At this time we feel the attempts that the builder has made to correct these issues have been at best, superficial, and have not corrected the deficiencies. The first issue is in regard to the extensive number of cracks that began in our basement on June 27, 1997. The problem was first brought to B &M's attention on July 3, 1997. The first crack measured 16 feet and within weeks another 7 foot crack appeared. B &M Enterprise was informed that not only were there cracking issues, but whenever it rained, water could be visibly seen coming through these cracks. A representative from B & M(Dave) acknowledged these cracks and said it was normal settling of the house, however, I do not believe that crack with water seepage is normal for a house less than one year old. On August 12, 1997, B & M was again notified that a third large crack was evident on the basement floor. Again there was no response from B & M. Enterprises. We continued to update B & M on a monthly basis of the ongoing and continuing cracking problems. On October 10, 1997 , we received a letter from B & M maintaining these cracks were normal and were due to the expansion of concrete. By November 4, 1997, water was not only evident on the basement floor, but also through the dolpin pins. On November 12, 1997, a subcontractor employed by B&M inspected the cracks and indicated he would return when it was raining. That person has never returned. To date we have experienced the following cracking problems in our basement: 1) 16 1/2 ft Crack from wall to wall 2) 1 3/4 ft Crack from crack#1 towards stairs 3) 2 1/2 ft Crack from crack#1 towards back door 4) 12 ft Crack from garage wall to stairs 5) 12 ft Crack from crack#4 to corner by AC compressor 6) 1 ft Crack from crack#5 towards hot water heater 7) 7 ft Crack from corner of garage to window by AC compressor below utility room 8)4 1/2 ft Crack runs from garage to outside house by utility room 9) 10 ft Crack from south wall to hot water heater 10)2 ft Crack from crack#9 towards window on west side 11) 2 ft Crack from crack#9 towards front of house 12)Numerous hairline cracks under Ping-Pong table 13) 1 1/2 ft Crack from corner support of front stoop diagonally to west wall 14) 3 1/2 ft Crack middle of lolly column 15)4 ft Crack in foundation wall from top to floor 16) Left side foundation wall leak from top to bottom 17) Right side of front foundation wall water leak from top to bottom, forms puddle 18) Ramp: 2 cracks on each side of wall B & M Enterprises were notified each month from July of 1997 of the ongoing and increasing number of cracks in our basement. We understand that some cracking is normal and expected, however,we believe the amount of cracking we have experienced , coupled with the presence of water, indicates a much more serious structural problem. After months of complaints, on April 3, 1998,the dolpin pins were plugged with cement and on May 12, 1998, a B & M employee came to chisel out some of the cracks, and then filled them with silkaflex. However, now, not only are these cracks unsightly in appearance, but after speaking to a number of concrete specialists, we seriously question the long term durability ofthis procedure. Currently, not only do we have an unsightly basement, but one that may continue to have water problems. For a home that is not yet one year old these problems are unacceptable. (Please see exhibit 1.) The second issue is in regard to the multiple drainage issues in and around 22 City View Terrace. Please refer to exhibit#2. At and since our closing on June 10,1997, we notified B &M Enterprises of the poor drainage conditions surrounding our home. There were and continue to be deep gullies and ruts in our back and side yard that have added to the pooling of water at the bottom of the property(see exhibit 3). Last summer we were told by B & M that the situation was temporary and would be addressed in the fall of 1997. However, the ruts have not been adequately addressed and are not only unappealing aesthetically, but these ruts are also trip hazards that could result in liability issues. We now believe that a drainage problem exists because Mr. Edwards did not adequately address the run off ofwater behind 22 City View Terrace (both the grassy area and the access road). It seems unfair that because of Mr. Edwards negligence, this issue should now become the responsibility of the Condominium Association. The third and final issue is the poor installation of the driveway at 22 City View Terrace. On June 24, 1997 it was reported to B & M that there appeared to be a problem with water pooling in approximately six different areas of our driveway. This concern was then reported each successive month, 7/21/97, 8/6/97, 9/12/97 and 10/3/97. We were concerned that with the onset of winter weather these puddles would freeze and become potential slip hazards. Again Mr. Edwards chose to ignore these concerns and did not inspect these asphalt problems until November 12, 1997. Without advance notice from B & M,we returned home in December and found their asphalt contractor burning the asphalt in our driveway. Unfortunately the contractors attempts to correct the problems were unsuccessful and we were told that due to the cold weather conditions the problems with puddling could not be addressed until spring. To this date the puddling continues to be a problem, therefore,we had an asphalt contractor inspect and review Mr. Edwards plans for repair. We were informed that what Mr. Edwards was offering was no more then a sealcoat, and that the problem most likely would continue. For a home that is less then one year old,we feel the construction problems we have experienced have been extensive. Hopefully, with the town's building official's help these problems will be resolved. Let me end here with a footnote on Mr. Edwards behavior this morning. Not mentioned in this letter were the interior problems with B &M Enterprises'workmanship. Yesterday Mr. Edwards sent over a contractor to do a repair at 8:00 in the morning. We were not notified of this arrangement and therefore in bed when the contractor arrived. We asked that the contractor make an appointment to come back so that we would be ready for his visit. Today Mr. Edward phoned us and was extremely rude stating from here on "No issues that we brought forward would be addressed!". We are asking for the assistance of our building inspector to help resolve these issues. Thank you in advance for your attention in this matter. Sincerely, Marian J. BUILDING DEPARTMENT South Windsor Town Hall 1540 Sullivan Avenue South Windsor,CT 06074 Dear Mr.Collins: Recently,we received a copy of the letter that was sent to you by Mrs.McCaull and Mrs.Tripp of 22 Cityview Terrace. In that letter, the resident mentioned three major problems they have had since they moved into their house on 6/10/97. Unfortunately, they have made it sound like we have made no efforts to fix any of these problems when,in reality,we have attempted to fix these and many other problems for them. But they did not mention any of these in their letter. Please notice the following attempts we have made to address and correct their complaints: 1) 11/21/97-The faucet in the bathroom was leaking. The problem was fixed 11/25/97. 2) 10/15/97-There was a cracked tile under the toilet. B&M arranged to have it fixed between 10/29 and 10/31. But then the resident wouldn't allow the work to be done. 3) 11/6/97-Hot air was escaping around the fiunace in the basement. This was completed on 11/11/97. 4) 10/15/97-The resident wanted 2 quarts oftouch-up paint. This was delivered 11/6/97. 5) 10/15/97-There were ruts on lawn and there were grading problems around their house. These were taken care of 10/16 and 10/17. 6) 10/1 5/97-There were a couple doors that did not close properly and there was a gap in the basement door which was letting air and light through. This was taken care of 10/24/97. 7) 8/27/97-The resident had repeated problems with the toilet not flushing properly and the sink was leaking water under sink cabinet. This was taken care of that same day. 8) 1/5/98-The door between the laundry room and the garage did not shut properly and did not lock. This was completed 1/19/98. 9) The residents complained about a miniscule knick in the countertop. The cabinetmaker replaced this for them on 9/9/97. Then, they complained the new countertop was different and was not installed properly. However,it was the exact same countertop as the other. They practically chased the cabinetmaker out of their house because ofthis and displayed a very condescending attitude toward him. 1/6/98-The cabinet counter was coming away from the wall. It was not secured to the wall and moved. This was completed 1/19/98. 10) 1/13/98-B&M received a letter dated 1/9 that reported a problem with a bubble on the wall in the bathroom. On Thursday,5/28/98,our drywall contractor called at approximately 8:00 a.m.to see if he could come over to fix this and they said yes. But when he got there,Mrs. McCaull said she couldn't decide what to do and needed to call her daughter and she refused to let the contractor correct the problem after he made a special trip over there to fix it. 11) Regarding the cracks in the basement,an architect inspected the cracks and determined them to be shrinkage cracks. However,we,upon the resident's request, sent 2 workers to fill these cosmetic cracks to please the resident. 12)Also,regarding the problems with their driveway, they mentioned in their letter that"Mr. Edwards offering was no more than a sealcoat." That is not true. Enclosed is a copy ofthe 1 letter we sent them regarding how we would go about fixing their driveway. As you will see, this would have been a very extensive process, not just a"sealcoat". Unfortunately, they never responded to our letter, even when we sent them a follow-up letter the next month due to their lack of response to our first letter. So this problem remains unresolved because of the resident's lack of cooperation with our efforts, not because of Mr.Edwards lack of response. 13)The resident complained there was water in the basement. We identified this as a leak through the dowel pins, which we corrected, and since we have received no further complaints regarding this,we are under the understanding that there is no longer any water problem in the basement. 14)The resident has experienced various problems with screens and windows in their house. However, these have all been add and taken care of by an Owens Corning representative. 15)There were four barrels adjacent to the Collins property line next to Mrs.McCaull's and Mrs. Tripp's unit. The attorney for the landowner was responsible to assure us that these barrels could be removed from the property. He employed Don Dobay,an environmental specialist, who determined that the barrels did not contain any hazardous waste aside from diesel fuel. We've since removed the barrels upon the approval of the landowner's attorney. Mrs. McCaull implied that B&M placed these barrels there, which was not true. However,B&M did remove them in May of 1998. As you can see from the detailed work records we have kept,we have made every effort to address and take care of all of Mrs.McCaull and Mrs.Tripp's concerns. The reason why we have done this is because we are very concerned with making our customers happy,as a good reputation means a lot in business today. With Mrs.McCaull and Mrs.Tripp,we've gone the extra mile, doing even more than we were requh ed to,all in an effort to try to satisfy them. Our records, our workmen, and our subcontractors can substantiate all the claims we have made in this letter. Ifyou would like to contact any of them with regard to this situation, please feel fee to call us for their names and phone numbers. Thank you for your prompt attention to this matter. Box 1060 South Windsor,CT 06074 April 25, 1998 22 Cityview Terrace South Windsor, CT 06074 Dear Ms. McCaul and Ms. Tripp: In response to your complaint of puddles in your driveway, Rick Winiarski, paving manager and Brian Johnston, paving superintendent of Galasso Materials examined your driveway on 4/23 and on 4/24, after it had been raining to determine the severity of the problem and what could be done to fix the problem. Although, it was of their professional opinion that this was not a significant problem they are willing to repair the driveway in the following manner. The two low spots will be heated and scratched out. A driveway filler will be applied to level the area. A sand texture coat would then be applied to the entire driveway, not including the access road. This will eliminate water from collecting in those areas. If you would like us to proceed with this repair as stated please sign this letter and return it to us as soon as possible. At that time we will make a copy of the signed letter for your records and we will contact Galasso Materials to schedule the repair. Sincerely, B & M Enterprises. Inc. Yes, we would like to have the driveway fixed in the manner described above. Signature: Date:
