A Transient Non-Community Public Water System is a water system that serves at least twenty-five or more persons over a 60 day period. Unlike a Non-Transient Non-Community Public Water System (NTNC), a TNC does not necessarily serve the same twenty-five or more persons. , Examples of TNC's would include restaurants, rest stops, parks, and churches. It would be appreciated if your department could review the attached list for South Windsor to ensure its accuracy. Please make any necessary corrections, deletions, or additions to the list to reflect your most current information regarding these facilities. Please provide contact names and addresses where available. A system that serves water 60 or more days a year is considered to "regularly serve" water. Public water systems can be publicly or privately owned. Public water systems are subdivided by regulation into two major categories: community and non-community water systems. This division is based on the type of consumer served and the frequency the consumer uses the water. Basically, a community system serves water to a residential population, whereas a non- community system serves water to a non-residential population. The non-community category is further broken down into two categories: non-transient non-community water systems and transient non-community water systems. Iwan, Ph.D. t Chief, Water Supplies Sect o Environmental Health Services Division SUBJECT: JOINT CERTIFICATE REQUIREMENTS (P.A. 84-330) FOR NON-COMMUNITY WATER SYSTEMS .The purpose of the Joint Certificate is to prevent the proliferation of inadequate, under-designed, poorly financed, and poorly managed water systems In the State. The assistance and cooperation of the local health department (LHD) and all other involved parties is needed to bring these projects to the attention of the State agencies (i.e. Department of Public Utility Control (DPUC) and Department of Health Services (DOHS). The Water Supplies Section has noted that certain non-community/non-transient water projects (such as, Shopping Centers, Commercial enterprises, office condominium developments), that were eligible for Joint Certificate of Public Convenience and Necessity, as defined in Section 16-262m of Connecticut Gen- eral Statutes (CGS), received local approval and endorsement without consult- ing with the State agencies who are lawfully involved in the approval pro- cess. Such actions may jeopardize water supply safety and are not consistent with the requirements of the Connecticut General Statutes. When a project of this type comes to your attention, please use the following procedure: 1. Plans pertinent to a project along with a request to evaluate its qual- ification for a Joint Certificate should be forwarded to the Department of Public Utility Control (DPUC), Water Unit, 1 Central Park Plaza, New Britain, CT 06051. Estimates of the project's customer population and its average daily water demand should be attached to the request. 2. A copy of the above request should be submitted to DOHS, Water Supplies Section, 150 Washington Street, Hartford, CT 06106-4474. 3. DPUC's written response on the project's eligibility should be received and reviewed before any local approval is considered. A copy of DPUC's approval should be mailed to DOHS. Following this procedure will assure that the proper state agency reviews are conducted and minimum design standards are implemented. It will also help to ensure that necessary provisions and public health assurances are applied to proposed developments. In the interest of preserving our high public health standards, your cooperation in this matter is greatly appreciated. A letter reeently went out to local officials who have direct responsi- bilities under the new law. Although P.A. 84-330 does not directly affect local health agencies, because of the key role in regard to water supplies which your office plays, a copy of this letter which describes the new law Is enclosed. The law does not change the existing division of responsibilities between local and state health departments concerning new water supplies. It does, however, forbid local planning and zoning commissions to approve a development that will rely on a community water supply serving 25 or more people if that system has not already received the necessary DPUC and DOHS approvals. The law also adds new criteria for the state to consider before approving of a new supply, the most significant new criteria being the feasibility of con- necting to an existing supply Instead of creating the new water system. If you would like a copy of the law (P.A. 84-330) , your local chief elected official and planning and zoning office should have one. If not, feel free to contact my Section with a request for a copy or with any other questions you may have on this subject. Lloyd, M.D. , Commissioner, Dept. of Hea h Ser /,es SUBJECT: MUNICIPAL REQUIREMENTS OF P.A. 84 3 0 This letter is to inform you of a state law concerning water supplies which was passed by the 1984 General Assembly. This law (P.A. 84-330 attached) , designed to limit the creation of new small water companies, will affect nearly every Connecticut town. If proper precautions are not taken at the local level, a municipality could find itself responsible for the operation of a small water company. Section 1(b) of the law requires that, as of October 1, 1984, a certificate of public convenience and necessity be granted jointly by the Department of Public Utility Control and the Department of Health Services prior to the creation or expansion of any community water company serving 25-1000 people or having 15-250 service connections. Problems with the quality and adequacy of the supplies as well as financial problems are common with such companies. The certificate will not be issued if financial or technical requirements are not met or if the agencies determine there is a nearby alternative public water supply which could be used. The purpose of this law is to protect the public by assuring that the water system will be able to provide adequate service. Because such systems may be initiated without the knowledge of the state agencies, the law forbids local planning or planning and zoning commissions to approve a development which uses such a water company unless a certificate has already been issued by DPUC and DOHS to that company. The sanction for failure to observe the requirement is that the municipality must take over operation of the water system if the company is unable or unwilling to provide adequate service. It is thus imperative the municipal planning and zoning commissions be made aware of this requirement. The law also provides a mechanism for the state agencies to deal with exist- ing small water companies which do not provide adequate service. Section 2 of the law describes a procedure by which the Department of Public Utility Control can order a large water company to take over an existing small water company. If you have any questions on this matter feel free to call DPUC (827-1553 X2011) or the Water Supplies Section of DOHS (566-1253). Preamble to part 141 (page 59566) states that non-community systems are basically those systems which serve tran- sients. They include hotels, motels, restaurants, campgrounds, service stations and-other public accomdations which have their own water systems and which have at least 15 service connections or serve water to a daily average of at least 25 persons.. Some schools, factories and churches are also included in this category. In Connecticut a community water system is a public water supply that serves at least 2 residences or its occupants throughout the year. Any other public supply is a non-community system, and that would include systems that regularly serve a non-resident population of 25 or more. It would include summer supplies. Non-community systems do not have to be tested as much nor as frequently as community supplies; nor do they have to be tested for inorganic and organic che- micals such as toxic metals and pesticides. The non-community supplies will be tested basically for bacteria and nitrate nitrogen but-not-for-the rest of the organic and inorganic chemicals. At some time in the next few months, someone from our department will be traveling to your town to inspect each of these supplies. You will find, enclosed in this letter, a copy of our inspection sheet and from this you will see the kind of information that we will be seeking. Please go over the list of non-community supplies within your town. If it is not complete or is incorrect in any way, we would appreciate being informed of this fact when we begin work in your town.
