Foundation Cracks and Water drainage problems On June 1st we had faxed a letter to you addressing the cracks in the foundation. In this letter it was identified to you as to how the cracks should be repaired and when. This information was obtained from our Engineers Report. On September 10th, 1993 the cracks were fixed by applying cement over the cracks. As of today most of the cracks are visable again including the ones in the garage. I have spoken to the Engineer we had hired Donald E. Clerke, he stated that this was totally unacceptable the way the cracks were repaired. George and I expect these cracks to fixed the proper way. We have also reported to you the problem with the flooding in the back- yard. When it rains the water continues to flow and erode a path onto our property not the 50ft easement. The easement slants toward our property when in fact our property should slant towards the easement. This is to be fixed as soon as possible. Call George at 726-7818 or myself at 547-3596 to schedule a time as to when the repairs will be made to the garage and foundation cracks. If the above problems are not properly fixed within 30 days we will turn this matter over to our attorney. cc: John Collins, Building Inspector South Windsor Attorney Francis Sablone Jr. Vj OCT 15 1993 Db South ffindsor BUILDING DEPARTMENT t April 6, 1994 Home Builders Association Of Hartford County Inc 1310 Silas Deane Hwy Wethersfield, Connecticut 06109 Subject: Property: 104 Rimfield Drive South Windsor, Conn. Builder: Mr. Jean Marc Jacques APR ) 2 1994 JMJ Construction South Windsor658EllingtonRoadBUILDINGDEPARTMENTSouthWindsor, Conn. To Who It May Concern: In October of 1992 George Trantalis II and myself Kathleen Gagosz built a home with JMJ Construction. We have written numerous letters starting in April 2, 1993 through October 7, 1993 (see attached letters) regarding our foundation. Problems are as follows: Cracking of the floor slab has occurred generallythrough-out the floor. The floor to the right of the stairs and near the center where cracking branches radiate, has lifted as well. All walls and corners of the foundation have cracking. Some cracks are in excess of what are normally considered to be "hairline" cracks. Steel Rods continue to leak. Were repaired twice. Approximately six to seven cracks go from the inside to the outside. Water came thru three of the cracks this winter. One of the cracks is directly behind the furnace. Cracking of the floor slab in the garage and cracks every three to four feet (inside to outside) around the garage foundation. Mr. Jacques did respond to our letter dated October 7th, 1994 regarding the above problems. The only thing that was fixed was the steel rods which continue to leak today when it rains. In addition to the foundation problems we have reported several times that our backyard continues to flood. We have a 50ft easement for water drainage, however the easement slants towards our property when in fact our property should slant towards the easement. Mr. Jacques on two occasions has brought in some top soil to raise the righthand corner of our property by an inch or two, we need a few truckloads of topsoilnotaninchortwo. Since Mr. Jacques doesn't seem to get the picture, we will bring in our own top soil to raise our property in the backyard. However we expect that the berm which contains rocks and hay will be removed and replaced with topsoil & grass seed as promised by Mr. Jacques last October. Another quality piece of construction by JMJ we encountered this winter was that our pipes in the first floor bathroom froze. When my husband got on the ladder in the basement to check the pipes, he could see right through the two by fours into the garage. The pipe was up against the wall to the garage with no insulation. We now know why our bathroom has always been so cold "no insulation". We have repaired this situation ourselfs. We are looking for your assistance to try to rectify the above problems before we have to file a lawsuit against Mr. Jacques for the costs of the repairs to the above mentioned problems. If you have any questions please feel free to contact me Kathy Gagosz) at 547-3907 or 644-0117. Thank you for your assistance. cc: John Collins, Building Inspector Town of South Windsor TO: Jeanne Huppe, JMJ Construction Co. We still have the following problems with our house: The cracks in the foundation floor and walls still need to be fixed(this was also in our last letter dated June 1) . We are waitng for someone from JMJ to contact us about fixing them. There at least 10 cracks in the foundation. We also have two cracks in the garage floor that have gotten large which we need to have fixed. The second problem that we are having is on one of the garage doors the weather stripping is torn, this lets in alot of cold air during the winter. The third problem is that in our backyard between us and the Spineli's, there is still a mound of rocks, dirt and weeds which Mike promised to tote away this summer. Since our year is almost up we would like to have this work done as soon as possible. Please contact me this week to let me know when this work will be done. Sincerely; George Trantalis Problems George and Kathy Trantalis Lot #41 104 Rimf ield Dr 644-0117 9/4/93 1. The cellar floor has a very long crack in it which seems to be expanding. We got some water into the basement through a crack in the wall, where the concrete meets the 2 x 4 's that support the house. Both are in the same area of the basement. Let me know a day ahead of time if you need to get inside the house. Kathy has been talking to him about the cracks in the foundation. It was recommended to us by a structural engineer to wait until the house settled more before the cracks in the foundation are f ixed(August or September) . Tell Mike to call or stop by if he has any questions. Thank you. DATE: April 2, 1993 TO: Jeanne Huppe, J.M.J. Construction FROM: Kathleen A. DESCRIPTION: The. house is- a typical two, story. colonial, house.,. Ian.. is wood , frame with a concrete foundation and concrete floor slab. It was built by J. M. J. Builders of South Windsor, Connecticut. Th house was started in the summer of 1992 and completed in October of 1992. Mr. Trantalis Ms. Gagosz Page Three April 22, 1993 DISCUSSION: The house has been completed since October 1952, but construction was started in the spring and summer of 1992, so the foundation has been. in less. than a year. Cracking of the foundation has been going on as long.as the house has been occupied and probably before. The cracks. started -.aut as hairline tracks and have increased im both., size and quantity. - Cracking appears to be universal covering .all walls and most. of the floor- slab. FOUNDATION: Foundation cracking has occurred on all foundation walls and in all of the corners. They vary in size from hairline cracking. to large cracks, probably an if 8" to 1/4"'. There are at least three (3) cracks on the front wall, two (2) cracks on the right side wall, three ( 3) cracks on the rear wall, and two (2) cracks an the left side wall. In addition, there are cracks in most of the inside corners- of the foundation. All foundations settle and some minor cracking in the foundation is expected, however, the extent of cracking in this foundation is in excess of what would normally be expected. While settlement may be part of the problem, it appears -that this may not be all of the problem. S ttlement occurs in all structures and is due to the dead load of the structure compacting- the soil under it,.. Some times loose material is left in the excavation and causes uneven settlement. Also, soil type varies under foundations with varying load carrying capacities. These will all add to the amount and degree of settlement in an individual foundation. Mr. Trantalis Ms. Gagosz Page Four April 22, 1993 In this- case, . the soil fa this, area, is believed to have',& high.: clay content.. Clay care. be expansive. when it gets wet and can push up on the bottom of the foundation causing cracking. The amount of force and frequency depends on the _subsurf ace soil/water conditions, with obvious relief when the soil drys out. This is probably a contributing cause of the cracking. It ts- not known what the concrete, slump was when the concrete was installed, but it is a common practice to add water to make it easier to distribute the concrete in the-.forms. ' The addition of water-sill ;increase tha shrinkage,of-they .concrete-and causer crackiag:--.condition .of. the walls indicates the pCssi+V7& presence of excess .water:. The foundation- is quite new, under a year., and it is still curing. The cracking stay, open- up some. Most of the cracks are hairline and at the present time do not exhibit any problems, Time may- cause.more cracks and those-. that exist ta open up more. The cracks should be repaired- by grooving• out-- the- cracks, both inside and outside and filling them with either a masonry Water Plug type cement or an Epoxy filler. A flexible epoxy sealer should be applied aver the filler material. CONCRETE SLAB: The concrete slab is exhibiting excessive cracking also:. The, cracking is generally throughout the entire basement floor. The concrete used in floor construction is generally a high strength concrete, 3,000 to 4,000 psi. The higher the strength concrete the more shrinkage will occur. Common Also with floor slab concrete is the addition of water. This adds to the shrinkage problem. The shrinkage will cause cracking and th joint at the foundation wall to open up some. Control joints should be cut into basement slabs. Control joints provide a point for expansion and contraction and prevent cracking from running all over the floor. In residential housing, control joints are rarely installed, thus cracking occurs at random. Mr. Trantalis Ms. Gagosz Page Five April 22, 1993 The cracking in this floor varies from hairline to about 1/8".. Some patching has been done, but. some hairline cracks have started in the patches. It- was- not confirmed that- the cracks were first grooved prior. to patching or .whether the cracks were surface patched._ The two large cracks run: frm_ the left center jog in the wall to the rear at the rear-wall.. Jog on the left. The other runs from the right side of the front wall to the center of the rear wall, by.--,the 3ti dsy ,area., Both of these have been patched. Each of' these.cracks have many branches of- hairline cracks covering most areas of the--floor. . Some of the branch .cracks are not connected, but have overlapping parallel cracks. This type of crack. is fr= shrinkage. The crack on the right side has lifted near the center at an area where other cracks radiate. This may be due to improper basing below the slab with gravel and the clay is expanding due to water forcing the floor up. To correct the problem, it may be necessary to install under slab drainage and a sump pit and sump pump to reduce the water condition under the slab. All cracks should be grooved out to a depth of at least 1/2" and sealed with either "Water Plug" type filler or an Epoxy filler. After the filling is done, the floor should be made smooth. FRONT WALK AND DRIVEWAY: The front concrete walk to the side entrance has settled as has the driveway close to the house.. This is. due to improper filling and compaction under the walk and driveway next to the house. Generally -the foundation excavation is filled with loos fill and not compacted. With time this settles and requires additional fill. This is not a proper procedure, especially under concrete walks and asphalt driveways. The concrete walk has settled and developed a crack next to the stairs. The driveway has settled, as well next to the garage. These will both have to be removed, the fill compacted, and the walk and driveway replaced in these areas. Mr. Trantalis Ms. Gagozz Page Six April_ 22.,. 1993 It is understood_that:the -driveway and its. base -were installedbytheowner`s contractor, but- the home builder, did not providea- proper base- fret which the driveway contractor could installhisbase. I , as acting Chairman of the Conunission, explained to Ms Gemme and the other people present, drat. unless .heir complaint was of a zoning matter the Planning & Zoning Commission was powerless to assist them. I have been a member of '-this Commission for nine years and received very few complaints of this nature . As a well known established builder in this town, it would seem to me that a swift and mutual resolution with - these homeowners would be beneficial to all . If I may be of any further assistance to you regarding this matter, please feel free to contact me at 289•--7113 . Very truly yours, PLANNING & ZONING COMMISSION Frank A. Castro Vice Chairman FAC/pmm Attachments cc: Attorney John Kindl Christie Gemme Jean Zurbrigen, Town Manager Director of Planning Chief Building Official vU,C C(5 We have all moved to South Windsor for various reasons, yet there were many common reasons, such as the quality of the school system, the beauty of the town, the friendly, neighborly atmosphere, and the quality of the homes. In most instances, our experiences have been as expected. However, one aspect has fallen woefully short. This area is the quality of the homes built. In particular, we aim our criticism at AU Construction and the lack of service and support we have received from town officials. Our experience to date with the town of South Windsor officials and JMJ has been anything but as expected. The continual arguing with JMJ and constant delays in having items resolved or not resolved at all, and the lack of response or assistance from town officials has been appalling. While we all have numerous problems in dealing with JMJ, the primary focus of our discussion here is faulty foundation walls, floors,and-garage floors. These areas of our homes are laden with excessive amounts of cracks and in many.cases water problems. Minor annoyances in most areas of the home can be dealt with However, problems with the foundation, excessive cracking and water seeping into basements is one area where most homeowners cannot tolerate such faulty work. We have asked, begged, argued, etc. for JMJ to correct these cracks correctly to no avail. JMJ has at tunes made attempts at fixing these cracks, but these attempts have been ineffective at resolving the problem. In addition, they have also not corrected all cracks but only a limited number. Because we are not experts,we have paid for professional engineers, waterproofing companies, etc. to provide us with a proper perspective on how the quality of work has been and the correct way to repair these cracks. These reports all state that there is an excessive amount of cracks and water for such new homes, and they have all stated that all cracks, even if not leaking at this time, need to be corrected now to avoid future problems later. Their inspection at JMJ attempts to fix these cracks have resulted in amazement by each outside expert. Just recently, JMJ has again tried to fix these cracks but we have not been provided with any sort of guarantee nor has JMJ fixed all the cracks. Not getting anywhere with JMJ, we have at various times contacted various town officials: the Town Engineer,Town Manager, Town Council members, Town Planner, and have gotten nowhere. To us this is troubling at best. We as well as JMJ pay taxes to the town. We, as taxpayers, pay the salaries of town officials. We as taxpayers, demand service for the high level of taxes paid to live in South Windsor. We as taxpayers, demand a reasonable amount of support in dealing with JMJ, rather than having town officials bend over backwards to accommodate JMJ. We find it hard to believe that the town allows the quality of homes built by JMJ to continue despite the vast number of complaints made to town officials. And now he is evert granted more projects without being held accountable for correcting past mistakes. We also find it hard to believe that the town continues to tell prospective buyers that no complaints or problems are ever brought up against JMJ when we have been making complaints to the town for quite some time. eto444- 4?,j- ab avC ° f CLLgR" ON 1ATNWj INC. CT GUT4 Dear Mr. Jacques: This law firm represents the fa dlies listed belaw, each of whom reside -in the development known as Dart Hill Estates in South Windsor, Connecticut. As I am sure you are aware, each of these families, as well as thess, have experienced significant problems with th f oundat ions in the hoofs you built for thew. There has been significant cracking of the floors and walls in the cellar f undation and garage foundation areas. This cracking has be n termed by various experts contacted by these families as r xtremely troublesome" and "very serious" in that it will c rtainly lead to structural problems in years to come. Specifically, the conerete/waterproofiag companies which hav examined these foundations have stated that either th pr paration. prior to the- pourinq of the concrete was improperly don or the concrete itself was improperly mixed and poured and/or not allowed to properly not prior to construction of th h mes. I am told that none of this information is new to you in that each of these families has attempted to correspond with y u on numerous occasions (see enclosed copies of correspondenc ) . It has become clear. to each of these families that you intend to avoid your responsibility under the statutory new home guarant b cause you have avoided all efforts to properly rectify each of th problems disclosed to you. Sorokin Sorokin Gross Hyde & Williams, M. Mr . Jean Marc Jacques Page 2 October 14, 1994 In an effort to avoid a protracted, expensive dispute, the families have asked that I contact you one last time in ord r to set up. a meeting with you within the next seven days in order to stahlisb: a proper schedule for fixing the, cracks in the corr ct- fashion (or hiring a third-party company) . As these various concrete/waterproof inq experts have- indicated to. the famili s involved, the "correct fashion" means cutting out every existing crack from the exterior of the house and properly filling the cracks on the interior to avoid further cracking in th foundation walls and floors. Additionally, it-_ has comae to the group' s attention that in the past few weeks, your company has fixed or is in the process of fixing tho foundations for the following families involved in this request: John and Genie Lomba, Kathy Gaqosz, Mike and Christie Game, and Cindy and Jack Iriondo. To insure that all cracks are corrected , properly, the group demands a tea-y ar warranty against any water leakage. and the fixing of "any additional cracks" related to the settling of the foundation. The reason that this group is demanding a written warranty f rain JMJ is due in part to the f act that JXJ has tr i ed on previous occasions to fix the basements in some of th above-mentioned houses. The cracks, however, were fixed inappropriately and continue to leak even after those repair attempts have been made. Various third-party waterproofing companies have come in and offered to fix the problem corr ctly and stated that they would furnish a ten-year warranty and this group, therefore, d such a warranty at this time- from JMJ. This warranty wILL insure that the eracks will be, oc have been, repaired properly. Let me assure you that this group is extremely serious with regard to following through with this matter and is presently in the process of compiling evidence establishing the poor quality of workmanship undertaken by JMJ Construction as it relates to these foundation problems. In the event that no meeting is set up with this group within the next seven days, this group has committed to taking the problem to various state and. local building officials, including the South Windsor Planning and Zoning Commission, the State Consumer Counsel Office and other state and local officials who are interested in learning more about the problems with this particular development and other JMJ Construction projects.
