A PLOT PLAN INDICATING LOCATION OF PROPOSED STRUCTURE, WATER SUPPLY, SEPTIC SYSTEM, EM•
BANKMENTS, WATERCOURSES, PROPERTY LINES AND ALSO INDICATING EXISTING AND PROPOSED
FINISHED GRADES MUST BE SUBMITTED BEFORE THIS PERMIT CAN BE ISSUED.
THIS PERMIT IS NOT TRANSFERRABLE FROM PERSON TO PERSON OR FROM PLACE TO PLACE.
NO PART OF THE SYSTEM SHALL BE BACKFILLED UNTIL IT HAS BEEN INSPECTED AND APPROVED BY THE
SANITARIAN.
SPECIFICATION AND REQUIREMENTS AS STATED IN THIS PERMIT MUST BE MET AND ANY CHANGES MUST
BE APPROVED BY THE TOWN SANITARIAN BEFORE FINAL APPROVAL WILL BE GIVEN.
THIS PERMIT SHALL NOT BE CONSTRUED AS PERMISSION TO CREATE A NUISANCE CONDITION NOR IS
THIS SYSTEM GUARANTEED BY THE HEALTH DEPARTMENT.

Re: Construction of New Septic System at 351 Niederwerfer Road
Dear Mr. Harris:
It is my understanding that a septic system to replace your existing one needs
to be installed on your property. This letter is to remind you and your
contractor that State Public Health Code requires that any part of a septic
system be a minimum of 25 feet away from any existing drainage pipes. In
order to install the proper amount of leaching area as per code requirements,
existing drainage pipes must be removed. The Code also requires that your
new system be elevated so you will need to fill a large position of your back
yard.
While these actions are required by the State Health Code, you should be
certain that you are legally entitled to either remove the drainage pipes or
elevate your backyard. If any neighboring property has any rights to the use of
the drainage pipes, you may need their consent before you seek to remove the
pipes. Also, if elevating your yard creates a new drainage pattern which causes
damage to an abutting property, you may need an easement from your
neighbor or some agreement that you can change your yard in such a manner
that it creates additional drainage onto his or her property. The Town takes no
position as to your right to do these things without seeking prior approval from
an abutting homeowner, even though you are required by the Code to do these
things to install your new septic system.
