Shaw, Superintendent of Pollution Control RILI FROM: Robert Deptula, Environmental Health Officer RE: 259 Lawrence Road As requested, following is information regarding the soil conditions at 259 Lawrence Road, South Windsor. Four test pits were dug on 5/1/97 in order to facilitate the installation of a repair septic system on the property. The soil and high ground water conditions are such that an engineer will be required to adequately design a system. It appears as though(although not confirmed) the system will be a filled system requiring the installation of a pump. Several "special conditions" exist on the lot. It is these which necessitate an engineered design. They are, high ground water, marginal soil (30-60 min./inch percolation rate), underlying tight soil, seasonal high ground water, and possible seasonal flooding. y I1lP=GA=CR FOR SEWAGE DMIUCSAL SYSIMM } v - LOC.T'*0!1 ,`_`1... -tcC.-cam ✓ w ows Vs eomtr pgt7L1TZ0a TE^I9: (Record all tarts)—"f7 SOIL MOISTURE: T= .READINGS gam 1 7 = #2 MaLz ` TIM Rtadl.as Time Reding Time RescSSng Time Read.:_a a bYV a -7 N L I3" TAjtTLATZ0?t OF Tom"'..:'!' ?MILTS Depth prozowx ?Kiaimua .pesaa2atlw k TMoye (I_nch_s) Err. h'Sase Ia , 2 4. as: C3:F t4A^_'IOlt PITS: (Record pits) - _y Gr=.rA 'rioter Tsble: Ugh a ov mcFarT SOTL P ' ►; P= D P?'i' C I 61- v ..`-ta Tod ®-y76p -i - le Ff4Zrvim' Y-36 `fY°--V" Pat r3 Fr►,r vyF r;tiy t -r trr.y wp # z vr.^Y !ate ypvrl .j;l t s4,, fitly f w z , TJISOL mjOR CF MIREWAr"ION n"'S G==d Soil Le At water At 11 b aasr e ;pp r' May 29, 1997 Mayor William Aman South Windsor Town Council 1540 Sullivan Ave. South Windsor, Ct . 06074 Dear Mayor Aman The Water Pollution Control Authority (WPCA) is continually evaluating our policies regarding sewer installations and associated regulations . The WPCA resolution presented to the Town Council earlier this year recognized the need to alter our policy relative to commercial and industrial zones in order to enhance economic development and growth in the new commercial areas established. The Town Council resolution, which followed the WPCA proposal for Town participation in the installation of a trunk line on Ellington Road, broadened the scope to include a policy which would provide cost sharing of sewer extensions based on a cost benefit approach for commercial and industrial properties . The WPCA is actively represented and is working with the Town Manager, his staff and the Economic Development Commission in developing the policy requested in the Town Council resolution. It should be noted that this cost sharing policy being developed as specified in the Town Council resolution is for the purpose of increasing the incentive for economic development and growth in our commercial and industrial areas . At the WPCA meeting of May 20, 1997, the subject of our residential sewer policy was discussed at length. It was stated that residential sewers, at this stage of growth of South Windsor, provide no economic development enhancement . Therefore, the sewer policy being developed for our commercial and industrial areas will not include residential sewer policy. Reviewing the past activity under our present policy for residential sewers, the Authority members unanimously concluded that the present residential policy is proper, effective and will be continued. This policy, which is reflected in Section 5, paragraph 5 . 3 and Section 12, paragraph 12 . 1 of the WPCA Rules and Regulations, is included as Attachment A. The Developers Agreement policy, wherein we allow developers or property owners to recoup a part of their expense when other properties hook up to the installed sewer, is a reasonable and fair assist program to those who install sewers at their own expense. The policy is in effect at several locations at present . This Developers agreement policy is included in Section 13 , paragraph 13 . 6, a copy of which is included as Attachment B. 2 . The WPCA considers a change in residential sewer installation policy is not warranted at this time for the following reasons . 1 . It sets an undesirable precedent which could cost the town of South Windsor an estimated $21, 000, 000 if the town installed sewers in all of the remaining stubs and isolated unsewered areas in town using the present assessment formula. 2 . Consistent guidelines would be difficult to develop in order to determine the areas that truly require sewers and how priorities would be determined. The Ridge road and Lawrence road . situations are good examples of inconsistencies in the reported problems. 3 . In order to obtain professional guidance in support of our policy, we consulted our Environmental Health Officer and a licensed septic system contractor who does septic system construction and repair. Our Environmental Health Officer has indicated that there have been no reported problem that could not have been corrected with an on-site repair. Cost estimates were provided by a licensed septic systems contractor doing business in South Windsor. A minimum repair was approximately $3500 . 00, a maximum repair was in the area of $20, 000 . 00 and the average repair was given as about $5000, 00 . 4 . To establish equality for all, developers and property owners who have installed sewers at their own expense in the past would have to be considered for reimbursement for their expense. It is estimated, based on the best available information, to be approximately $2, 146, 695 . 5 . Bonding for these periodical relatively small expenditures would not be cost effective and may not be approved by the majority of the property owners not involved in these small installations . 6 . The WPCA would be reluctant to use existing or future user fees to finance new construction. That is not a legitimate expenditure of user fee funds as presently defined. We would require the establishment of a fund with financial resources yet to be determined, and a time period in which funds can accumulate . This concept is being pursued by the WPCA and the Town Manager and his Staff . 7 . Any mandatory payment concept would force involved properties with functioning septic systems to pay for sewer installations they don' t need or want . 3 . In summary, the WPCA has unanimously stated that they propose to retain the present residential sewer installation policy. The Authority members do however, suggest that if the Town wants to assure a proper installation at a competitive cost, the Town can act as the general contractor and have any selected sewers installed. However, the full cost of the installation would be the responsibility of All properties that are served by that sewer through a 1000i assessment policy. A Ten (10) to Fifteen (15) year deferred payment policy could be considered. However, as stated in item 7 above, many properties with functioning on-site systems would be required to subsidize those properties that request and elect to connect to the public sewer. If Council members want to pursue this further, the WPCA invites the Town Council to a WPCA meeting which would contain this item as the only agenda item of the meeting. Please advise if the Town Council desires such a meeting with the entire WPCA membership. Very Truly Yours; i.,co ibos`ehJ. Caarino Chairman, South Windsor WPCA cc . All Council members Town Manager, Matt Galligan Town Attorney, Barry Guliano Director of Public Works, Michael Gantick Environmental Health officer, Robert Deptula`/ Superintendent of Pollution Control, Fred Shaw ATTACHMENT A Building Sewers and Connections 5 . 3 All costs and expenses incident to the installation, connection and maintenance of a sewer, lateral or cross country line on public or private lands shall be borne by the owner . The owner shall indemnify the Town of South Windsor from any loss or damage that may directly or indirectly be occasioned by such installation . 12 . 1 Resolution to Construction a Sewer System At any. time a member of the Authority may introduce, at a meeting of said Authority, a resolution to construct a sewerage system, the costs of which are to be met in whole or in part by assessment of benefits ; said resolution to . state briefly and intelligibly, the general layout and description of the proposed system. I ATTACHMENT B 13 . 6 The Authority, at its discretion, may enter into agreements with developers for the construction of sewers by and at the expense -of such developers involving the provision for reimbursement of such developers of sanitary sewer assessment charges and connection charges collected by the Town from other owners of land served by the developers sewer . The reimbursement shall be at a rate corresponding to the current rates in effect at the time of connection, but such 11 reimbursement shall not exceed the cost of construction. The limit of time for reimbursement shall be established by the Authority, but no reimbursement shall be made for a period greater than ten years from the date the Authority accepts- the sewer into the public- system. Expiration of the time for reimbursement to the developer shall not release subsequent owners of property connecting to the sewer from paying all appropriate and current sewer assessments and connection charges to the Town.
