Mr. Greg Neary
474 Main Street
South Windsor,CT 06074
Dear Mr. Neary:
Pursuant to your request, this letter is written in regard to the various permits that have been taken out
on your property. I have reviewed the information on file in the Building Department, Planning
Department, and Health Department that pertain to your property.
With regard to the Building Department, any construction done to the house and garage that we have
been made aware of has had all necessary permits taken out.
The Planning Department approved a Home Occupation Permit (Office Only) for the living space
above the garage. Please note that Home Occupation Permits do not run with the land. Any future
owner of 474 Main Street would need to acquire a new Home Occupation Permit from the Planning
Department or the Planning & Zoning Commission should they want to utilize this living space for a
home occupation. Planning & Zoning Commission approval would be required in order to use.the
living space as an in-law or accessory apartment; this approval would also have to be sought by each
additional owner of this property.
As you may recall, there were outstanding Public Health Code issues as noted in the letter dated
December 9, 2009. On December 15, 2009, you received a Permit to Discharge, which, reflects final
approval from the Health Department confirming that all Public Health Code issues have been
resolved.
Should you have any further questions or concerns, please do not hesitate to contact my office.
Very truly yours,
C

Re: Request to connect detached garage to central system owned by Rose Neary located at
474 Main Street, South Windsor, CT 06074
Dear Mr. Merrigan:
The owner of the above referenced property has requested to convert the area above the detached
garage into habitable space that will contain one bedroom. They would also like to request an
exception to section 19-13-103d(d) and connect to the central subsurface sewage disposal
system.
The existing subsurface sewage disposal system is properly sized for a four(4)bedroom house
and all the requirements of B 100a have been met for a two bedroom system. As you know a two
bedroom system application was applied during the review because this is the minimum sized
system allowed by the Technical Standards of the Public Health Code. There is room enough in
the yard directly below the existing septic system for a six(6)bedroom septic system repair
when the need arises.
If you have any questions or would like to discuss this request further, please call me at
860-644-2511, extension 248.
Sincerely,,

Re: Notice of Exception to connect detached garage to central system located at
474 Main Street, South Windsor, CT 06074
Dear Ms. Neary:
Enclosed you will find a copy of the Notice of Exception granted by the State of Connecticut,
Department of Public Health, Subsurface Sewage Disposal Section. This document allows you to
legally connect the detached one bedroom residence above the garage located at the same
address to the existing central septic system that currently serves the home.
The next step toward final approval from this office is to apply for a permit and have all
subsequent work inspected by a representative from this office. When all the work is inspected
and approved a Permit to Discharge will be issued which constitutes final approval.
If you have any questions or would like to discuss this request further, please call me at
860-644-2511, extension 248.

Hi Everyone,
For the sake of clarification and in response to the a-mails I would like to take a moment and explain that this
building is served by a septic system and as such the building and its use may be governed by other regulations
but most certainly it is governed by the Public Health Code. The interpretation of the space above the garage is
just part of what the Public Health Code governs for this building and for simplicities sake I will confine my
comments to this part of the code. This dept understands that there are several depts. that must review the space
above the garage and all the depts. may not agree on what the use of the space is but they certainly should not
be contradicting other depts. regulations. In essences one depts. interpretation does not trump another. This
matter has been discussed with the State Health Dept Sub Surface Sewage Disposal Section and they have
agreed with the results of the review of this dept.which are that the habitable space above the garage meets with
the definition of a bedroom as outlined in the Technical Standards for Subsurface Sewage Disposal Systems
located on page 13 and. Please feel free to discuss this matter with me at anytime.

Subject: RE: 474 Main Street
Hi Chris,
Thanks for the heads up on 474 Main Street. You are correct that there are relevant issues for Planning and
Zoning should the space be used for anything besides a Home Office, or if the property is sold, in which case the
new owner would need to re-apply for permits.
The Zoning file contains a copy of a November 19, 2009 letter to Mr. Greg Neary from Town Manager Matthew
Galligan which clearly spells out the implications for the property with regard to Planning and Zoning. It also
seems to address the issues of the Building Department and the Health Department, but I would defer to those
departments authorities.

Patrice,
I was cc'd a letter dated November 23, 2009, from South Windsor's Sanitarian to the State of CT Department of
Health regarding Rose Neary's detached garage and her septic system at 474 Main Street.
To avoid any confusion or misinterpretation,by the homeowner, the conversion of a space above a
garage for sleeping purposes must be in compliance with the State Building Code, which will require a
new building permit application. There may be relevant issues for Zoning, if the space is intended as an
in-law or accessory apartment.
As it presently stands the existing habitable space above the garage, is the home owner's office. This
space(office), in its present configuration does not allow for a code compliant bedroom use.
