HomeMy WebLinkAboutSeptic Correspondence 38 Main Street Town of • • • DepartmentHealth Memo To: File From: Robert De Vito, Environmental Health Officero) Date: 12/24/2009 Re: 28, 30,38 Main Street During the construction of the septic system that services the horse barn on 38 Main Street this department received notification from the owner of 28/30 Main Street that the septic system for 28/30 Main Street was on the property of 38 Main Street. The owner of 28/30 Main Street continued with his leaching fields were dug up during the construction of the foundation for the horse barn which begged the question why did he and/or the building department notify this department at that time. His response was that he was told by the persons constructing the foundation it was a regular drain pipe and he had no reason to be concerned. The construction for the septic system for the horse barn was stopped and an investigation to locate the septic system for 28/30 Main Street ensued. The results of the investigation confirmed the leaching fields were on the horse barn property and they were dug through during the foundation construction. In addition the end of the northern most trench was directly against the foundation. Sean Merrigan from the State Health Dept visited the site to assist in making a decision. He offered several options and explanations for resolution one of which was the owner of 38 Main St could remove 15 feet of the trench from 28/30 Main St to satisfy the required separation distance and the owner from 38 Main would not be obligated to reconstruct it.This was the option that was taken and the Pudeler As Built shows this alteration. 1 r i ti'h Z ! He informed me that during the construction of the new foundation his leach fields were dug up. I questioned why he did not inform me at that time and his reply was he was told it was"run of'. He expressed great concern that when the leach fileds for this property are to be installed they would interfere with his fields. His concern was that they would be dug up. I and the Licensed Installer,James Throwe, performed a preliminary inspection to determine the validity of his concerns. His tank is approx. 10 from this property line and his fields/gray water system is on this property. The construction of the new fields was stopped and the owner of 38 main St was informed. Resolutions/Options: 1. The exact location of 28 Main St,Cortese, system must be located and placed on a plan. 2. An easement must be granted to 28 Main St, Cortese. 3. Explore the possibility of the system for 28 Main St; Cortese can be reconstructed on its own property. 4. Relocate the proposed system for this property to another area on the property. 1 TOWN OF SOUTH WINDSOR HEALTH DEPARTMENT Application for permit to install a new/repair subsurface sewage disposal system.
