IV• JUDICIAL DISTRICT OF HARTFORD/ IfNEWBRITAINATHARTFORD
IZONING BOARD OF APPEALS OF
I THE TOWN OF SOUTH WINDSOR OCTOBER 21, 1981
I+ MEMORANDUM OF DECISION II
This appeal is from a decision of the South Windsor Zoning
l
Board of Appeals (hereinafter referred to as the "Board") granting
I I
a variance of the 150 foot frontage requirement to allow the use
of backland as a residential building lot with frontage of 50.01
feet on Main Street.
The pertinent facts are as follows: The owner of the subject
property is Mrs. Marion P. Case of South Windsor. When Albro Case,
the deceased husband of Marion P.' Case, purchased the tract in 1962,
it had approximately 254 feet of frontage on the easterly side of1
Main Street and an average depth of approximately -880 :feet. Shortly -
after thea purchase, Mr. Case conveyed the northerly 204 feet, to a
depth of 300 'feet (now known as to a third
party. He retained title to the remaining portion consisting of
11roughly 3.8 acres with frontage on Main Street of 50.01 feet. Mr.'
Case diedd Marion P. Case inherited title to the 3.8

r
Facres. Her application for a variance was granted by the Board
on October 2, 1980 and it is that action which i•s the subject of
1 this appeal.
i,
The land is located in an A-40 Residential Zone. Section
I'
1' 5.2 of the South Windsor zoning regulations requires that a
residential building lot in the stated zone have frontage of 150
feet on a public street. Mrs. Case had originally applied to the
i
IiBoard on January 10, 1979 for a variance of the front footage
11requirement to allow the construction of a single family residence
I
on the 3.8 acres. After a public hearing on that application, the
1,
I' Board, on or about February 1, 1979, voted to deny the variance
on the ground that the hardship was self-created. That denial of
iiher request for a variance was appealed to the Superior Court,
I
Judicial District of Hartford, and the Court (Bieluch, J) •sustain d
I, the appeal in a Memorandum Of Decision filed April 22, 1980. The
Court found that •"the :situation falls* outside- the ' scope of the
self-created hardship rule" since "the manner in which [Mrs. Case]
Iacquired the property [by inheritance] was purely involuntary."
I On June 20, 1980, Mrs. Case filed this application for a
variance of Section 3. 2 to permit use of the acreage as a
residential building lot with less than the required frontage.

The doctrine of res judicata is one of rest and is enforced
i on the ground of public policy"; the purpose of- the doctrine is ,
to prevent a multiplicity of suits. Accordingly,g y, where "there is
an identity of actions between the same parties, or where the
actions, actons, though not. identical,g cal, do raise identical issues, or where
some issue is necessarily involved in both actions, and those issues
are litigated before and finally determined by a court of competent
jurisdiction, they become res judicata as to the parties and those'
j who are in privity with them." (Emphasis added) Brad v.
Anderson, 110 Conn. 432, 435 (1930).
A cause of action is that single group of facts which is

Ilegal issues being raised here were actually and finally determined
by the Board on Mrs. Case's previous application and, therefore,
if those issues were before the Superior Court in the previous
appeal. The sole reason given by the Board for the denial of the
first application (according to the Superior Court's Memorandum Of
Decision) was that "the hardship was self-created." . The Memorandum
IOf Decision states that evidence was submitted to the Board that
I the land in question was not suitable for any permitted use other
i
than the proposed building lot, and, that a denial of the variance
would practically destroy the value of the property. However, on
ithe present record, it is unclear whether the Board (on the first
application), or the Court in the appeal from the Board' s first
decision determined an issue on the requested variance otherY
than that of a "self-inflicted hardship." Certainly, as the Board
concedes, the emphasis in the previous appeai wdff on the questioni

The question before the court in the instant appeal is whether

granted local zoning authorities under Section 8-6 of the General

The applicant' s attorney stated to the Board that Mrs. Case
i
had the property for sale; the potential purchaser wished to construct
a single family residence on the parcel; the land was wooded and a
certain portion thereof came under the inland-wetlands legislation;
the potential buyer wished to place the residence on a portion of
the land where it could not be seen from the road; the entire

family residence; and that the land had been "unproductive." The
Board was fully aware that the pending sale of the land was
conditioned upon the .obtaining of the- variance. - The Board also
heard that there was no other practical use that the land could be
put to other than a residential building lot; that it was open

space which produced no income, and, as the land was located ex-
elusively in an area of residential homes, there existed no other

reasonable permitted use. The Board was informed that the existing
3 economic hardship was not brought about by any action of the
i
applicant (existingowner 2 and that the land and the proposedCPP
use) satisfied the zoning requirement in all respects, except as
to the extent of frontage on Main Street. Thus, there were before
I+ the Board sufficient facts of an economic hardship establishing
that the land was not suitable for any permitted use other than
y
the proposed building lot and that the denial of the variance
i,
would result in the land, for all practical purposes, having little
or no marketable value. From such facts, the Board could reason-
ably conclude that the application of the zoing regulation to this
1 particular piece of land greatly decreased or practically destroyed
its -vaitie for any permitted use, and, that the application of the
regulation, under these circumstances, was so minimally -related
to the u oee of i

ii Plaintiffs argue that there was no evidence before the Board

before it the statement of the applicant's counsel as it related
Ito the character of the subject land, the maps of the parcel and
of the surrounding area, and it was aware of the size and dim nsions

take into account their own knowledge of the condition of the land
and any facts about the area learned through personal observation. '

zoning map and the ordinance; as their questions to the attorneys
and the public indicated they were familiar with the subject land
and the area in which it is located.4 Accordingly, the court
finds that the Board's conclusion regarding a peculiar and unusual
hardship has reasonable support in the record. Our Supreme Court
j,'has stated that a hardship resulting from a peculiar topography or
condition of- the 'land constitutes the -unnecessary or unusual type-
of
w_ y ._

proposed use of the land in concluding that the public health,

Plaintiffs also assert that the Board, in granting a variances
to permit fifty feet of street frontage in a zone requi ring one- I
hundred fifty feet, exceeded its authority under Section 11.4.1.c
i
to grant variances from a "literal" enforcement of the ordinance.
Plaintiffs argue that such a substantial variance of the front

i literal" enforcement of the zoning regulation. This contention,
however, overlooks the facts and information before the Board
i. concerning the dimensions of the land and the proposed use. In
1!considering the effect of the variance, the Board was aware that ,

authority, or abused its discretion, in granting the variance to
permit a 50-foot frontage. In this regard, the ,Board specifically
found that the reduced street frontage would not detrimentally
affect any adjacent properties or the residential character of the
I
loverall neighborhood.
Plaintiffs also argue that the Board lacked authority to-
place restricting conditions on the granting of the variance. Our
Supreme Court has stated that the "right to attach reasonable
conditions to the grant of a variance is not dependent upon express
authorization from the law making body." Service Realty Corporation

re: Historic District Jurisdiction - property at 1742 Main Street
Dear John:
The town attorney, Ralph Alexander, has determined that the
Historic District Commission has no jurisdiction over the
construction of a house which falls outside of the boundary of the
Historic District.
The Historic District Commission will have jurisdiction on the
portion of the property within the district boundaries. We expect
the owners to contact the Commission in the future regarding any
use of the property within the Historic District.
Sincerely,
Peter Walsh
Commissioner
