GULIANO Town Attorney December 10, 2001 Mr. Daniel F. Lesnieski, Jr. Manager of Region Operations The Connecticut Water Company 93 West Main Street Clinton, CT 06413-1600 Re: Clarification of Legal Opinion Regarding Right of Way to Property of Society of St. Pius X, Hartford, Connecticut, Inc. Dear Mr. Lesnieski: To follow up on our telephone conversation of December 7, 2001, you have asked whether the right of way discussed in my prior legal opinion of September 26, 2001 is the same as an easement or is more limited. It is my legal opinion that in most instances, and certainly in the instances of this case, a "right of way" and an easement are the same. Where an "easement" or a "right of way" are created by a written agreement such as the deed in the present case, the terms are essentially interchangeable. They both define a conveyance of the right of one party, usually an abutting landowner, to use the property of another for the purposes and in a manner specified in the grant of the easement or the right of way. Such a writing does not convey title to the property, but merely the right to use the property of another in a particular specified manner. Applying this to the present case, both the deeds from Moses N. Maskel to Temple Beth Hillel dated December 24, 1963 and from Temple Beth Hillel to Society of St. Pius X contain the following language in conveying an easement or right of way: A certain piece or parcel of land being a strip of land fifty (50) feet in width running westerly from the westerly side of Foster Street to be used as a right of way for all purposes for which a highway is normally used, including the right to run transmission lines and utilities over, under and on said'land (emphasis added) Mr. Daniel F. Lesnieski, Jr. December 10, 2001 Page 2 As you can see from the specific language in the deeds, the right of way or easement includes the right to run utilities under the 50-foot strip of land abutting the property of the current owner, Society of St. Pius X. I trust this clarification of my legal opinion is sufficient for your purposes. If not, please do not hesitate to contact me and I will attempt to provide further clarification.
