Family Day Care Homes are programs that provide supplementary care for six or less children. These programs are licensed and regulated by the Connecticut Department of Public Health(DPH). For your information and/or guidance DPH has developed the attached recommended protocol and a letter that will be included with licensure application documents. These documents were developed in consultation with the Connecticut Association of Directors of Health(CADH) and the Connecticut Environmental Health Association(CEHA). Please note that the recommended protocol and the license application insert letter are directed toward Family Day Care Homes and do not pertain to the other types of programs of supplementary care for children that are licensed and regulated by the DPH (i.e., Child Day Care Centers and Group Day Care Homes). The recommended protocol provides local health departments with guidance for follow up action upon notification that lead-based paint hazards have been identified in family day care homes. Background: During pre-licensure, re-licensure, random, and complaint inspections of facilities that will be/are used to provide family day care, DPH child care licensing specialists may observe deteriorated paint conditions. The licensing specialists are required to collect paint chip samples from those deteriorated painted surfaces and submit those samples to the DPH laboratory to be analyzed for lead content. (Note: The child care licensing specialists have been trained to collect and transport these paint samples that are obtained during the course of the site visit but they are not trained lead inspectors.) The template letter"Lead Letter to Family Provider" (copy enclosed) is used to develop a site-specific letter that includes sample analysis results and guidance on how to proceed. The letter and the analysis results are provided to the family day care operator by DPH. Copies of these documents are sent to the local health department(LHD)by DPH when lead-based paint has been.identified. Under certain circumstances as described below, the LHD is required to undertake various follow up actions. LHD Follow Up Protocol The LHD follow up is related to two main factors: (1) the presence of identified lead- based paint that is in a deteriorated condition and(2) site specific occupancy status. • When lead-based paint has not been identified in the paint samples no action is required of the LHD (items #1 and#2 on the template letter). • When lead-based paint has been identified required follow up action is determined by the site-specific occupancy status as described below. A. Family Day Care where children <6 years of age reside(item#4 on the template letter) 1. The LHD visits the site to confirm the existence of the deteriorated lead-based paint hazards identified in the DPH report. Phone: Telephone Device for the Deaf (860) 509-7191 410 Capitol Avenue -MS# P.O. Box 340308, Hartford, CT 06134 An Equal Opportunity Employer 3. Additional deteriorated painted surfaces observed by the LHD during the site visit must be either: a. Sampled/tested by the LHD and ordered eliminated if a toxic level of lead is found'2 or; b. Stabilized using lead-safe work techniques in lieu of sampling/testing(i.e. establish a lead safe condition assuming that these additional deteriorated surfaces may contain lead-based-paint). 1,2 4. The LHD is permitted(but not required)to conduct a complete(comprehensive) lead inspection to identify all surfaces thatontain lead-based paint. 5. The property owner submits a lead hazardzemediation plan to the LHD for review and approval. The LHD monitors the corrective action and verifies that the corrections have been properly implemented. 6. The LHD sends written verification to DPH, Child Day Care Licensing Unit when hazard remediation has been properly completed. C. Family Day Care where children <6 years of age do not reside and where the family day care facility is not located in a tenement house(item#3 on the template letter)=Please note that under this scenario the DPH encourages the LHD to be involved in an advisory role to the extent that local resources will permit. 1. The LHD may be contacted by the family day care operator and requested to assist in resolution of lead-based paint hazards identified by the DPH. 1'2 The LHD may provide such assistance or refer the family day care operator to a licensed lead consultant contractor. The LHD may visit the site to confirm the existence of the deteriorated lead-based paint hazards identified in the DPH report. 2. Additional deteriorated painted surfaces observed by the LHD during the site visit may be either: a. Sampled/tested by the LHD and referred to the DPH, Child Day Care Licensing Unit3 if a toxic level of lead is found'2 or; b. Recommended to be stabilized using lead-safe work techniques in lieu of additional testing(i.e. establish a lead-safe condition assuming that these additional deteriorated surfaces may contain lead-based paint). 1,2 3. The DPH will require the elimination of hazards caused by any deteriorated surfaces that have been determined to contain lead-based paint. 1,2 4. A hazard remediation plan is submitted to DPH, Child Day Care Licensing Unit3 for review and approval. The DPH monitors the corrective action and verifies that corrections have been properly implemented. Buzzetti, RS Supervising Environmental Sanitarian Department of Public Health 410 Capitol Avenue, MS #51 LED Hartford, CT 06134-00308 From: Phyllis E. Hyman Assistant Attorney General Office of the Attorney_General 55 Elm Street, 4th Floor Hartford, CT 06106 808-5210 Date: May 31, 2001 Subject: Collection of Lead Samples by Day Care Specialists This memorandum is in response to your request for advice concerning whether day care specialists who inspect family day care homes prior to licensure or relicensure are authorized to collect samples of paint for analysis by a laboratory to determine whether the paint contains impermissible levels of lead. Based on my review of the relevant statutes and regulations regarding family day care and lead paint inspection, we conclude that day care specialists who license family day care homes for the Department of Public Health (the "Department') are authorized to collect paint chips during their inspection visits for the purpose of having them analyzed for the presence of lead paint. Pursuant to section 19a-87b(a) of the Connecticut General Statutes, when an individual applies for a license to establish a family day care home or applies for relicensure of said license, "the department shall make an inquiry and investigation which shall include a visit and inspection of the premises for which the license is requested." Department day care specialists perform these inspections to ensure that all applicable statutory and regulatory requirements pertaining to family day care homes are met. As part of these inspections, the family day care statute requires the Department's day care inspectors to inspect for sources of lead poisoning. Specifically, section 19a-87b(a) provides that "[ajny inspection conducted by the department shall include an inspection for Alan J. Buzzetti, RS May 31, 2001 Page 3 Conn. 641 (1993); Gaynor v. Union Trust Co., 216 Conn. 458 (1990). Therefore, the specific statutes authorizing day care inspectors to collect paint samples and have them analyzed for their lead content, governs. Even under the general statutory provisions concerning inspections for the presence of - toxic levels of lead, however, there is nothing that would prohibit day care inspectors from inspecting family day care homes for evident sources of lead poisoning, collecting samples and providing for the chemical analysis of these samples. "Inspection" under the lead abatement statutes is defined as "an investigation to determine the presence of lead in paint, lead in other surface coverings, lead in dust, lead in soil or lead in drinking water, and the provision of a report explaining the results of the investigation." Conn. Gen. Stat. § 20-474 (10) (emphasis added). An "inspector" under these statutes is an individual who performs inspections solely for the purpose of determining the presence of lead-based paint and surface coverings and lead in soil, dust, drinking water through the use of on-site testing including, but not limited to, x-ray fluorescence (XRF) analysis with portable analytical instruments, and the collection of samples for laboratory analysis and who collects information designed to assess the level of risk. Conn. Gen. Stat. § 20-474 (11) (emphasis added). These definitions do not apply to that portion of the statutes that governs the inspection of family day care homes. See Conn. Gen. Stat. § 20-474 (definitions in section 20-474 apply to sections 20-474 to 20-482, inclusive, subsections (e) and (f) of section 19a-88 and section 19a-111). Even if they did, however, day care specialists are not "inspectors" conducting "inspections" as the terms are defined above. The family day care inspectors are not visiting family day care homes "solely for the purpose of determining the presence of lead-based paint and surface coverings. . . ." Rather, they are inspecting the family day care homes for the purpose of ensuring that the home and its staff are following the Department's extensive health and safety regulations that pertain to all aspects of the family day care operation. The gathering of paint chips is an incidental piece of a family day care inspection. Moreover, there is no sampling of the soil, dust and drinking water and there is no on-site testing performed by the day care specialists during their inspections. Accordingly, the mere gathering of paint chips by family day care specialists inspecting the premises of a family day STATE OF CONNECTICUT DEPARTMENT OF PUBLIC HEALTH *• Division of Community Based Regulation May 9,2002 Name of Provider Address Town,CT Zip Dear Name: Enclosed is a copy of the test results from paint sample(s) that were collected during my visit to your family day care home on date. These samples were collected from painted surfaces that were observed to be deteriorated. Test results from the paint samples indicate that: 1 ❑ Lead-based paint was not identified in any of the paint samples that were collected. There is no action required from you. 2: ❑ Some of the paint sample(s)that were collected contain levels of lead below the level (0.5% by dry weight)deemed to be lead-based paint. Although these surfaces do not contain lead- based paint, lead dust or lead-contaminated soil hazards could be created if the paint is turned into dust by abrasion, scraping, or sanding. Caution should be taken when disturbing these surfaces. There is no action required from you regarding these surfaces. - 3: ❑ Lead-.based paint was identified in paint samples that were collected. Children under the age of six do not reside in your home(and the building does not contain three or more dwelling units). Therefore, the lead-based paint hazards must be corrected and made inaccessible in accordance with the Regulations for Family Child Care Homes (Section 19a-87b-9): "Poisonous substances shall not be accessible to children enrolled in the facility." You are required to take immediate steps to correct this problem because you(intend to)operate a family day care home. Performing this work improperly may create a greater lead hazard. It is recommended that you contact your local health department or the Lead Environmental Management Unit of this department [(860) 509-7299] who can help you decide what work methods are most appropriate for your property and situation. Before work is initiated a copy of the hazard remediation plan must be submitted to the Child Day Care Licensing Specialist for DPH review and approval. The plan must: (a)describe measures that will be taken to ensure that children will not be exposed to any hazards (including lead paint chips and dust) before, during and after the remediation, (b) describe work to be performed and provide an explanation of how that work will be performed in a lead-safe manner, (c) identify who will perform the work, (d) provide time frames for completion of repairs, and (e) document that all parents of enrolled children have been given notice that lead-based paint hazards have been identified at the facility, and that the conditions are being corrected.(See attached sample letter.) Box 340308 Hartford, CT 06134 An Equal Opportunity Employer STATE OF CONNECTICUT DEPARTMENT OF PUBLIC HEALTH 0U/t SJSNC T Dear Family Day Care Home Applicant, Please be aware that lead was commonly used in paint until 1978. Since 197-8 the Federal Government banned the use of lead in all residential paint. If the home you are planning to use as a family day care home was built before 1979 the possibility exists that the home may contain lead-based paint and lead-based paint hazards (estimates show that 75% of homes built before 1979 contain some lead-based paint). Lead-based paint that is in good condition is usually not a hazard. Peeling, chipping, or flaking lead-based paint is a hazard. Please note that as part of the licensing process a State of Connecticut, Department of Public Health child care licensing specialist will collect paint chip samples from any peeling, chipping, or flaking paint that is noted during the licensure inspection and will submit the sample(s) for laboratory analysis. This is a requirement under Connecticut General Statute §19a-87b. If the analysis identifies lead-based paint, the Department of Public Health will notify the local Director of Health. Pursuant to the state Lead Poisoning Prevention and Control Regulations, the Director of Health must order abatement of any defective lead-based paint surface(s) if a child under six (6) years of age resides in your home. Lead abatement work has the potential to be very expensive. In some cases lead abatement work can exceed the value of a given property. Prior to the inspection by the child care licensing specialist it is suggested that you consider hiring a certified lead consultant to conduct a visual inspection of your property in order to evaluate painted surfaces and identify potential lead hazards. This assessment would determine if lead-based paint hazards may exist and where the potential hazards are located. If potential hazards are observed they may be treated by standard lead-safe treatments, as opposed to lead abatement. Standard treatments are generally easier to do and much less expensive than lead abatement work. If you are in a rental property it is strongly recommended you discuss the licensing process with your landlord prior to scheduling any inspections. Exposure to lead-based paint hazards can be detrimental, particularly to children under the age of six. Lead exposure can have negative health and developmental impacts such as reduced intelligence and attention span, and may cause learning disabilities and permanent damage to the nervous system. The U.S. Centers for Disease Control & Prevention have stated that childhood lead poisoning is "the most common environmental disease of young children and is entirely preventable". !'h(me: (860) 509-8045 i Telephone Device fiOr the Detif (800) 509-7191 410 Capilol Avenue - Ms# 12DAC N.O.
