APPLICATION OF 1

FOR CHANGE OF ZONE FROM A-20 TO GC
FOR .9 ACRE ON NORTH SIDE OF SULLIVAN AVENUE
OUTLINE OF PRESENTATION
TO
PLANNING & ZONING COMMISSION
MAY 35 1988
1. Zone change would result in conformance to Section 2.2.1 by having zoniqr-
boundary go along the property line:
a) . The property to the south facing onto Sullivan Avenue is also part
of applicants' property and is in a GC zone, resulting in the east-west
zoning boundary going right through applicants' entire piece and not running
along their property line. A zone change would result in the zoning boundary
running along the northerly boundary of applicants' property as suggested by
Section 2.2.1.
b). The history is as follows:
1) . The westerly half of applicants' property to the south (part
of lot #20 on the map) was previously part of a larger piece that included
the .9 acres and the premises to the north and east of it. When the zoning
boundaries were established, the dividing line of A-20 and GC was drawn
easterly-westerly along the northerly boundary of lots 21, 22 and 23 and
extended easterly at the same depth cutting through lot 20. The property to
the north and east of the .9 acres (23.9 acres)was sold by prior owners in
1981 who retained the .9 acres apparently because there were some barns on
it, which were subsequently burned by vandals. The .9 acres remained as part
LAW OFFICES of lot 20 including the property to the south with the .9 acres remaining in
RICHARDM.RITTENBAND the A-20 zone and the property to the south in a GC zone. The result is that
1734 ELLINGTON ROAD
the zoning line still does not run along the property line. The zone change
SOUTH WINDSOR.CONN 06074 would correct the existing situation.
203)644.2456 2. The .9 acres is not usable in its present A-20 zone.
JURIS NO 50412
a). The regulations prohibit 2 houses on the same piece, and there is
already one there.
b) . To make it a separate lot would make it a rear lot without sufficient
frontage in violation of the regulations.
c). The driveway, an accessory use in the GC zone, Oection 3.4) cannot
be used to gain access to an A-20 zone.
i
2 -
3. Changing the zone to GC would be consistent with the GC zone already
located immediately to the south and to the west of the .9 acres. Although
the General Plan of Development does not specify this piece as GC, it is close
enough to a GC zone to comply with the intent if not theiletter of the General
Plan. (Strict adherence to the General Plan is not mandatory in any case) .
4. The zone change would allow the property to be improved. The intent is
to move or tear down the unsightly existing structures, (a house 'lot 20' and
store 'lot 21')and construct a new building housing 2 or 3 specialty type shop
The .9 acres would give applicants more room to be creative in providing an
attractive group of stores, although with the buffer requirement only half of
it would be usable. The result would be to provide needed retail services/
products as well as increased tax revenue to the Town. It would enhance the
property and the area. There would be one entrance onto Sullivan Avenue
instead of the two existing entrances. The details would be provided with
the site plan application which would be subject to the Commission's approval.
5. Traffic: (Testimony of E. Russell Johnston, P.E. of Meehan Associates)
a). There is no problem with the site line as to the curve easterly on
Sullivan Avenue.
b) . Under Section 5.2, the maximum coverage for building, parking, etc.
is 65%, and with the parking requirements in Section 8.4, the maximum size
building would be about 10,000 square feet, of which one-half could be on the
9 acres; 5,000 square feet would generate only 11 peak hour trips.
6. Storm Drainage: A storm drainage system will be provided in accordance
with Town regulations that will result in zero run-off and will secure the
subject land and other land described in Section 11.2.3(e) from flooding.
Mr. Johnston) .
Utilities: Water, sewerage and other utilities presently exist within
Sullivan Avenue.
LAW OFFICES
RICHARDM.RIrrENBAND 8. Wetlands: There are no wetlands on or near the site.
1734 ELLINGTON ROAD
SOUTH WINDSOR CONN o6074 CONCLUSION
203)644.2456 The zone change makes sense. It will provide for zoning boundary along
JURIS NO 50412 the property line, will allow the .9 acres, otherwise unusable, to be
utilized for the creation of specialty shops that will enhance the location
and the area, and will be consistent with the General Commercial Zone and its
uses adjacent to the subject premises as well as in compliance with the
regulations.
