MEMORANDUM
TO: Bob Deptula, South Windsor Environmental Health Officer
FROM: Michael S. Anderson, P.E., Fuss & O'Neill"A
RE: DEP's Required Construction Contract Provisions
Barber Hill Road Water Main Extension
DATE: February 15, 2001
As a follow up to our coordination meeting with Connecticut Water on December 8,2000,we
have discussed some of the meeting's decisions with Mike Senyk. As you might expect, the
DEP has some fairly rigid policies for bidding and construction of State funded projects. The
following is our understanding of the DEP's policies which will change our approach to the
referenced project:
1. Connecticut Water indicated that they would like to pre-approve bidders. The DEP has
instructed us to make this a publicly open bid. We will include qualifications
requirements in our bidding documents, and a review of the apparent low bidder's
qualifications will be conducted before recommending an award.
2. Connecticut Water also indicated that they would inspect the water main and services
as they are installed. However, the DEP would like the design engineer to inspect the
work. The DEP noted the Connecticut Water may inspect the work on their own and
offer advice where appropriate, but they shouldn't submit an invoice to the DEP for their
inspection time.
3. The DEP would prefer to not have materials pre-purchased. The contractor should be
responsible for purchase of all materials such as the meters. We recommend requiring
that the contractor purchase the meters from Connecticut Water directly. In fact, we
would like to list this cost in the bid documents.
4. For all materials that Connecticut Water needs to standardize on,we will need to submit
a letter to the DEP to formally request authorization to bid these items as sole source,b
including justification for this. r,
Subsequent to our meeting, Jerry Iazzetta had asked us to use some of the Town's front end
material in the bid package. The DEP will require that the bid package be arranged in their
format as shown on the DEP's Plans and Specifications Checklist(attached).
Please contact us if you have any questions about this material. We will proceed with
completion of the plans and specifications'based on this information. We expect to submit
review copies to the Town,DEP and Connecticut Water within 3 weeks.

existing system as a whole, the cost of such facilities will be included in the Agreement
and paid by the Applicant. If such facilities are installed larger than required to serve
the Applicant's requirements, the Company shall pay the cost of the excess capacity.
4.) Applicants must furnish the Company with two co ies of a town approved map

7.) The main extension and related service connections and other plant exclusive of the
curb box shall be the property of the Company. The curb box shall be the property
of the Applicant, and he shall be liable for its maintenance, its proper grade and any
legal claims which may arise.
8.) If property to be supplied by a main extension is at such an elevation that, in the
opinion of the Company, adequate pressure cannot be furnished at all times, the
Applicant may be obligated to execute a limited service agreement, to be recorded in
the Land Records of the municipality in which the property is situated.
9.) The Company will make a refund to the Applicant for each new metered service
connected to a main extension installed pursuant to the Company's Refundable
Advance Payment Agreement within a period of 10 years from date of advance
payment, the combined refunds and payments made under Section 10 in no case to
exceed the advance deposit. No refund will be made to the original Applicant for
service connections for which a payment is required under Section 10. The refund will
be at the Refund Rate on file with the Connecticut Department of Public Utility
Control Refunds will be payable at the expiration of one year after the date of
execution of the Agreement for each new metered service which qualifies as outlined
herein. Refunds for subsequent qualifying new metered services will be paid thereafter
on the anniversary date of the execution of the agreement, for a 10 year period, so long
as the Agreement is in force and the other terms thereof are complied with.
10.) Any new Applicant seeking metered service through a service connection off a main
installed pursuant to an existing Refundable Advance Payment Agreement, and within
10 years of the date such Agreement was executed, may be required to pay the
Company an amount which, in the judgment of the Company, represents his equitable
share of any original prepayment, less refunds. Such amount will be reimbursed to the
original Applicant. If there is more than one applicant, said reimbursement shall be
distributed equitably among the original applicants.
11.) The Agreement shall remain in effect during the useful life of the utility plant installed
pursuant to the Agreement except that the requirements of Sections 9 and 10 above
will terminate 10 years from the date of execution of the Agreement.
12.) Extensions designed to serve developments or areas which may be located considerable
distances from the Company's existing mains will be considered separately on their
own merits. The Company reserves the right to decline to undertake extensions
which in its judgment would not be in the best interest of the Company or the
community to be served. The Company also reserves the right to make modified
proposals, subject to approval of the Connecticut Department of Public Utility
Control, to suit other special circumstances.

Re-Water Main Extension - Barber Hill and Miller Roads, South Windsor
Dear Mr. Deptula
The water distribution system in South Windsor has been planned and constructed (to
date) to provide adequate water quality, pressure and fire flows and is an integral part of the
Company's Northern Western Distribution System that provides water service to eight towns in
north central Connecticut. In order to provide uninterrupted service the system is highly

throughout. The system capabilities are supported by the Company's storage facility (Wapping

MEMORANDUM
TO: JERRY IAZZETTA
TOWN ENGINEER
FROM: MELVIN C. STEAD,JR. ,
SUBJECT: MILLER ROAD WATER EXTENSION
DATE: DECEMBER 8, 2000
Bob Deptula and I attended a meeting at the Connecticut Water Company to keep abreast
of the proposal.
A number of things were discussed, some concerning design and some concerning
agreements that must be drafted and executed.
First; the design/bid items:
• CT Water requires all bidders to be pre-qualified and approved 15 days prior to
bid opening.
• CT Water has standard and typical specs and drawings to be incorporated in the
bid and require North American made products.
• CT Water will have an inspector on the job.
• Separate bid items for hydrants. CT Water pays for them.
• CT Water will do the taps and plumb to the curb stop.
• Pressure reducing valves may be required on the service horns.
• Service and meter to be to the front of the house.
• Interior plumbing allowance fixed at$350.00.
• At the twin 36 inch culvert (not the per foot main installation price) separate bid
item.
• Because of nearness to steel gas line cathodic protection is required.
Other items:
The question was raised about construction/contract management. Who is going to do it?
The Town, its Engineer or the Water Company? Dan Lesnieski of CT Water indicated that they
have worked any one of the three.ways mentioned.
They also want to get an agreement signed that would indicate how that would be done.
Dan was going to get some sample agreements to Bob.
etc. The agreement would also indicate how the project would be paid. Up front, monthly,
They also asked about whether the project would be extended out Barber Hill Road
beyond the first 3 homes.
Bob told them that would happen only if funding was approved and that was not final yet.
I talked with Mike Anderson after the meeting about how the patch/overlay bid items
would be set up. The overlay would be bid as an alternate. We talked about curb reveal and
decided to also bid milling and curbing as an alternate. These items would not be funded
through the grant but if we chose to go this route the pricing would be in place.
The details of an agreement were not something Bob or I was in a position to talk about.
The following were in attendance at the meeting.
