The Connecticut Water Company would prefer that the line enter from the front of the home if possible, even if it may require minor plumbing modifications. It is realized that this may not be possible in all situations. In some instances, it is least disruptive to have the water service enter where your well water line presently enters your home. The cost of water usage is your responsibility. Also, please remember that due to conditions or circumstances, the service line may not be able to be installed in your first choice area. If you have any questions regarding this correspondence, please contact me at(860) 644-2511 extension 248. Tom DeSantos or Michael Anderson from Fuss &O'Neill may also be contacted at(860) 646-2469. The South Windsor Health Department has been attempting to correspond with the Flotos via certified mail to advise them of the situation and alternatives which may be available to them as a result. The Town also needs to know as soon as possible whetl.er the Flotos want their home connected to the available public water at no cost to them. We would need them to complete a Water Service Location Form and sign a Temporary Construction Easement. Thank you for your prompt attention to this matter. Yours truly, e Robert Deptula, R.S. Environmental Health Officer RD/cm October 12, 2001 Town of South Windsor 1540 Sullivan Avenue South Windsor CT O6074 c/o Robert Deptula, R.S. RE: Public Water Connection Uwe do not wish to be connected to public water due to the fact that according to the law firm of Fitzgerald&Prucker, they obtained foreclosure on the property of Albert Lebrun at 911 Foster St. Ext., South Windsor. So, if the property has been foreclosed, unknown to Lebrun at this time, it is not for Albert Lebrun to make the decision of the public water connection but the decision should be made by the foreclosure firm and the Kangaroo Court of Rockville. Lebrun would get connected to public water only if the fraudulent attachment, fraudulent judgment lien and fraudulent foreclosure performed by Kangaroo Court are all released. At a later date when all the above acts of fraud get released, Lebrun would get connected at the expense of Fitzgerald&Prucker and everyone else involved in that scheme of extortion, including Judges Scheinblum, Hammer, Shaughnessy and Rittenband. Is there something wrong with officials of Judicial Branch of Government and members of the bar when they are so corrupt and greedy that they try to extort large amount of money without commencing a civil action in a court of law, but instead use a Kangaroo Court to perform their extortion scheme? I am including herein the transcript of the P.J.R. Hearing to prove my point. When America becomes corrupt, God punishes. This is what happened on 9-11-01 at N.Y.W.T.C. It is too bad that God can't punish only the corrupt ones; I believe that God holds this punishment for when those crooks will be facing Him. The Town of South Windsor apparently already gave Lebrun's home at 911 Foster St. Ext. to the Flotos by asking the Flotos if they want "their home" at 911 Foster St. Ext. connected to the public water. Refer to letter dated August 29, 2001 to Brian W. Prucker. This made the Town of South Windsor a participant in an extortion scheme. If the Town of South Windsor's records show that Lebrun's home belongs to the Flotos, then how come the town still sends their real estate tax bill to Albert Lebrun? If Prucker foreclosed on Lebrun as he has been claiming, then why did the town send their real estate tax bill to Lebrun? What a tangled web we have when the systems are all corrupt. S T A C E Y F L O T O, the plaintiff in this action, called to testify on her own behalf having been duly sworn, testified as follows: DIRECT EXAMINATION BY MR. FITZGERALD: Q Where do you live, Stacey? A 126 Munson Road. Q And where is that? A Stafford Springs, Connecticut. Q How old are you? A 15. s s 7 Q And where do you go to school? A Stafford High School. Q What year are you in? A I'm a sophomore. Q Okay. How long have you lived in Stafford? A All my life. Q Do you recall any incidents on July 3, 1989? A Yeah. Q You have to answer audibly. A Okay. Q And in particular I will call your attention to the early afternoon of July 3rd, 1989. Do you know what you were doing? A I was riding my bike. Q Okay. Who were you riding it with? A My sister. Q Where were you riding your bikes? A On Industrial Park Road. Q Okay. How far is that from your house? A It's about--- it's not very far. I'm not sure really. THE COURT: It's not very far? WITNESS: No. Q. Okay. Had you ridden your bike in that area 8 in the past? A Yeah. Q Could you tell me if anything out of the ordinary happened while you were riding your bike at that time? LIE UNDER OATH A Yes, a dog started chasing me. PERJ'-'RY Q Okay. Had you ever seen this dog before? A Yes. Q Stacey, I'm going to show you a picture which has been marked as Plaintiffs Exhibit 1 and ask you whether or not that is a picture of the dog that attacked you. A Yes. MR. FITZGERALD: Okay. Let the record reflect that the plaintiff has identified the dog depicted. THE COURT: The plaintiff has identified Roscoe. BY MR. FITZGERALD: Q Stacey, were you still on your bike when the dog came after you? LIE UNDER OATH A Yes. pER.IURY Q What happened? LIE UNDER OATH A Well, I was riding my bike and the dog started PERJURYchasing me. And I was, like, trying to ride away from it, but it, like, started running me off the road to the o 9 side. So when I hit the side of the road, I had to get off because I fell off and then the dog just, like, was jumping at me. And I was trying to hit it away or something and it caught my hands in its mouth. Q Did it knock you to the ground? LIE UNDER OATH A Yes, after. PERJURY Q How long did you struggle with the dog, if you can recall? A I'm not really sure. It was -- it wasn't-- it seemed like a long time, but I'm not really sure how long it was. Q Okay. Were you scared? A Yes. Q How did the dog get off of you finally? What happened? A There's another dog and it came and started, like, fighting with it. Q Okay. And you were able to get up and get away? A Yes. Q What did you do next? A After the dog? LIE UNDER OATH Q After the dog. After you got away from the dog. PERJURY A I ran home through the building --through that property and through the woods to my house. s 10 Q Okay. And what did you do when you got home? LIE UNDER OATH I went and my dad was not there because my sister PERJURY came home and told me where he was so he went after me. So he wasn't there. So I just washed off my hand. Q Did your dad take you to the hospital? A Yes. Q What hospital was that? A Johnson Memorial. Q Okay. Were you admitted overnight to Johnson Memorial? A Yes. Q Do you know what they did for you there? A Yes, they gave me stitches in my arm and my leg and my hand. Q Did they take any x-rays if you know? A Yes. Q Were you upset during the night you were at Johnson Memorial? A Yes. Q Did you cry during that day? A Yes. Q Did your dad take you to any other doctors after you were discharged from the hospital? A Yes. 1 Y 1 11 Q Do you know who that was? A Dr. Pascal. Q Do you know where his office is? A In Enfield. Q Okay. How many times did you go to Dr. Pascal? A Three about. About three times. Q Did you go for any physical therapy? A Yes. Q Do you know where that was? A It was in Stafford. Q Do you still have scars from the attack? A Yes. Q Could you show them to the judge now? THE COURT: Do you have any on your legs too? THE WITNESS: Yes, I have. THE COURT: Let's identify all the scars for the record. The first thing we have -- and, Mr. Norris, maybe you want to stand here and be sure that I'm describing the matter cor- rectly. On the back surface of the right hand we have a scar, irregularly shaped scar, some- thing like a half moon, approximately one inch in total length and approximately a quarter inch 12 wide. To the right of that scar, also on the back surface is another irregularly shaped scar, probably a little more than a quarter of an inch to a half inch in total length. Is this also a scar you are claiming from the dog bite, that right there? LIE UNDER OATH THE WITNESS: I don't know. PERJURY THE COURT:You don't know, okay. Well, how about this over here? Is this anything to do with the dog bite? THE WITNESS: No. THE COURT: Then we have a scar on the ring finger of the right hand that is approxi- mately a quarter to a half inch in length, almost where the finger joins the back surface of the right hand. On the palm surface of that same hand we have another scar that is an irregularly shaped scar, approximately one half inch in length which lies between the first and second fingers of the right hand. Then we have on the upper left arm an irregularly shaped scar, again, almost like a circle scar, total length of about a half to three quarters of an inch. That's on the inner surface of the upper arm. On the outer 3 / 13 surface we have two scars and they're not quite as noticeable as the other scar, but one is almost a perfect circle, about a quarter inch around. The other, which lies to the right as you face the plaintiff, is, again, about a quarter of an inch, shaped something like an arrowhead. Where are the other scars, dear? THE WITNESS: On my leg. THE COURT: And that's on your left leg in the hip area. We have above the knee a raised scar, almost a circle, about three quarters of an inch in diameter. And then about three inches above that is another scar, oval in shape, maybe an inch. MR. FITZGERALD: I think that is fair, your Honor. MR. NORRIS: Yes. THE COURT: Anything else? THE WITNESS: No. THE COURT: Any other scars? THE WITNESS: No. THE COURT: Okay. BY MR. FITZGERALD: Q Stacey, are you self-conscious about your scars? 1 1 l 14 A Yes. Q Do they bother you sometimes? A Yes. Q Do people ever ask you where you got them? A All the time. Q Okay. Have you changed the style of dress you wear at all? A Well, not really. It's just like when I wear bathing suits and something. That's really when it bothers me. Q So the remainder of that summer, certainly 1989, the scars bothered you a lot? A Yes. Q Did you continue to become upset and worried and anxious about this attack after the first few days? A Yes. Q Okay. Could you tell the judge a little bit about that. LIE UNDER OATH PERJURY A Well, I had nightmares and I thought about it all the time and it was hard to talk about it too for a long time after that happened because I just, ilke -- and every time I saw a dog, like, I'd start to cry, especially if it was a dog that looked anything like the dog that bit me. And still now I'm afraid of dogs. ♦ M 15 Q Okay. Do you have to go past that property very often? A Not anymore. Well, we go by it every time we ride our car past it on our road. MR. FITZGERALD: I have nothing further for the witness at this time. CROSS EXAMINATION BY MR. NORRIS: Q Stacey, you were aware of this dog before the date in question, July 3rd, 1989? A Yes. Q And you'd been on that property? MR. FITZGERALD: Objection, your Honor. Relevance. I don't see where the fact she's been on this property prior-- THE COURT: It's cross examination. I'll allow it subject to tying it up. BY MR. NORRIS: Q You'd been on the property before, hadn't you? LIE UNDER OATH PERJURY A No. Q You deny having been on the property? Do you deny having been warned to stay off that property before? LIE UNDER OATH PERJURY A No. Q Were you owned by the owners to get off the 16 property before? LIE UNDER OATH PERJURY A No. Q You say you were riding your bike with your sister. Exactly where were you riding; on the street? LIE UNDER 9ATHA Just, like, it was pretty much in the middle PERJURY of the road, of Industrial Park Road. Q Do you know the physical building, the building's structure which is on the property owned by the Lebruns? A Yes. Q And were you riding towards that building or away from the building? A Neither. I was just riding by it. Q Well, from which direction were you coming? A I was coming from -- I just rode right past the front of the building. Q Well, you must have been coming from some direc- tion too, right? A Yes. Q Where were you coming from? A I was coming from the side of the building because the road, the road I live on, not the Industrial Park Road, the building is right across the road; like, it goes with the road, like, along the road. And when I rode my bike, I rode on the road, like, alongside a building 17 but just on the road. And then when I turned in to Indus- trial Park Road, then I was, like, riding alongside the other side of the building. Q Can you estimate how far you were from the building when this occurred? LIE UNDER OATH PERJURY A I was pretty far away. Q And when you say pretty far away, a couple of hundred feet away? LIE UNDER OATH A Yes, at least. PERJURY Q Okay. And you say that when this dog, as you described it, attacked you, you kept riding, is that correct? LIE UNDER OATH A Yes, for a little ways. PERJURY Q So from the time the dog came near you, you were actually going farther away from the building. LIE UNDER OATH A Yes. PERJURY Q And it's your testimony that the bike fell over and that is when you sustained the scars? LIE UNDER OATH PERJURY A Yes. Q Okay. And where was your sister when you were attacked? LIE UNDER OATH A She was riding her bike behind me and when the PERJURY, dog went over me and I jumped off my bike, she jumped off hers and I told her to run home, so she ran home. Q Did you have your glasses on at the time of your 18 attack? A Yes. Q You're not wearing them today, are you? A No. Q But your glasses were on you at the time the dog attacked you. You're sure of that? A Yes. Q And it's your testimony that you thereafter ran home? A Yes. Q Now, you are familiar with the building which is owned by my clients, the Lebruns? A Yes. Q And were you familiar with the fact that the dog in question, Roscoe, was chained on that property? A Yes. Q Had you seen him chained on that property? A Yes. Q Before this date. And is it your testimony that you did not go on this property of my clients to tease or torment this dog? LIt UNDER 0A I H PERJURY A No. Q And it's your testimony that the attack took 19 place somewhere way down the street, is that correct? A Not way down. Q Okay. A couple of hundred feet down the street. LIE UIVUC,. L;t-%i ri PERJURY A Yes, from being on the street, yes. Q And at no time did you go to the building owned by my clients or immediately in front of it, did you? LIE UNDER OATH A No. PERJURY MR. NORRIS: No further questions. THE COURT: Any redirect? REDIRECT EXAMINATION BY MR. FITZGERALD: Q Stacey, I think you testified previously you ran home after the dog attacked you. A Yes. Q Did you run across the defendant's property when you were running home? LIE UNDER OATH A Yes. PERJURY Q Do you know when you lost your glasses? LIE UNDER OATH A It was when he knocked me down, when the dog PERJURY knocked me down, because when I went to run he knocked me down and bit my leg and my glasses came off. MR. FITZGERALD: I have nothing further. MR. NORRIS: Nothing further. THE COURT: Can I ask her a question? MR. FITZGERALD: Sure 20 THE COURT: Stacey, when you first saw the dog that day, was he tied up? LIE UNDER OATH THE WITNESS: No. I saw him in my yard PER '' in the morning. THE COURT:He had been in your yard that morning? LIE UNDER OATH THE WITNESS: Yes. PERJURY THE COURT: I have nothing further. MR. FITZGERALD: At this time I'd like to call Andrea Floto to the stand. Q And do you understand if you don't tell the truth you can be punished? A Yes. Q Andrea, can you recall what happened on July 3rd, 1989? A Yes. Q Okay. A The emergency room doctor wanted to get a hand surgeon because after they had taken x-rays they found that there was a couple of broken bones in her hand so they called Dr. Pascal from Enfield and he came over and, yes, they did admit her. MR. FITZGERALD: Your Honor, I have 27 subpoenaed medical records from Johnson Memorial Hospital. At this time I'd like to offer them. MR. NORRIS: I have no objection, your Honor. I would just like to have access to a photocopy of these records if they are going to be made an exhibit. THE COURT: Any problem? MR. FITZGERALD: No problem. THE COURT: They may be opened. MR. FITZGERALD: Your Honor, at this time I'd like to offer the medical records. THE COURT:Show them to Mr. Norris, please. (Showing the medical records to Attorney Norris.) MR. NORRIS: Again, I have no objection. I don't need to go through them. I have seen some. As long as I can obtain a copy from the plaintiffs counsel. THE COURT: As a packet then, those medical records from Johnson Memorial Hospital may be marked as Plaintiffs Exhibit 2. (The exhibit was marked and entered into evidence.) 28 BY MR. FITZGERALD: Q After your daughter was discharged from Johnson Memorial Hospital --this is Stacey--Mr. Floto, did you take her for follow-up care? A Yes. &Ord un Albert Lebrun 911 Foster St. Ext. Stafford Springs, CT 06076 Dear Mr. Floto, As you are aware, the Town of South Windsor has retained the firm of Fuss &O'Neill to design a water main that will serve your area. The purpose of this correspondence is to request information from you to help with this design. We would like information from you that will locate where you would like the new water-service line to enter your home. The Connecticut Water Company would prefer that the line enter from the front of the home if possible, even if it may require minor plumbing modifications. It is realized that this may not be possible in all situations. In some instances, it is least disruptive to have the water service enter where your well water line presently enters your home. Please remember that your home will be connected to public water only if you abandon your well, and that the cost of water usage is your responsibility. Also, please remember that due to conditions or circumstances, the service line may not be able to be installed in your first choice area. Environmental Health Officer RD/cm September 25, 2001 CERTIFIED MAIL 7099 3400 0005 5728 3796 Albert Lebrun 911 Foster Street Ext. South Windsor, CT 06074 Dear Albert Lebrun, As you are aware, the Town of South Windsor has retained the firm of Fuss &O'Neill to design a water main that will serve your area. The purpose of this correspondence is to request information from you to help with this design. We would like information from you that will locate where you would like the new water service line to enter your home. If you have any questions regarding this correspondence, please contact me at (860) 644-2511 extension 248. Tom DeSantos or Michael Anderson from Fuss &O'Neill may also be contacted at (860) 646-2469. Yours truly, Robert Deptula, R.S.
