V.1awsan appeared and explained that the reason for requesting a variance was that the location of the present rear entrance to his home would not allow for the construction of the garage on the side of the house without blocking t the only window on that side. Lassman, 37 Lewis Streets artford,, requests variances to permit a gasoline station in an Industrial Zen , Illuminated signs in excess of permitted use and a lot Less than minim sizrm with 1 as than minimum front and rear yard lines; and a specific exception to allow a motor.fuel station with limited repairing on property at the intersection of Sullivan Avenue and Rye Street, South :93ndsor. 9 Mr. Lassman appeared before the Board representing J.E.S. Realty. He pointed out th changes which had been made in the planned service station since the appeal in Oct ber. The islands would now be landscaped rather than of asphalt, the building would now be of a colonial style and the building Would be moved on the property to conform with one of the necessary front yard requirements. The lot size will be 13#500 square feet. also, the access from Sullivan Avenue had been made safer. Mr. Cunningham and 'err. Babikian of the Atlantic Refining Company answered questions from the Board concerning the operation of the station and the type of business they effect to have. The operation will be considered as a neighborhood station With the hours set by the operator, but probably in the range of 7 a.m. to 9 or 10 P.M. Mr. Lassman stated that this is plan d as an attractive addition to the i surroundings. The property is to be owned by J.E.S. Realty, but the atlantic Refining Company will have a twenty-year lease and under this lease they will" retain all control of the gas station. Mr. Fred Babitt of Farnham Road spoke in opposition to this appeal. H stated that there was already a station ©n Rye Street which served the neighborhood and that there were enough stations closed on Rmte 5, APPLICA J.E.S. Realty Company, c/o Edwin A. Lassman, 37 Levds St Hartf ard, requests a State Hearing for a gasoline station and limited repair license on property located at the intersection of Sullivan Avenue and Rye St r Mr. Lassman stated that this was the station in question in Appeal #,44 and F " felt this use of the land would be a good one. Town attorney Frank Ahearn met with the Board to discuss the revision of th Bye-Laws. He also stated that in regard to the second appeal from the J.E.S. f Realty Company, the Board does not have to be hearing the same appeals over over again. It is up to the Board to determine if there has been a s ubstanti change of circumstances. If this is the cases the application can be heard.
