He stated he wishes to add a six-fo extension to the end of his house plus a two-car garage. He stated that about one-half of the houses on this street have garages. In reply to a question from a Board member, Mr. Fournier said there was about 45 feet from the property line on the proposed garaqe side of the house to the adjacent house. He said his sign had been posted and there were no objections from his neighbors that he knew of. It was noted for the record that no one spok, in favor of or in opposition to this appeal. Mr. Fournier noted that the application does not address the non-conforming front yard. He said the house encroaches five feet on the building line, an( the addition will only encroach three feet. Mr. Murrin said the existing hoi and the addition are still encroaching on the 50-foot building line and shout have been included as a variance in the application. He said the Board woulc have to discuss whether the application should be reheard next month. He sa: Mr. Fournier would be notified. Application #1598-85 - Richard C. Carabillo Attorney Frank Russo appeared before the Board representing this application., He said several of Mr. Carabillo's neighbors had stated they want d to be in attendance, and since they were not yet present, he asked that this appeal be postponed. Application #1599-85 - Walter Kupchunos, Sr. Attorney Wayne Gerlt appeared before the Board representing this application. He said Walter, Jr. and Al Kupchunos are requesting permission to put an office into a former tobacco warehouse and processing facility next to Sophie Kupchunos' house on Ellington Road. He said that presently Walter an Al are operating their businesses out of a garage on the other side of Sophie house. This Board granted a variance for that use several years aqo. They need more space at this time and plan to expand and renovate the building in question. At the present time they will not be occupying the entire building even though the entire structure will be renovated. Mr. Gerlt stated that they may wish to rent a portion of the building out to other office uses. There is no intent to change the appearance of the building except to improve it. Any additional parking will be to the rear of the building. He said them is no further need for this building for its original intended use, and it would be very expensive to demolish it. It was noted for the record that no one spoke in favor of or in opposition to this application. In reply to questioning from the Board, Al Kupchunos said they plan to gut the inside of the building, insulate, do electrical work, sheet rocking, carpeting_ He replied that the building is 32' x 621 . He said the cost of renovating it will require them to rent a portion at this time. However, if their businesse continue to grow, they will soon need all of it. He said the number of car trips a day is presently 3 and might go to 6. He also said they will be using the existing driveway and there will be no additional cut onto Ellington Road. A He noted that all of the locations for the signs are the same as in the past d except the one on the corner of Ellington Road and Chapel Road which has been tes moved across the street. In granting this approval he noted that all previous ye conditions of approval shall remain in full force and effect. ing j The motion was seconded by Mr. Earley and voted unanimously in favor. one EFFECTIVE DATE: April 19, 1985 m Application #1596-85 - Red Star Express, Inc. The sign shall be illuminated from within and shall be illuminated during the hours when the terminal is in tion. operation. The sign is necessary for truckers to locate the terminal. The motion was seconded by Mr. Steben and voted unanimously in favor. EFFECTIVE DATE: April 19, 1985 Application #1597-85 - Richard E. Fournier sly Mr. Earley moved to readvertise and rehear this application at the May 2, 1985 meeting. at no additional cost to the applicant due to the fact that the required front yard variance was not advertised. Lons The motion was seconded by Mr. Warren and voted unanimously in favor. Application #1598-85 - Richard C. Carabillo ted Mr. Steben moved to grant a variance to Section 3.10.3.a and Section 5.2 of the Zoning Regulations to allow construction of a kitchen addition to a non- n conforming home/office structure within the required front yard at property ss located at 55 Windsorville Road, South Windsor. He noted that this home pre-dats zoning and the addition is to the rear and ct will not be visible from the street. The motion was seconded by Mr. Earley and voted unanimously in favor. EFFECTIVE DATE: April 19, 1985 Application #1599-85 - Walter Kupchunos, Sr. Mr. Steben moved to grant a variance to Section 4.2 and Section 4.1 of the Zoninq Regulations to allow a business/professional office on property known as 1959 Ellington Road, South Windsor in an existing_ concrete and wood frame warehouse, subject to the following conditions: S a( 1. There shall be no additional driveway cuts onto Ellington Road. 2. The business/professional office use of this building shall be "passive," generating low volume traffic in and out of the site) . 3. A site plan of development shall be filed with the Town of South Windsor Planning and Zoninq Commission. He noted that this was a renovation of an existing building which has been devoted for many years to another purpose. He also noted that permitted uses for this building could be more objectionable than a "passive" office use. The motion was seconded by Mr. Warren. Mrs. Cottle stated that although she has no problem with the proposal by the Kupchunos brothers, she is concerned about a variance which always stays with the property and feels it is "spot zoning." 9teben, Warren, Earley and Murrin in favor; Cottle opposed. The motion was carried and so ordered. EFFECTIVE DATE: April 19, 1985 Application 01600-85 - Joseph P. Lewis and Dolores O. Lewis Mr. Earley moved to deny a variance to Sectian 4.3.1 of the Zoning Regulations to allow a woodworking shop on a residential lot, secondary to the residential use of the property, located at 850 Ellington Road, South Windsor. He noted that no hardship was demonstrated and in accordance with State of i Connecticut General Statutes, any variance granted must be based on exceptional difficulty or unusual hardship. The motion was seconded by Mr. Warren and voted unanimously in favor. Application #1601-85 - Town of South Windsor Water Pollution Control Authority Mr. Steben moved to grant a variance to Section 5.2 of the Zoning Regulations to allow extension of the existing Municipal Garage to result in a front yard dimension of 33 feet (17 foot variance) , at property located at 1 Vibert Road, South Windsor. He noted that upgrading of the facility is required by the Department of Environmental Protection, and the driveway, existing structures and equipment restrict the directions for expansion. He also noted that there is little likeli hood of other development in the area. The motion was seconded by Mr. Warren and voted unanimously in favor. EFFECTIVE DATE: April 19, 1985 Sydnie R. Landscape bond $ SJ G) Mr. Joseph Krawski, 215 Foster Street, spoke in favor of this application. He said he was the largest owner of asperagus in the State and he would like to preserve this by delaying development of the entire rear parcel. Mr. Linc Streeter, 259 Foster Street, spoke in opposition to this application. He stated he lives on lot #1 of the street developed property. He said he is not in opposition to development of the entire parcel, but is in opposition to a lot in the rear without an approved street, sewers, sidewalks, etc . He said it would be uncharacteristic for the neighborhood. Mr. Fred Kopper, 1 Autumn Drive, spoke in opposition to this appeal. He said his concerns are the same as Mr. Streeter' s. ry Ms. Carol Burbeck, 241 Foster Street, spoke in opposition to this appeal. She said she was concerned about an un- improved road and lack of sewers. Mr. Philip Pierce, 179 Foster Street, spoke in opposition to this appeal. He said he would prefer the entire area developed instead of just one lot. During questioning from the Board it was established that the "future road" was approved as part of a plan for future development. Mr. Murrin asked what- the- difference was in elevation between Foster Street and the driveway. Mr. Cummings replied that the engineer has this information. He said t Planning and Zoning Commission would address this problem. It was also determined that putting in the road would cost approximately $150. per foot . It was also stated that i= it would not be economically feasible to bring in the sewers from the street for one lot .w, Mr. Linc Streeter said there is a drop-off between the road and the driveway, and he felt the neighborhood would prefer entire development of the parcel in the rear. Ms. Burbeck stated that the drop-off between the street and the proposed driveway is about 10 feet and also is ledge . She also noted that she was told the development to the r rear would be a cul-de-sac and that Mr. Cummings had indicated it would be cut through to Felt Road. She said she bought this property because she was told there would be a cul-de-sac . Mr. Warren replied that the layout of the development and the roads would be a Planning and Zonipg Commission decision. Application #1491-83 - Kupchunos Brothers, Inc . Mr. Al Kupchunos appeared before the Board requesting a use variance on property located at 1979 Ellington Road. He said this building was used for a farm office for over 40 years and is currently not being utilized. Now that Mr. Paul Kupchunos and Mr. Walter Kupchunos, Sr. are retired, they have no use for the building. e stated that the area is adjacent to the Town Offices and ear the business community in town. He noted that there e no immediate neighbors other than family and the ndominium project across the street. He said he runs a rokerage-type of business done mostly over the phone with or 3 other employees. The traffic generated would be lnimal. He said he is presently located in East Hartford d this location would be ideal for him. He noted that the pact on the neighborhood would be virtually none andgattherewasmoretrafficandactivitywhenthebuilding s used for a farming office. Kupchunos stated that the hardship in this appeal is hat the building in question has no suitable use . He said he had spoken to all of the neighbors in the area and they ere all supportive and even enthusiastic about the idea. t was noted *for the record that no one in the audience spoke in favor of or in opposition to this application . It was determined during questioning from the Board that there would be no significant changes to the outside of he building with the exception of a new entrance . Mr. upchunos also stated that he has no intention to rent this office space and that he will occupy it. There is urrently approximately 500 feet of finished office space d 1,000 square feet of usable office space . 0RK SESSION Ayproval of Minutes he minutes of the December 2, 1982 meeting were approved r As submitted. lication 148 -8 - Colony Shops Mr. Steben did not sit nor vote on this application; therefore, e4 affirmative votes are necessary to grant or deny this appeal . Any i'ghts shall be extinguished within 30 minutes after the at business closes. he motion was seconded by Mrs. Murray and voted -unanimously a favor. EFFECTIVE DATE : January 19, 1983 Application #1490-83 - Joseph A. Krawski The Board discussed that the only hardship proposed was financial, which isn' t a suitable hardship for granting an appeal. Concern was also expressed over the precedent that _ would be set as everyone who owned rear property jumped on the "band wagon" to develop one lot without an approved road, sidewalks, sewers, etc. Mr. Steben moved to deny application #1490-83 requesting a variance to Section 5.2 and Section 5.2.3 of the Zoning Regulations to allow a lot without frontage on a public highway at property known as lot #5, which is an interior lot on the west side of Foster Street, approximately 178 feet, more or less, from Foster Street, Zone AA-30. In denying this application, he noted that insufficient hardship was shown and that a precedent would be established of developing one lot in rear land without an improved road, sanitary sewers or sidewalks. Additionally, the objections of the neighbors and the fact that this development would not be in keeping with the character of the neighborhood were taken into consideration. The motion was seconded by Mr. Murrins Steben, Murrin, Cote and Warren in favor, Murray abstained. The motion was carried. EFFECTIVE DATE: January 19, 1983 Application #1491-83- -- Kupchunos Brothers, Inc. a Mrs. Murray moved to grant application #1491-83 requesting a variance to Section 4.2 and Section 4. 1 of the Zoning Regulations to allow a business/professional office on property known as 1979 Ellington Road, South Windsor, Zones RR and AA-30, providing the structure is limited to the existing building of approximately 2400 square feet . She noted that the building is in a suitable position for a driveway, it has been an office in the past, and it is a dormant building that will not be utilized. The motion was seconded by Mr. Cote and voted unanimously in favor. EFFECTIVE DATE. January 19, 198 Sydnie R. Cote , Clerk v`; ILL,bL v r1 •J , l h GQ SUBDIVISION APPROVAL c% 1 . There is one situation that should be treated with caution, in which every effort should be made to provide stopping sight distances greater than the minimum design value. When horizontal sight restrictions occur on downgrades, particularly at the ends of long downgrades, the greater height of eye of the truck operator is of little value, even when the horizontal sight obstruction is a cut slope, and even when (on long downgrades) truck speeds may closely approach or exceed those of passenger cars. Although the average truck operator tends to be more experienced than the average passenger car operator and quicker to recognize hazards, it is best under such conditions to supply a stopping sight distance that meets or exceeds the values in Table 111-1. Lindell 9 Darlene Drive South Windsor, Ct. Re: Kupchunos Application or Professional Office on Ellington Road Property Our family is a recent addition to the town having relocated from Vernon just this summer. Our decision to choose South Windsor was based in large part upon the aggressive position the various town offices took in preserving the character and beauty of the community. As we discussed our location choice with friends, the same respect was echoed by many others praising the controlled growth and intelligent planning demonstrated by the town. In our seven years in Vernon we watched the steady growing sprawl of strip malls, condo projects and professional offices. We were pleased to think that we were moving to a community that was opposed to uncontrolled incursion of commercial growth into residential areas. The application to convert the Kupchunos property into professional office space is exactly the type of change we would hope our Planning and Zoning body would deny. It would be the first domino in an all too quick commercialization of Ellington Road. It would add traffic at an extremely hazardous point of entry and egress. It would not be in keeping with the present residential nature of the area. It does not add an essential service to the immediate community that would justify approval. Thank you for your consideration. S' cerel yy Stephen A. Lindell October 21, 1987 Mrs. Louise Evans Chairperson Planning and Zoning Commission Town Hall South Windsor, CT 06074 Dear Louise, An extension to December 17, 1987 is hereby granted to your commission in regards to the site plan which we have submitted for the professional office at 1959 Ellington Road. The Commission was quite concerned that the proposed driveway onto Ellington Road would create a traffic safety hazard for vehicles entering and exiting the site ; and that the proposed parking lot would be visually disruptive to the abutting residences .
