MEMORANDUM
To: Town/City Engineers, Building Inspectors, Plumbing Inspectors, Planning

Pollution Control Facility Officials
From: State of Connecticut
Department of Environmental Protection (DEP)
Water Compliance Unit (WCU)
i Date: August 11, 1989
i
The Department of Environmental Protection requests your assistance and
cooperation in the following matter:
Confusion has been generated among owners of motor vehicle service
i
facilities applying for a permit to discharge vehicle service floordrain
wastewaters due to a lack of communication between the State DEP-WCU engineers,
aand the town/city engineers, building inspectors and planning & zoning
officials. This has resulted in situations where municipalities have approved
of facility construction or modifications which do not meet DEP requirements.
In these situations, DEP h'as had to order further modifications so that the
_ facility meets our requirements to protect against water pollution. Obviously,
this is hard on the motor vehicle facility owners, and it also creates more
work for us.
In the interest of coordinating our efforts so that consistent information
is disseminated by Town and State alike, and so that stream and groundwater
contamination can be minimized, the following guidelines have been developed
which the DEP-WCU is using in approving discharge permits for motor vehicle
service facilities:

1. Floor drains must not discharge directly to the ground surface, surface
waters, wetlands, dry wells, storm drains, or to the sanitary sewer.. In
the case of a motor vehicle service facility, floor drains must either
discharge to an approved oil/water separator which then discharges to
the sanitary sewer, or must discharge into a holding tank fitted with a
high level audio/visual indicator.
2. In addition, if floor drains are located in a room where there is
storage for any used or unused motor vehicle fluids, including motor
oils, motor fuels, transmission fluids, brake fluids, radiator fluids,
solvents, detergents, paints, paint thinners, or degreasing agents,
then provisions must be made to ensure that these materials do not get
into the floor drains through accidental spillage or containment leaks.
The DEP has normally recommended containment berms or oversized tanks
with 110% secondary containment capacity for storage areas. Facilities
seeking a dealer's and/or repairer's license from the Department of
Motor Vehicles are required by law to install a retention tank for
waste motor vehicle fluids with a minimum capacity of 275 gallons. The
DEP requires secondary containment be provided for these retention
Ph tanks as well. The oil/water separator is there to handle only
Fincidental drippings and floor washing wastewaters.
3. At a minimum. Oil/water separators must meet our specifications, which
have been included as an attachment to this letter. Some
municipalities may require more stringent controls, although this has
not been our experience to date.
4. Dry wells are not allowed under any circumstance. If any dry wells
exist or have ever existed, we will require their removal as well as a
_* study to determine whether—o- not.._any contamination of the soil or
u groundwater has occured as a result, with remedial action if necessary.
Therefore, we would appreciate if you would notify us of any drywells
that you discover.

MEMORANDUM September 18, 1989
To Ms. Jean Zurbrigen
Acting Town Manager
Re: Leak of Hydraulic Fluid at Town Garage
Following is a report, in chronological order, of the events
surrounding the incidence of hydraulic fluid leakage at the
South Windsor Town Garage.
9111189 - Suspected leak of hydraulic fluid from
hydraulic lift at Town Garage.
9112189 - Area of concrete floor and soil removed by
Town staff. This excavation confirmed a leak
of hydraulic fluid into ground beneath the
Town Garage floor.
The State Department of Environmental
Protection, Oil and Chemical Spill Section,
was notified. Simultaneously, the firm of
Harold Hockinberry, was contracted with to
repair the leak (which was in a flow-line from
the hydraulic reservoir to the lift), and the
firm of Tri-S Inc. was hired to pump
groundwater and hydraulic fluid from the lift
pit.
9113189 - DEP investigated the site and agreed that all
necessary excavation had already been done by
Town staff and the contractor (removal of
approximately one cubic yard of contaminated
soil) . It was also determined by the DEP that
a 6-inch monitor well be installed--the well
be observed and, if necessary, be pumped to
remove any fluid which might collect in it.
9114189 Installation of monitoring well (in the
excavation within the Garage) , backfilling the
excavation, and replacing the removed section
of Garage floor was completed. Tri-S, Inc.
removed approximately 400 gallons of
groundwater, contaminated with hydraulic
fluid, from the lift pit.

The above-mentioned activities were conducted with State DEP
approval.
There is approximately one yard of contaminated soil
presently stored at the Garage facility. The DEP will
instruct us this week as to its disposal.
The associated cost estimates, to date, are approximately
$2, 000. 00.

Dear Mr. Gerlt:
This is in response to your letter of September 25, 1989
and a follow-up to our conversation on October 10, 1989 in
regards to fire protection charges on your private property
within the Robins Wood Subdivision.
The fire protection charges for which you are
responsible are based on the length of .water main initially
placed within your subdivision along with one (1) fire
hydrant charge. ; These charges were agreed to by you on June
28, 1985 as part of the water main extension agreement. A
copy of the agreement is attached. The agreement also
provides for thefire charges to be transferred to the town
if the town agrees to pay them. This is the normal
arrangement particularly if acceptance of a roadway by a town
is a consideration in the future.
The subsequent main extension to Foster Street to loop
the main is notlbeing charged to you. This looping of the
water main improves fire flow capability, as well as,
improves water quality by reducing stagnation. in a dead-ended
main.
Please call, if you have any further questions.
sincerely,
Robert P. Iculas

DMr.. Robert Kulas
Division Manager
The Connecticut Water Co. +-
25 North Road \`J /f } !(5)
East Windsor, CT 06088
Dear Mr. Kulas:
In 1985 I developed a subdivision known as the Robins Wood Subdivision
in South Windsor pursuant to an approval received from the Town of South
Windsor Planning & Zoning Commission. One condition of that approval required
"water shall be supplied by the Connecticut Water Company". In making arrangements
for that service, the design was done by your company and I was forwarded
the contract documents which I executed and the water service was installed.
Then in January of 1986, .the final costs were forwarded to me along with
a refund check. Since that time, I have received a bill each month for
what I believed to be a fire hydrant in that subdivision, within which I
have also built my own home. However, in looking into the bill, since it
seemed to be unusually high, I learned that I am paying for the water line
off of which the services have been run as well as the fire hydrant each
month. This is so even though the line was subsequently "looped" to Foster
Street and used to provide water service elsewhere.
Further, I have learned that I am the only private developer apparently
paying until eternity and beyond on a fire hydrant and water line or main.
This is a formal request that the charges billed to me monthly for the water
line in the Robins Wood Subdivision cease immediately. From the period
January 1, 1987 through June of 1989, I have paid a total of $2,361.04,
ti
Mr. Robert Kulas -2- September 25, 1989
and I continue to receive monthly billings. Unless this matter can be
satisfactorily resolved, I will have no alternative but to contact the State
of Connecticut Department of Public Utilities Control and request their
assistance in resolving this matter. I believe that these continuing charges
are completely unfair since the line was installed at my expense, and the
company is benefitting by water service charges off of that line each month,
and has used the line to loop and provide other services to the residents
of the Town of South Windsor. Perhaps you should be billing the Town of
South Windsor.
Your prompt attention to this request would be deeply appreciated.
Thank you.
Very truly yours,
Wayne Christopher Gerlt

DATE: June 6, 1988
RE: Non-transient non-community water system (NTNCWS) inventory
As you may recall, in my letter to you of 11/12/87, USEPA is focusing its
attention on a new category of public water systems known as non-transient
non-community water systems. It is EPA's intent to have these systems
monitored for the 8 regulated volatile organic chemicals and any new regulated
contaminants, e.g. lead and copper, after January 1, 1991.
In my letter, I asked that you survey your towns and update your
non-transient non-community inventories. I would now ask for a copy of that
inventory. The inventory should include:
1) Name and address of NTNCWS
2) Population served
3) Contact Person
4) Phone number of contact person if available
It is imperative that I have your inventory by the end of August of this
year so that we may begin compiling the information.
This will be a new program and we must know the numbers of NTNCWS that we
have so that the program can be properly administered and funded.
If you have questions, please call me.

TO WHOM IT MAY CONCERN:
Mrs. Janice Rosenberg has severe cardiac and cerebral problems.
I am told that she is having difficulty at her home because of
sewage backup and that she is getting quite anxious about it.
There is no doubt that an annoyance of this kind is detrimental to
her condition, and it would be quite appropriate to have something
done that would relieve her anxiety.
T ly yours ,

RE: 1302 TWIN CIRCLE DRIVE, SOUTH WINDSOR, CT
PROPERTY OF SEYMOUR & JANICE ROSENBERG
Dear Mr. Thibodeau:
I am writing on behalf of my clients, Seymour and Janice Rosenberg, the
Occupants of 1302 Twin Circle Drive at Briarwood Condominium. The
Rosenberg's have owned the property since May 22, 1985. In the three (3)
years that they have owned the property, they have Suffered through five (5)
sewage back ups. In each instance, sewage backed up into their bathtub,
overflowed the toilets and damaged their unit. The Association has paid
them for their damage and has made efforts to keep the sewage system clear
by using the services of Rotor Rooter. Unfortunately, Rotor Rooter is
unable to keep the sewage system clear, and they live in constant fear of
sewage backing up into their home.
Mrs. Rosenberg is quite ill, and her physician, Dr. Norman Mann, has advised
me that the stress created by the constant threat of sewage back ups is
effecting Mrs. Rosenberg's health. In addition, her husband has a long
history of heart problems, and his health is being jeopardized by the
Association's inability to correct the situation.
The Association must take immediate steps to correct the situation. We
expect that you will immediately obtain estimates and make whatever
modifications to the sewage system as are necessary to ensure that the
Rosenberg's unit will not be subject to' sewage back ups. If immediate
corrective steps are not taken, the Rosenberg's will take whatever steps
they deem necessary to protect their Health and their investment. Although
litigation is an event they do not relish, they are prepared to take that
step if the situation is not rectified.
Thank you in advance for your anticipated cooperation.

RE: 1302 TWIN CIRCLE DRIVE, SOUTH WINDSOR, CT
PROPERTY OF SEYMOUR & JANICE ROSENBERG
Dear Mr. Martin:
Thank you for your letter of April 7, 1988. Obviously, my clients are very
pleased that the Board of Directors is finally taking corrective action. A
14-21 day time schedule is acceptable to the Rosenbergs. In the event there
is going to be any delay, we would want that information conveyed to us. We
are assuming that the work will be completed within 21 days.
I do feel it is necessary to respond to the second page of your letter
wherein you state that Mr. Rosenberg has been harassing members of the
Board. You and the Board have to understand that the Rosenbergs have lived
with this problem since the day they moved into their house. They have been
forced to retain the services of an attorney in order to ensure that .this
problem is corrected. I belive that rather than harassment, Mr. Rosenberg' s
actions are properly characterized as those of an individual who wishes to
protect his investment and his health. To the extent the work is not
completed, he will continue to take such steps as are necessary to ensure
that both his health and his investment are, in fact, protected.,
Very ••- o s,
i

Dear Mr. Martin,
Pursuant to our meetings of May 4th and, 5th, 1988 concerning
Mr. Rosenberg' s complaint of sewer backups at 1302 Twin Circle
Drive, the following issues were reviewed and a resolution to
the problem was agreed upon.
Those present at the meetings:
Mr. Seymour Rosenberg (May 4th meeting only)
Mr. Thomas Martin, Thibodeau Management
Mr. Robert Deptula, Town Health Department
Mr. Fred Shaw, Town Public Works Department
a contractor hired by Thibodeau Management (May 5 meeting only)
It was determined that the elevation of the building sewer should
be determined to ensure enough pitch to where the main line exists.
It was determined by your contractor that there was not proper
pitch to the main sewer line. This is obviously the cause of
the sewage backup. It was agreed that the best solution to this
problem was to install an ejector pump connected to a suitably-sized
force main which would drain into the existing manhole. A large
enough reservior to accommodate sewage in the event of a power
failure should also be installed.
It was also agreed upon that all necessary permits to do the re-
quired work be obtained from the town before work begins. Ad-
ditionally, it was agreed that the building sewer would be cleaned
as often as is necessary to prevent blockage of the line and
prevent another backup into Mr. Rosenberg' s unit, and that the
work would commence as soon as possible (May 9th or 10th) .
Very truly yours,
LMZ fJ A21/

PROPERTY OF SEYMOUR & JANICE ROSENBERG
Dear Mr. Martin:
I understand from your phone call of May 31 that there will be a delay of
1-2 weeks in resolving the sewer line problem in connection with the above
unit. As I am sure you are aware, my clients are most anxious that this
problem be resolved as expeditiously as possible. I would appreciate if
your office could supply me with an outside date for the correction of this
problem. An outside date will provide a comfort factor for my clients and,
at this point, I believe that is the least they are entitled to.
Please get back to me at your earliest convenience with an outside date so
that I may convey it to my clients.
