However, conditions that, (1) a bond be posted that is satisfactory to the town attorney in order to insure sewer hookups are made, if and when sewer hookups are made available on Sullivan Avenue; (2) also , an easement agreement would be held in escrow by the town attorney for sewer construction. It is also conditioned on site plan approval of the Planning and Zoning Commission. Also , your application No . 1412-81 for property on Ellington Road was approved for a minimum width variance of 36' , a minimum front yard setback variance of 58' and a minimum side yard variance of 4. 5' subject to site plan approval by the Planning and Zoning Commission, if the structure is to be put to other than residential use , has been granted. This action is effective February 18 , 1981 and upon filing of the enclosed form in the Town Clerk' s office. I have informed Richard Eriksson, member of the Zoning Board of Appeals, and Harold Cummings, attorney for the applicant, of my opinion on the foregoing. I would anticipate a bond being posted in an amount satisfactory to the Town Engineer to ensure the hookup to the sewer line if it is ever installed in Sullivan Avenue and the depositing with my office for the Town of an easement for the sewer hookups• When the bond of at least $1,500 per building and the easement agreement have been furnished to my office, I will notify you that they have met the conditions for the issuance of a building permit. Naturally, all of this is conditioned upon the Zoning Board of Appeals actually granting them the variancesthey request at the Board's meeting on February 5, 1981, It is my understanding that Mr. Kelly plans to ask for three variances, one being to replace the 1973 approval which you forwarded to me. The bond in these matters can take the form of assurity bond, cash, or1eal property bond. Being in an RO zone, public sewers are normally required, however, a variance permitting a septic system for one (1) 5,000 sq.ft. building has been granted and takes effect once a document requiring eventual public sewer hookup has been filed in the land records. Accordin 1 , after this document has been filed, a building permit for one kl) 5,000 sq. ft. building only, may be issued. Permits for the other two (2) buildings approved by the Planning and Zoning Commission must await variance approval for the Zoning Board of Appeals.
