MEMORANDUM To: Marcia Banach, Director of Planning From: Robert Deptula, R.S, Environmental Health Officer ip. Jeffrey B. Doolittle, P.E., Town Engineer Date: 4/25/06 RE: App 06-03P Tiger Lily Ventures Corp Subdivision The Tiger Lilly site on Burnham Street is proposed to be subdivided into three residential building lots with a well on each lot to provide potable water to the house. The Town has concerns about potential industrial contamination in the soil and groundwater on this site due to the industrial waste found on this site (old buckets, drums, tanks and mechanical parts) and because this site was industrial zoned for many years. The Connecticut Department of Environmental Protection has recommended that an environmental assessment be conducted on this site by an environmental professional under the State Voluntary Remediation Program. The Town wetlands officer, Jeff Folger received information from Joe Urso of Design Professionals, Inc about soil testing that was done on site and the removal of the abandoned storage tank found on the site. It is not clear if this work was done in accordance with the CTDEP Voluntary Remediation Program or by a licensed environmental professional. There are still questions that need to be answered about the environmental characteristics of this site. 1. A plan needs to be submitted for the clean up and proper disposal of the remaining waste and debris on the site. 2. An environmental assessment should be conducted on this site by a licensed environmental professional per the DEP recommendations. 3. The information from Design Professionals includes Total Petroleum Hydrocarbon(TPH)test results for 5 soil samples taken from this site. We did not find any map showing where these samples were taken on the site and from what depth. This information needs to be provided with an explanation as to how it was decided where to take soil samples from the site. Why were the soil samples only tested for TPH and not other industrial contaminants such as solvents, metals, pesticides, organohalides, etc. More soil samples and tests may be necessary. Why were no groundwater samples taken from this site and tested? 4. It needs to be shown that an uncontaminated potable water well can be provided for each proposed residential lot on this site. Test wells can be drilled or potable water wells can be installed now on each lot. Groundwater needs to be sampled and tested for hydrocarbons, organohalides, solvents, metals, pesticides and possibly other constituents to determine that an uncontaminatedpotable well can be provided on each proposed lot. Please call me if you have any questions. CT DEP: Voluntary Remediation Program CGS 22a-133y Fact Sheet Pagel of 3 wwn, _ . Voluntary Remediation Program - CGS 22a-133y NOTE: There are two voluntary programs in the State. This particular program is an elective process for which environmental assessments and remediation of properties located in areas which have a GB or GC ground water classification are performed by a Licensed Environmental Professional. This program requires the submission of a remedial action plan and remedial action report to the Commissioner. Purpose Public Act 95-190 "An Act Concerning Remediation of, and Liability for, Contaminated Real Property"became effective on October 1, 1995. This Act established a voluntary remediation program for owners of certain contaminated sites in Connecticut to facilitate the remediation of their property. This Act has since been codified as Section 22a-133y of the Connecticut General Statutes. Program Overview The voluntary remediation program is overseen by the Remediation Division of the Bureau of Waste Management, Department of Environmental Protection. Participation in the voluntary remediation program is not a regulatory requirement. It is an elective process for those property owners who wish to expedite the remediation of polluted property. Authorizing Connecticut General Statutes, Section 22a-133y. Statutes Applicability The following criteria for real property which has been subject to a spill must be met to allow for voluntary remediation under this program: 1. Such property is located in an area where groundwater is classified as GB or GC. 2. Such property is not subject to any order, consent order or stipulated judgment issued by the Commissioner regarding such spill. Who May Perform Any Licensed Environmental Professional(LEP)may conduct a Phase II the Work environmental site assessment or a Phase III investigation, prepare a Phase III remedial action plan, supervise remediation and submit a final remedial action report to the Commissioner for any real property subject to a spill which meets the criteria for voluntary remediation. The Licensed Environmental Professional must render an opinion that the action taken to contain, remove, or mitigate the spill is in accordance with the remediation standards adopted by the Commissioner under CGS 22a-133k. Submittals Remedial Action Plan Required Prior to commencement of remedial action, the owner of the property must submit a remedial action plan prepared by a Licensed Environmental Professional to the Commissioner. The Commissioner may review and advise http://www.dep.state.ct.us/pao/Perdfact/volremedl33y.htm 4/21/2006 CT DEP: Voluntary Remediation Program CGS 22a-133y Fact Sheet Page 2 of 3 such owner as to the adequacy of such remediation plan. q Y Permits Any permits required under CGS 22a for the proposed remedial action must be obtained prior to the commencement of the remedial action plan. The Commissioner shall expedite the process for issuing any permits needed. Notice of Remedial Action Prior to the commencement of remedial action the owner of the property must provide notice of remedial action by at least two of the following means: 1. Publish a notice of remedial action in a newspaper having a substantial circulation in the town where the property is located. 2. Erect and maintain for at least thirty(30) days a legible sign not less than six(6) feet by four(4) feet which is clearly visible from a public highway and must include the words 'ENVIRONMENTAL CLEAN-UP IN PROGRESS AT THIS SITE. FOR FURTHER INFORMATION CONTACT:" and include a telephone number for an office from which any interested person may obtain additional information about the remedial action. 3. At the conclusion of the initial IWA/CC Public hearing held on March 1",the applicant,Mr. Todd Kriney, represented that he would contract an Environmental Testing Firm to analyze samples on his property to determine if the soils on site have been contaminated. Activity included the removal of the above ground tank by Ivy League Landscaping on March 20th,2006. We have provided documentation regarding the proper disposal at Bixon,Inc. CET(Complete Environmental Testing,Inc.)collected 5 soil samples on March 21st,2006. Documentation provided by them reveals only one sample registering a level of TPH (Total Petroleum Hydrocarbons)far below the limits found acceptable by the State of Connecticut Remediation Standard Regulation(January 1996). Documentation of the test samples are provided for your review. Photos will be available at the Wetlands meeting for you to view. A variety of the material was found upon excavation of the"mounds"on site including topsoil, crushed stone, and pavement remains. It is the opinion of Mr.Kriney that these piles are remains from the activity associated with power line installation. Doolittle, P.E., Town Engineer Date: 1/30/06 RE: App 06-03P Tiger Lily Ventures Corp Subdivision have reviewed the proposed subdivision/special exception plan for Tiger Lily Ventures Corp on Burnham Street(beside No. 770), and I have the following comments: 1. The topography shown on the plan does not appear to be complete, based on my site walk and the Town topo map. There are several large mounds or small hills on the site that are not shown. Please check the topo and revise as necessary. 2. There are old industrial parts, buckets, drums and a large storage tank on the site. These need to be cleaned up and disposed properly off site. The site (soil and groundwater) needs to be checked for waste contamination and remediated as necessary. There area also piles of old brush that have been dumped on the site and need to be removed and properly disposed. 3. Surface drainage from this site needs to be addressed. What is the increase in runoff expected from this site as a result of this development? Where will this surface water go? There is not obvious place for surface water to discharge off site and presently it stays on the property. What improvements are necessary to handle the surface runoff from this site (including foundation drains) so it does not impact abutting properties or Burnham Street? 4. The proposed sanitary sewer laterals will require both WPCA approval and MDC approval. All sewer charges assessed by the MDC must be paid prior to installation of the sewer laterals. A drain layers permit must be taken out from the Town of South Windsor for the sanitary sewer laterals and the Town will inspect their installation. 5. Additional ROW needs to be quit-claim deeded to the Town of South Windsor to provide a 25 feet ROW from the center of Burnham Street to the north along the front of this property; unless this has already be done. 6. Will the driveway be paved with bituminous concrete? Lable it accordingly. Please call me if you have any questions. The property is presently identified as Assessor's map #8, parcel #55 in the South Windsor Assessor's office. Since public water is not readily available, these properties would be served by private wells. During a visit to the site Town staff observed some five gallon type buckets, some rusted 55 gallon drums, one large fuel type storage tank on top of the ground and several what appeared to be large tanks of the same type partially buried. These items raise the issue of potential soil or ground water contamination which might have an impact on private wells. Additionally, there are "mounds" of soil on the property. Some of these mounds appear to be covering metal, asphalt, and concrete. It is felt that requesting DEP input would be prudent regarding the proposed development of this site. If you have any questions please contact me at the South Windsor Town Hall at 644-2511 ext. 248. Yours truly, Robert Deptula, R.S. Environmental Health Officer RD/cm Cc: Joseph A.
