawed the pipes so that we could get water. He also said that he told you and John Miller in order to properly remedy the problem so that it wouldn't occur again, that you would have to put insulation on the outside of the pipes between the garage firewall and the pipes. Currently, the insulation is only between the pipes and the interior wall which does no good against the cold. It appears that this may have never met code and may have been overlooked back when the walls were first insulated. Having heard all this, I then called you first thing Tuesday morning to inform you of the frozen pipes and you assured me that someone would be out as soon as possible that day. I believe you also told John Hogan (So. Windsor building inspector) that you would have somebody out by the end of the day Tuesday and would wrap the pipes and get the water flowing again. As you know, Tuesday came and went and when I talked to you on Wednesday I got the same promise again, that someone would be out after I returned home from work after 4 pm. Again I got home and nobody showed up that evening. I then put in another phone call to your office and spoke to Carol Gallant who was going to speak to you once again about this issue. As of noon Thursday 12/30, I still have not heard anything from you or your office regarding when someone will be out to properly insulate these pipes. I must say that I am very dissappointed in your responsiveness and apparent lack of concern regarding this matter, although I should be used to this by now from you. Should the pipes burst, I guess you and I will be looking at an even bigger problem. In the meantime, this has been a big inconvenience for us. I hope you can find the time to resolve this matter soon. Sincerely, cc: Kevin Rennie, Atty. Home Builders Association of Connecticut, Inc. The extra insulation you added around the exposed pipes in the attic space above the garage so far appears to have resolved the problem of frozen pipes leading into the half bath. We have had a few days of sub zero temperatures since the additional insulation was added on January 18 and have not had either the hot or cold water pipes freeze completely. A couple of times the cold water seemed to be partially frozen so I just let the cold water run through real lightly for a short period of time to try and thaw the pipe if in fact it was partially frozen. I will continue to keep an eye on the pipes during the sub zero temperature days but so far it would seem as if we shouldn't have any further freezing if it hasn't occurred yet considering the below normal temperatures we've had this winter since the insulation was added. My only regret is that it took three weeks and a burst pipe before the problem was seriously addressed and apparently corrected. I did want to extend my thanks to you for the quickness in which you and the plumbers responded to my phone call about the burst pipe on Monday evening, January 17. I called you about 5:30 that evening and within 90 minutes you guys arrived, with freezing rain and icy road conditions, to repair the pipe. I commend you for your quickness in responding to this problem as promptly as you did under the circumstances. After adding the additional insulation on the 18th, you suggested that we wait a while to be sure that resolved the problem and then you would come back to replace the 5/8" sheetrock in the garage that had to be cutout in order to repair the split pipe. You mentioned you could still replace the sheetrock and do the taping in the winter with the use of a portable heater in the garage. To me it's not something that has to be done while the temperatures are still around freezing. I can wait until spring for the sheetrock repair if you'd prefer. Maybe we can say by the end of April that should be done. Please feel free to call me at your earliest convenience to set up a day and time to replace the sheetrock in the garage firewall. Thank you, c cc: Kevin Rennie, Atty. John Hogan, Town of South Windsor, Building Inspector Home Builders Association of Connecticut, Inc. 23 To: Anthony Bianca, Jr. ATB Construction From: Rick Sheehan, Phone 275-4398 Date: April 14, 1994 Re: Outstanding Items Tony, As you are probably aware, your sheet rocker, Guy, stopped by our house on Tuesday, March 29, 1994 to put an initial coat of joint compound and tape on the sheet rock damaged from a frozen pipe that burst in the winter on the firewall side of the garage. This is where they had to cut out a good portion of the sheet rock in order to access the broken pipe. Guy did mention to me when he was there, that he would have to return to put on another 2 or 3 coats of compound in order to properly cover up the seams. I realize that in my last letter to you, I thought by the end of April would be a reasonable amount of time to perform this and the weather would also be more appropriate for the compound to dry. I just wanted to follow up with you regarding this issue and look forward to hearing from you soon regarding subsequent dates that Guy will be out to continue and complete the compounding of the sheet rock. The other outstanding issue I have concerns the window well you installed in the back yard around one of the basement windows. I understand the reason you had to install this window well is because of the poor grading of the lawn. Without the window well, the bottom portion of the basement window would be below ground level, which would be a problem with water constantly entering the basement through the bottom of the window whenever it would rain. However, even with the window well, we've still been experiencing water problems consistently with this window throughout the past year. I thought these problems were going to be remedied back in October of '93 when you hired a professional waterproofing company to repair multiple cracks in our foundation. At that time, they had not been told of any water problems concerning the window well in the rear, as well as water problems with another crack around the hatchway. If you recall, the day they arrived at the house to repair the cracks (October 25), I telephoned you and reminded you once again about the window well and hatchway water problems that we were experiencing and that the price for them to take care of the problem while they were already there would be much cheaper than if they had to make another trip back. You agreed then that they should definitely address those problems while they were already there handling the other foundation cracks, which they did. Unfortunately their repairs to the rear window well did not work. Water had still been rising inside the window well and I have been bailing water out this spring any time it rained and even on a warm day when snow was melting with the ground being so saturated. The water would come in from the bottom of the well and rise until it came into the basement through the bottom of the window. I then contacted Connecticut Basement Systems (the company you hired to perform the work) and discussed this matter regarding the window well with them. After researching, they informed me that you never paid the full amount of the bill. Basically that you never paid the amount for the window well and hatchway leak that they performed per your okay during our telephone conversation October 25th, the morning they were out to do the work. I then telephoned you twice on Monday March 21, 1994 regarding the window well and left 2 messages with Carol Gallant who informed me that you were out of the office but would return my calls when you got back. It's now been over 2 weeks and I still have not heard from you. That Monday evening it rained quite heavily and that, coupled with the melting snow, had me removing forty- four 5 gallon buckets of water from the window well between lam and Sam. I then hired someone on my own to divert the water away from the window well in order to alleviate this problem. Because of your desire not to pay Connecticut Basement Systems for work you okayed and subsequently their policy of not guaranteeing work that is not paid for, I had to do something soon on my own since you chose not to return either of my phone calls regarding this and my cellar was flooding. I hired someone to dig and install a dry well that would take the water away from the window well and divert it to another area of the back yard far enough from the house where drainage is better. So far this seems to be working fine. I am submitting to you the bill for the work performed on this drywell and would expect that you would take prompt action to reimburse me for the amount listed which I have already paid. If you decide not to reimburse me for the work performed, I will have to pursue further action. I believe 30 days from now, approximately May 15, is fair enough for me to expect payment from you and eliminate you from any further responsibility regarding this window well.
