Box 468 Holyoke, Massachusetts 01041 Attention: Mr. Raymond M. Vincunas President Re: Proposed ChemLawn Facility South Windsor, CT Dear Mr. Vincunas: -; Thank you for the prompt submission of the revised plans for the referenced facility. Upon reviewing these plans I find that my original comments have all been satisfactorily addressed. Therefore, it is my opinion that adequate safeguards against environment contamination have been in- corporated into the design of this facility and thus, this Unit has no outstanding concerns regarding the construction of this facility. I would remind you however, that the above is based on the plans submitted and any variances from those plans may alter our stated position. Further, as you know, our review of building plans is conducted on I site specific basis. Therefore, although we find the design of this facility acceptable, it is not to be construed as a blanket endorsement of future ChemLawn facilities. In keeping with that sentiment, it is requested that future ChemLawn facility plans be submitted to this office for review and comment. If there should be any question or comment on this matter, please feel free to contact the writer at 566-5903. MEMORANDUM May 10, 1983 TO: PLANNING & , ZONING COMMISSION RE: Proposed Building for Chemlawn Corporation, Bidwell Road, So. Windsor Plans prepared for this building by the Edward J. O'Leary Company, Inc. revised on 5/9/83, show adequate protection against accidental chemical spills at this facility. The dike surrounding the tank farm area is designed at 125% capacity of one chemical tank and provides sufficient protection should a tank rupture. This area is also provided with a water tight tank draining into a water tight sump pit. A trench drain inside the building where trucks are loaded with chemicals and washed also drains into the sump pit. Liquid from this to fill individual Chemlawn trucks. This enclosed s sumystem it is then used des adequate protection against environmental contamination during truck washing and loading. The chemicals, pesticides and herbicides used by Chemlawn are approved by the Connecticut DEP. The design of this facility is adequate from an environmental health viewpoint. Windsor, CT 060/4 PLANNING DEPT' Attention: Planning Department Re: ChemLawn Facility Dear Mr. DeMallie I have been requested by the contractor of the referenced site to provide your Department with a written statement of compliance with Department of Environmental Protection criteria for the subject facility. To give you a brief history of my involvement with this project I have the following to offer. On May 3, 1983 I met with representatives of the Edward J. O'Leary Company to discuss the construction of a ' ChemLawn facility to review plans for the facility. I had some comments, and the plans were revised to incorporate modifications that would address my concerns, see attached letter. In addition, I have inspected the construction of the facility on three separate occasions to insure that the modifications were in fact incorporated into the facility. Therefore, as of this date, the existing construction of the building has been accomplished in accordance with the revised plans and I am satisfied with same. It however, that chemical storage tanks and' associatedhoipingld is°not in place and I understand that this will be accomplished at a later date after ChemLawn accepts the basic building. Once the tankage and piping is installed I would then like to inspect the facility to insure problems from that standpoint won' t arise. If there should be any question or comment on this matter, please feel free to contact the writer at 566-5903 . Windsor Phone: 165 Capitol Avenue • Hartford, Connecticut 06106 An Equal Opportunity Employer f MEMORANDUM April 23, 1984 To : Mr. Richard J . Sartor Town Manager Re : ChemLawn Carpet Cleaning Service Based upon a complaint (copy enclosed) made to the Department of Environmental Protection ' s Hazardous Materials Management Unit , the Office of the Chief State ' s Attorney--Statewide Prosecution Unit for the Environment--began an investigation into activities conducted by ChemLawn Carpet Cleaning Service, 381 Governor ' s Highway, South Windsor, Connecticut--the address occupied by the firm for approximately eight or nine months during the year 1983 . In November 1983, ChemLawn Carpet Cleaning Service moved to their present East Windsor location. Due to the nature of 'the investigation, the Prosecution Unit and DEP officials were unable to discuss it for fear of jeopardizing their positions . However, the State ' s - - investigation did determine that ChemLawn Carpet Cleaning Service was discharging used cleaning fluid to the groundwaters of the State via the Town of South Windsor ' s storm drainage system (pictures attached) . This evidence was then forwarded to the Office of the Chief State ' s Attorney; and action was taken against ChemLawn and one of the firm ' s drivers (employed in Southington) . The Company was not prosecuted, but made a $40, 000 donation to. the University of Connecticut Medical Center; and a $10, 000 donation to the State of Connecticut . Had prosecution occurred, and a fine been levied, that fine would have gone into the State ' s General Fund . The discharge entered the Town drainage system through a catch basin at 381 Governor ' s Highway. From that point, it was piped-- in a westerly direction--under Route 5 , toward Pratt $ Whitney, where it then proceeds northwesterly under Governor ' s Highway and into Stoughton ' s Brook . Stoughton' s Brook flows westerly under Main Street and into the Connecticut River. (Map of drainage path attached . ) This entire area is served by public water (M. D . C . ) ; however, at this time, it is not known if all potential users are M. D .C . customers . Laboratory tests , conducted by the State Health Department Laboratory (see copy) , revealed that various components of cleaning fluids containing hydrocarbons were discharged . Drinking water samples will be collected by the Sout1 Windsor- Health Department for analysis--if area residents not connected to the public water supply so request . Memorandum Re : ChemLawn Carpet Cleaning Service Page 2 April 23 , 1984 The Public Works Department has surveyed the drainage system involved, and has determined that there was no visible damage . The entire system could not be thoroughly inspected due to the fact it was partially flooded at the time of inspection . When drainage and run-off conditions permit, a more thorough inspection will be conducted . Consultation with various Town departments determined that there were no local ordinances violated--with the exception of Inland/ Wetlands , and watercourse regulations , where violations apparently occurred . By definition (Wetland Regulations Section 2 . 1 . h) , deposition of material into , or pollution of, a watercourse is a regulated activity . Section 5 states that regulated activities affecting the wetlands and watercourses of the Town are prohibited, except as they may be permitted by the Agency. Section 6 requires submission to the agency of an application for a permit to carry out a regulated activity; Section 7 requires the inclusion of various types of information on the application; Section 8 pertains to the agency ' s formal review procedure ; and Section 9 applies to the public hearing procedure, if deemed necessary, by the agency . The firm in question did not apply to the Agency, nor did it comply with any of the above-mentioned sections of the Regulations . Section 14 of the Regulations (enforcement) provides for penalties as stated under Section 22a-44 of the Connecticut General Statutes , which provide for a fine of not more than $ 1 , 000 for each offense . Any fines levied would be awarded to the Department of Environmental Protection, or possibly the Town of South Windsor . In addition, if Town property has incurred any damage due to the ` dumping, any ChemLawn Carpet Cleaning property in the State may be attached as a process of seeking reimbursement from the firm . The Department of Environmental Protection is in the process of issuing orders to ChemLawn- -copies of which will be sent to the Town . The orders will state that a consultant be hired by the end of June ; that the consultant submit a preliminary report (regarding contamination) to the Department of Environmental Protection by the end of July; and that a final report be Memorandum Re : ChemLawn Carpet Cleaning Service Page 3 April 23 , 1984 submitted by the end of August . This final report will include results of soil analysis for any possible contamination; and recommendations for any groundwater sampling, well water sampling, and removal of contaminated soil . These reports will also be available to the Town . A complaint was initially received by George Dews and during a telephone interview with the complainant, Patrick Bowe was told that the chemicals used in the cleaning were toxic. Further, the complainant stated that employees were directed to dump the wastes into storm drains, and that two of the vans had been equippedwith devices which allow the driver to dump the contents of the holding tanks at will without leaving the cab of the vehicle. This activity is reported to occur between 3:00 P.M. an.d 6:00 P.M. for the residential crew and typically from 11:00 P.M. to 4:00 A.M. for the commercial crew. The commercial crew uses and dumps much stronger and more concentrated chemicals than the daytime residential crew. I am therefore referring this matter to your office for further investigation. The entire area is served by public water (M.D .C .) --although, at this time, it is not known if all potential users are served by it . Connecticut SU1)rFc_"r _ Reported Clandestine Dum,Qingof ToxG GHQ ning AgPnrG Based upon a compliant (#339) made to the Hazardous Waste Management Staff, it is the opinion of the staff that there may be criminal violations of the Connecticut Hazardous Waste Management Regulations and Section 22a-430 of the Connecticut General Statutes at the Chemlawn Carpet Cleaning Service at 381 Governors Highway, South Windsor. A complaint was initially received by George Dews and during a telephone interview with the complainant, Patrick Bowe was told that the chemicals used in the cleaning were toxic. Further, the complainant stated that employees were directed to dump the wastes into storm drains, and that two of the vans had been equipped with devices which allow the driver to dump the contents of the holding tanks at will without leaving the cab of the vehicle. This activity is reported to occur between 3:00 P.M. and 6:00 P.M. for the residential crew and typically from 11:00 P.M. to 4:00 A.M. for the commercial crew. The commercial crew uses and dumps much stronger and more concentrated chemicals than the daytime residential crew. I am therefore referring this matter to your office for further investigation. / L Stephen W. Hitchcock SWH:PFB:kls A VI 11111 : /l ,otn r,tirnt. Sartor Town Manager Re : ChemLawn Carpet Cleaning Service Based on a complaint made- to the DEP-Hazardous Materials Management Unit, the Office of the Chief State ' s Attorney-- Statewide Prosecution Unit for Environment began an investigation into activities conducted by ChemLawn Carpet Cleaning Service, 381 Governor ' s Highway. Due to the nature of the investigation, the Prosecution Unit, and DEP officials, were unable to discuss it for fear of jeopardizing their positions . The investigation determined that ChemLawn Carpet Cleaning was discharging used cleaning fluid into the Town ' s storm drainage system. This evidence was then forwarded to the Office of the Chief State ' s Attorney. Action was taken against ChemLawn and one of their. drivers (employed in Southington) . The Company was not prosecuted, but made a $40, 000 donation to the University of Connecticut Medical Center, and a $10, 000 donation to the State of Connecticut . The firm has since moved its operation to East Windsor. The discharge entered the Town drainage system at the rear of 381 Governor ' s Highway. From that point, it was piped--in a westerly direction, under Route 5 , toward Pratt & Whitney. From that point, the drainage proceeds northwesterly under Governor ' s Highway and into Stoughton ' s Brook which flows westerly under Main Street and into the Connecticut River. The entire area is served by public water (M. D .C . ) --although, at this time, it is not known if all potential users are served by it . Laboratory tests conducted by the State Health Department Laboratory revealed that various components of cleaning fluids were discharged. Water samples will be collected by this department for analysis, if any resident so requests . Consultation with various Town departments determined that there were no local ordinances violated, with the exception of Inland/Wetlands , and Watercourse Regulations , where violations may exist . The Public Works Department has surveyed the drainage system involved, and has determined that no damage has been incurred . DRAFT Memorandum Re : ChemLawn Carpet Cleaning Service Page 2 April 17, 1984 The Department of Environmental Protection is in the process of issuing orders to ChemLawn . The orders will state that a consultant be hired by the end of .June; that the consultant submit a preliminary report (regarding contamination) to the DEP, by the end of July; and that a final report be submitted by the end of August . This final report will include results of soil analysis for any possible contamination; and recommenda- tions for any groundwater sampling, well water sampling, and removal of contaminated soil . Box 468 Holyoke, Massachusetts 01041 Attention: Mr. Raymond M. Vincunas President Re: Proposed ChemLawn Facility South Windsor, CT Dear Mr. Vincunas: 6 Thank you for the prompt submission of the revised plans for the referenced facility. Further, as you know, our review of building plans is conducted on 04 site specific basis. Therefore, although we find the design of this facility acceptable, it is not to be construed as a blanket endorsement of future ChemLawn facilities. In keeping with that sentiment, it is requested that future ChemLawn facility plans be submitted to this office for review and comment. Hartford_ Connecticut tii TTJf!- , Reported Clandestine Dumping of Toxic 4emfral rlenning Agent-s-, i Based upon a compliant (#339) made to the Hazardous Waste Management Staff, it -is the opinion of the staff that there may be criminal violations of the Connecticut Hazardous Waste Management Regulations and Section 22a-430 of the Connecticut General Statutes -at the Chemlawn Carpet Cleaning Service at 381 Governors Highway, South Windsor. A complaint was initially received by George Dews and during a telephone . interview with the complainant, Patrick Bowe was told that the chemicals used in the cleaning were toxic. Further, the complainant stated that employees were directed to dump the wastes into storm drains, and that two of the vans had been equipped with deviceswhich allow the driver to dump the contents of the holding tanks at will without leaving the cab of the vehicle. I -am therefore referring this matter to your office for further investigation.
