Town Sanitarian South Windsor Health Department Town Hall 1540 Sullivan Avenue South Windsor, CT 06074 Re: Complaint by Robins Wood Property Owner Association Regarding the Patinsky Farm 902 Foster Street Ext., South Windsor, CT 06074 Dear Mr. Deptula: Pursuant to our telephone discussion of Tuesday,May 17,2005,and to respond to a complaint you received regarding the Patinsky Farm located at 902 Foster Street Extension,I contacted Mr.Robert Jacko, a resident of the property known as the Patinsky Farm. Mr. Jacko stated that he had the oil tanks referred to in the complaint pumped out a number of years ago, following his observation of imminent leakage from one of the tanks. Mr. Jacko also indicated that he would not allow his property to become contaminated by his actions as the source of water for the property is a on on-site drinking water supply well. Mr. Jacko indicated that he was environmentally aware, and had previously been engaged in the business of growing herbs. Ultimately, as there is a potential source of chlorinated solvent pollution in the area, Mr. Jacko and I agreed that I would visit the property and sample the well water to ensure that it continued to be potable. At the time of the residential potable well sampling I will also inspect the above ground oil tanks at the greenhouses, if allowed,to verify that they were pumped out and do not represent a potential threat of pollution to the environment. Mr. Jacko requested that we delay the well testing for a short time as his mother is in extremely ill health. I will notify you and the Robins Wood Property Owners Association when I am able to schedule the water testing and inspection. My expectation is that this will occur in the second week of June. If you have any questions regarding this letter, please contact me at (860)424-3769. Rocque, Jr. Commissioner November 24, 2003 Mr. Robert Jacko Patinsky Herb Farm 902 Foster Street Extension South Windsor, CT 06074 Dear Mr. Jacko: Attorney General Richard Blumenthal has requested that the Department of Environmental Protection (DEP)provide you with an update on the status of any investigations that may have occurred to determine the source of ground water contamination near your property and to provide you with information regarding any available funding to protect your property from pollution. As you are aware, the DEP has conducted an extensive soil and ground water investigation in the Barber Hill Road/Foster Street area in an effort to determine the source of the trichloroethene contamination. In addition,Northeast Utilities conducted a preliminary investigation at the substation facility located on Barber Hill Road. However, the source of contamination has not been determined to date. Unless new information becomes available, it is unlikely that the DEP will conduct further investigation to determine the source(s)of trichloroethene. Since the initial water testing conducted by the DEP and local health department did not identify pollution, the need to earmark State funds to protect the ground water used at your property for irrigation purposes is not warranted. As my staff has explained to you in the past, the DEP issued the Town of South Windsor a consent order to address the long-term water supply needs of properties affected or potentially affected by the contamination. It is our understanding that you have refused ong-term solution for your property, which is a connection to the municipal water main. I am responding on behalf of the Town of South Windsor, as there seems to be some confusion as to your particular piece of property. You mentioned in your letter a delay in notification and total lack of help. You were told verbally that there was contamination in the area on March 3rd and March 10th of 1999. In the second paragraph of your letter you talked about a chemical stripper to eliminate trichloroethylene (TCE) from your water. I think the Department of Environmental Protection (DEP) and the Health Officer of South Windsor have told you that there was none found in your well. Since the source of contamination was not found, the Town voluntarily entered into a consent agreement with the DEP to provide an assured potable water supply to all those within the impact area. You also state in your letter that your liability insurance was invalidated. I don't know this to be true, but in discussion with the DEP they said they would meet with your carrier to discuss the concerns and options for safe water. We should also.go over some past history as I know you are well aware that the DEP first became aware of a problem as a result of a random well water sample that was collected within the impact area. Since that time, the DEP has been the lead for the groundwater investigation except the Town of South Windsor Health Department has assisted in the collection of drinking water samples. Because your well is free of volatile organic compounds to date, there is no mechanism for the Town or the DEP to provide a filter system. The Town, through DEP potable water grant will continue to monitor Mr. Bob Jacko September 12, 2001 Page 2 of 2 your well and water quality until such long-term supply of potable water is made available. This grant also allowed the Town to hire a consultant to evaluate various potential water supply alternatives. As you know, the outcome of the engineering study has determined that extending the public water to the affected area and connecting those houses to it is the best solution insuring that all affected or potentially affected property owners, including yourself, have a safe supply of drinking water. This water supply alternative should help resolve your well-water and business concerns. You also indicated that Bob Deptula, Health Officer, made the statement, "you have nothing to worry about, and it's no big deal". Mr. Deptula has told me that this is not true and that he went over the reasons for the sampling, where the contamination area was, and that your well was checked out and there were no contaminants. He has told me that he informed you various times of your particular situation. As far as the lack of information, I believe that Mr. Deptula has provided you information and certified return receipt letters, which you have not picked up. We have also asked you to come in and pick up information and have you sign for it. Any information concerning this project is public information and anything that you requested would have been given to you but I do think that you should have signed for the certified letters so that this information could have been made available to you. It is my understanding that on 8/6/01 you refused to allow Fuss & O'Neill, our consulting engineers, to collect water samples unless certain conditions were met. Therefore, I think one of the biggest problems that we have is a lack of cooperation that you have shown on your part. The DEP and staff of the Town have made themselves very accessible to your requests and your needs but you have not availed yourself of any of these resources and information. I believe that the bottom line is that the DEP is the lead in this issue and your well has not been affected at all. We will continue to monitor the situation and provide any information you might possibly need. All you need to do is ask. If you need any additional information feel free to contact my office (644-2511 ext. 200) and we will make sure that the DEP or appropriate agency will get it to you. Very truly yours, , Matthew B. The purpose of this correspondence is to request information from you to help with this design. We would like information from you that will locate where you would like the new water service line to enter your home. The Connecticut Water Company would prefer that the line enter from the front of the home if possible, even if it may require minor plumbing modifications. It is realized that this may not be possible in all situations. In some instances, it is least disruptive to have the water service enter where your well water line presently enters your home. Please remember that your home will be connected to public water only if you abandon your well, and that the cost of water usage is your responsibility. Also, please remember that due to conditions or circumstances, the service line may not be able to be installed in your first choice area. Or 902 Foster Street Extension Phone# Phone# South Windsor, CT 06074 Fax# Fax# Dear Mr. Jacko: I have looked over the letter that you sent to Mayor Lassman Fisher, basically stating that you have received no information on the Barber Hill situation. I believe that a letter was sent before June 27th, 2001, which did outline certain information. I am responding on behalf of the Town of South Windsor, as there seems to be some confusion as to your particular piece of property. You mentioned in your letter a delay in notification and total lack of help. You were told verbally that there was contamination in the area on March 3rd and March 1 Oth of 1999. In the second paragraph of your letter you talked about a chemical stripper to eliminate trichloroethylene (TCE)from your water. We should also go over some past history as I know you are well aware that the DEP first became aware of a problem as a result of a random well water sample that was collected within the impact area. Bob Jacko August 31, 2001 Page 2 of 2 your well and water quality until such long-term supply of potable water is made available. This grant also allowed the Town to hire a consultant to evaluate various potential water supply alternatives. As you know, the outcome of the engineering study has determined that extending the public water to the affected area and connecting those houses to it is the best solution insuring that all affected or potentially affected property owners, including yourself, have a safe supply of drinking water. . The DEP and staff of the Town have made themselves very accessible to your requests and your needs but you have not availed yourself of any of these resources and information. believe that the bottom line is that the DEP is the lead in this issue and your well has not been affected at all. We will continue to monitor the situation and provide any information you might possibly need. All you need to do is ask. If you need any additional information feel free to contact my office (644-2511 ext. 200) and we will make sure that the DEP or appropriate agency will get it to you. Very truly yours, Matthew B. Patinsky Herb Farm Phone# Phone#r Y— 902 Foster Street Extensiol Fax# Fax# South Windsor, CT 06074 Dear Mr. Jacko: This letter is a reply to the concerns raised in your April 8, 2001 letter regarding ground water pollution in the vicinity of your property. For future reference, Gil Richards was recently assigned the project and will be your primary contact. However because of our prior knowledge and involvement in the case, you may contact either Mike Senyk or myself should you have additional questions. I would like to first address your concerns regarding the alleged effects that the pollution has had on your business. As you are aware, your well water supply, which serves both domestic and agricultural operation purposes, has been, and will continue to be sampled on a regular basis by the Town's consultant until a long-term potable water supply is provided. However,to date, no trichloroethene has been detected in your well water supply. Consequently, I do not understand why you or your insurance company has taken the position not to use the water supply, especially in view of the on-going monitoring program. As I offered in the past, I would be willing to meet with you and a representative of your insurance carrier to discuss the concerns and options for ensuring that the water supply is safe for your business operations. In order to address the polluted well water in the affected area, the Town has applied for a.state grant that will ultimately be used to extend public water. The DEP is currently reviewing engineering plans and specifications for the water line extension. Based on the findings of the engineering study, you will be given the opportunity to be connected to public water. Provided the DEP is successful in securing funds from the state Bond Commission to provide the grant to the Town to complete the work, the grant will cover the costs associated with.the extension of the water main and individual service connections and well abandonment for all those affected and potentially affected properties, like yours. However, you should be aware that the owners of properties connected to public water are responsible for paying their individual water bills. During the past year, the DEP has conducted an extensive soil and ground water investigation throughout the Barber Hill Road/Foster Street area in an effort to determine the source of the pollution. However, a source has not been definitively determined to date. It is currently unlikely that the DEP will conduct additional investigations unless new information, which suggests a potential source area or areas become available. I have not been notified of a water sampling schedule, although I have requested it from DEP and Robert Deptula in separate correspondence. On March 9, 1999;Robert Deptula verbally told me that this issue was, "no big deal, and nothing to get concerned about." I have had two samplings done in a two-year period, one on March 9, 1999 and on February 2, 2001. I did receive notification on September 20, 2000 about the public hearing held on October2, 2000. It was when I attended the public hearing that I learned that the ground water contamination in my area was of grave concern to my business. I also do not think that I was given enough time between September 20 and the public hearing to adequately review the data from Fuss and O'Neill's report. Since that time, I received a letter from Robert Deptula dated November 22, 2000 that stated that TCE levels approaching "action levels" were found in wells adjacent and across the street from my property. This substantiated my concern that I could reasonably expect to be contaminated. In January 2001, my insurance carrier notified me that my product liability insurance is invalidated by any suspected defect in my product which is due the proximity of the TCE contamination. I sold product for two growing seasons, unaware of this risk, because Robert Deptula did not adequately inform me about the scope of the contamination. My product was destroyed because I have no filters to protect my water, and cannot afford the extreme cost of retrofitting my entire water irrigation system. No funding or help has been offered from CTDEP, the Town of South Windsor, or CT Department of Agriculture. When will mayor and town council respond to my letter dated March 27, 2001? You should contact DEP staff directly regarding the investigation. As you know, the Town, through a potable water grant made available by the DEP, hired an environmental consultant (Fuss & O'Neill) to conduct a ground water impact evaluation and water supply alternative analysis. The findings of the report, which recommends the extension of public water, have been approved by the Town and the DEP and the project is proceeding accordingly. Water samples were collected by the Town from your water supply well on March 3ra and 9t", 1999. During these collection times you were informed of the reason for the area wide water sampling just as every other resident whose well was tested was informed. Fuss &O'Neill Inc. 146 Hartford Road Manchester,CT 06074 Dear Mr.Anderson, Attached is a copy of a letter we received from Robert Deptula, South Windsor's Environmental Health Officer. An individual was in the neighborhood on March 1 collecting water samples for your firm. My residence and business was not on the list to be tested. Why? Due to the TCE contamination in close proximity to our property, liability issues have forced to us to cease business operations because we grow edible products. As a result, the business is no longer viable. The threat posed by this ground water pollution has caused us undue stress and financial hardship. To date, we are still unaware of the source of the contamination. The length of time it has taken to locate the contamination source makes it impossible to prepare any business plan, and as a result,we have to close the farm. Why wasn't a study conducted on the agricultural (commercial/industrial) impact of TCE contamination on this area, when the testing was first initiated? I requested a detailed testing plan for the investigation of the source of the TCE contamination from the Town of South Windsor back in November, but never received any direct answers to these questions. Your response to these concerns will be appreciated. Fuss &O'Neill Inc. 146 Hartford Road Manchester, CT 06074 Dear Mr.Anderson, I received your reply regarding concerns I addressed to you in a letter dated March 25, 2001. Questions still remain about the study your firm conducted in the spring of 1999. I have a copy of the Fuss and O'Neill report to the Town of South Windsor. I don't understand how Patinsky Farm and the two Dzen family farms were excluded from the long- term water supply needs of residential and non-residential properties affected or potentially affected by the TCE contamination. Patinsky Farm's greenhouses are across the street from a property where TCE detection is approaching the CTDEP "action level". The two Dzen farms comprise a sizeable acreage containing both greenhouses and obviously irrigated crops. Both properties are within the study area outlined in the report. Signs are posted that Dzen has blueberries, raspberries, and strawberries grown on that site. The edible nature of the crops that Dzen and Patinsky Farms grow and the tremendous amount of water used by these activities must have an influence on the ground water impact evaluation and water supply alternative analysis. What explanation can you offer to explain the why agricultural water use was not part of the scope considered in the long-term water supply analysis? This doesn't appear to follow scientific logic. I would appreciate it if you could clarify this issue. To date,we are still unaware of the source of the contamination. The length of time it has taken to locate the contamination source makes it impossible to prepare any business plan, and as a result,we have to close the farm. Further, notification to our business that a contamination problem existed was not given in a timely manner, so that we could not make plans in time for this growing season. Complete retooling and a water filtration system would have been necessary to consider growing my products. The expense and time to make these modifications also factored into the decision to close the business. Why wasn't a study conducted on the agricultural (commercial/industrial) impact of TCE contamination on this area, when the testing was first initiated? I requested a detailed testing plan for the investigation of the source of the TCE contamination from Robert Deptula, Environmental Health Officer, in November 2000, but never received any direct answers to these questions. Why haven't Town officials followed up with DEP to locate the contamination source? We also met with Gary LeBeau and DEP officials at the State Capitol building on January 23 to discuss what actions are being taken to address this problem. The public hearing will be held at 7:30 p.m. on Monday, October 2, 2000 at the South Windsor Town Hall, Council Chambers. TCE, a degreasing solvent, has impacted groundwater in the Barber Hill Road area. A source for the contamination has not been identified to date, and, consequently, the Town of South Windsor entered into a consent order agreement with the DEP to evaluate water supply alternatives for the impacted area. Three long-term water supply alternatives have been evaluated in a report prepared by Fuss & O'Neill, the Town's consultant. Copies of the report are available for review at the Health Department and the Town Clerk's Office at Town Hall. Please remember that your home will be connected to public water DWI if you abandon your well, and that the cost of water usage is your responsibility. Also, please remember that due to conditions or circumstances, the service line may not be able to be installed in your first choice area.
