Varley: This is to confirm our telephone conversation today concerning your proposed measures to rectify your violation of the building permit (inadequate grading on your property) . It is my understanding that Boutin & Sons will be giving you an estimate of cost to place curbing along your driveway today. As I indicated,, we must receive confirmation by Tuesday morning (9-17-91) from Boutin & Sons that they will be installing the curb this week. Also your proposal to complete the rest of the grading "on weekends" is unacceptable. This must be accomplished by a professional and must be completed within two weeks from today. If we receive confirmation from Boutin & Sons by Tuesday morning (September 17 , 1991) and confirmation from a professional in the grading field by Wednesday morning (9-18-91) that the grading will be completed by September 30, 1991, we will refrain from starting legal procedures . However, if this work is not completed within these time frames, or if confirmation is not received, we will immediately start legal proceedings . It has now been almost one (1) month since my letter of July 26, 1991 and we cannot allow a substantial extension of time, particularly in view of the fact that we are in the middle of hurricane season. Accordingly, an extension of the deadline contained in my July 26, 1991 letter is granted to on or before September 3, 1991 which would give you approximately two (2) weeks- to resolve this matter. The Town is not interested in any, dispute you may have with a general contractor. It is your responsibility to correct this grading problem by September 3, 1991. Failure to do so, as there will be no further extensions, will mean immediate institution of legal action as described in my letter of July 26, 1991 without further notice to you. Varley: This is to inform you that you are in violation of Section 8-12 of the State Statutes . When a Building Permit was issued for Lot #176, 158 Newmarker Road, the plan stated "Grade to keep water on Lot 176" . An inspection of the 158 Newmarker Road site indicates that this has not been -complied with. At the present time the grading is such that stormwater flows from Y 9= property onto the adjacent property belonging to Mr. .& firs . Joseph Natsisky. Therefore, this must be corrected to comply with the building permit plan. You are hereby ordered to correct this situation within 10 days of receipt of this certified letter. Failure to correct this within 10 days as duly authorized by Section 8-12 of the State Statutes will leave us no alternative but to commence legal proceedings which could lead to fines being imposed, revocation of the Certificate of Occupancy and a specific court order prohibiting use of the premises. It is' recommended that you contact your engineer to determine the appropriate corrective measures which will be necessary to correct this situation., V ry truly yours, Je ry C Iaz0a, E. To n ineer JCl/jsv cc: Jean E. Zurbrigen, Town Manager Richard Rittenband, Town Attorney Michael J. Gantick, Director of Public Works Joseph Natsisky, 122 Newmarker Road =(A Ale wma4 MEMORANDUM December 28, 1987 To: Richard J. Sartor, Town Manager Re: Property located at .122 Newmarker Road In response to a complaint made to your office on December 1, 1987 by Mr. Joseph Natsisky of 122 Newmarker Road, South Windsor, an investigation was conducted and the following information was gathered. Since the Town has no involvement in contractual agreements between private parties, the monetary aspect of this complaint was not investigated. 1. A statement from Joseph Natsisky, 122 Newmarker Road, South Windsor, containing allegations of improprieties on the part of Mr. Raymond Dzen. 2 . A statement from Mr. Raymond Dzen of Dzen Construction Co. , Inc. 3. Memo from Lester Braddock who inspected the sewer lateral installation at 122 Newmarker Road. 4 . Four notes to file containing additional iinformation. 5. Four Polaroid photographs. Based on the information obtained, and since Mr. Natsisky refuses to dig up his well to verify its location, it is currently unknown if indeed the sewer lateral was installed too close to the well, as alleged by Mr. Natsisky. In conclusion, a determination cannot currently be made as to whether or not a voilation of the State Public Health Code exists. If additional information becomes available, appropriate procedures will be utilized in dealing with it. As of this writing, Mr. Dzen has not yet read or signed his state- ment. He has indicated he will do so only if it could be read by his attorney. I have informed him that a copy would be made available to him for his attorney' s review, but he has not yet claimed it. lc-e 0 Robert Dept la, R. S. Environmental Health Officer RD/ml Page 1 of 8 The following is a statement given to Robert Deptula , Environmental Health Officer for the Town of South Windsor and Officer Felber of the South Windsor Police Department by Mr . Joseph Natsisky of 122 Newm Aker Road , South Windsor , on December 3 , 1987. J' /u' Mr . Natsisky was born on March 26 , 1925 , and has lived at his current address ( 122 Newmarker Road , South Windsor) all of his life . His mailing address is Rockville . J At, When Mr . Natsisky 's land was sold to Mr . Mike Jacques , the agreement was that #122 Newmarker Road would be hooked up to the sewers ; and that Mike Jacques would pay for it . But that did not include #136 Newmarker Road--Mr . Natsisky ' s other house . Mr . Natsisky would pay for that himself . The house was hooked up in July or August--it was very hot and the workers spent considerable time sitting under a tree . Most of the finished grading was done by the Natsisky 's . They (the workers) did a poor job of grading . T V_ Mr . Natsisky then showed us the well location , and the U / location of the recently-installed sewer lateral (refer to Diagram #1 ) . He also pointed out that four (4) house sewers left the house--each of which was tied into the lateral (refer to Diagram #2) . He showed us the location of the incoming water line from his-ii well , and the closest existinghouse sewer Xiv (refer to Diagram #3) . Page 2 of 8 Mr . Natsisky came to see the Town Manager because of this "deal" between he and Mr . Dzen (the lien on his property by Dzen) . Before he had seen the Town Manager , Mr . Natsisky came in to see the "engineer" upstairs in the Town Hall (he did not know the engineer ' s name ) . Mr . Natsisky said he told the engineer that the sewer was hooked up wrong , and that an air test (or something) had to be done . He also told the engineer about the lien on his property . The engineer said he was not interested in the lien , but that the well was located past the shack about 75 to 100 feet from the house . The engineer was told this by Mr . Dzen ; and said that Dzen must have lied about the well location . The engineer told Mr . Natsisky that he would contact Mr . Dzen , but Mr . Natsisky said / not to--to wait and see what happened . While the job (the installation of the sewer lateral) was in progress , Dzen asked Mr . Natsisky where his well was located . Mr . Natsisky told him (refer to Diagram #1 ) . Mr . Dzen told Mr . Natsisky to say that the well was behind the shack about 75 to 100 feet away (refer to Diagram #4) , and feeds #122 and #136 Newmarker Road . Mr . Natsisky was to say this if anyone (from the Town) checked . Mr . Dzen told Mr . Natsisky that , this way , they (Dzen ' s workers ) wouldn ' t have to test the lines , or other stuff . Mr . Natsisky did not realize that these procedures were wrong , at the ` time . He had no knowledge of the regulations . Lit Page 3 of 8 Mr . Natsisky stated that he has an artesian well approximately 125 to 150 feet deep . Mr . Natsisky took us to an area past the shack and said that Mr . Dzen went to that point with a tape measure and for Mr . Natsisky to say that the well was at that point and feeds houses #122 and #136 Newmarker Road . That point was measured by myself and Officer Felber , and measured approximately 82 feet from the existing well ; and that much further from the installed sewer lateral . Number 136 Newmarker Road has its own well , which is r located greater than 85 feet from that recently installed sewer u^-NI lateral . Mr . Dzen charged Mike (Jacques) $4 , 500 , plus $800 to $900 , for a Permit to hook up #122 Newmarker ; and told Mr . Natsisky that #136 would be hooked up cheap because he (Dzen) would jack-up Mike ' s TIM (Jacques) price . Mr . Dzen gave Mr . Natsisky a bill for $2,4.99 for hooking up #136 Newmarker . Mr . Natsisky thought that was too much . Mr . Dzen said for Mr . Natsisky to pay him $1 , 800 cash , or a check made out to Ray Dzen . Mr . Natsisky said that was too much money . Mr . Dzen made harassing phone calls to Mrs . Natsisky ; called her names ; and said he would block-up the sewer line (if the bill was not paid) . Page 4 of 8 Mr . Natsisky offered to give Mr . Dzen a check for $1 , 800, and Dzen said "No , " and slapped a lien on #136 Newmarker Road . XNi Mr . Jacques told Mr . Natsisky to give him the $1 , 800 check , and he would give it to Mr . Dzen . Mr . Dzen would not take it . Mr . Natsisky gave the $1 ,800 to his lawyer to give to Dzen ' s lawyer , who also would not take it . Mr . Dzen finally accepted a check for £-$0 from Mr . Natsisky ; and the lien is supposed to be taken off the property at #136 Newmarker Road . Mr . Natsisky wants to pursue the sewer lateral installation at #122 Newmarker Road . C Z page 1 of 4 The following is a statement given to Robert Deptula , Environmental I Health Officer for the Town of South Windsor , by Mr . Raymond Dzen of 59 Stonehedge Lane , Bolton , Ct . on December 11 , 1987 . Mr . Dzen was born on March 17 , 1950 , and is a licensed drain layer in the State of Connecticut . The following paragraph only is paraphrasing of discussion prior to Mr . Dzen ' s statement . Mr . Dzen could not recall my last name , I told him it is Deptula. I also told him the reason for him being asked to give this statement - that Mr . Natsisky had complained to the Town Manager ' s Office , and made statements regarding the location of the well and the sewer lateral at 122 Newmarker Road . Mr . Dzen asked the name of the Town Manager . I told him. He then asked if he should have an attorney present . I told him that was his choice and we could reschedule this if he wanted to , that I (Robert Deptula) nor anyone from the Engineering Department could not or would not force him to stay and/or give a statement if he did not want to. Mr . Dzen said he realized he was here (at the Town Hall) freely . Mr . Dzen installed the sewer lateral at 122 Newmarker Road . He asked Mr . Natsisky where the well was located . Joe (Natsisky ) asked "why"? Mr . Dzen explained to him the requirements for pressure testing a sewer lateral if it is too close to a well . Mr . Natsisky then told Mr . Dzen that the well that serves 122 Newmarker Road was by the small red building . Mr . Dzen thought the well was Page 2 of 4 far enough away from where the sewer lateral was going (so that a pressure test would not have to be done) . Lester (Braddock) and Lynn (Sadosky) came out ( to 122 Newmarker Road) and Mr . Natsisky told them the well was located by the red building . The sewer lateral was then installed . At this point in time , Mr . Dzen was allowed by myself to look at the statement that Mr . Natsisky gave to myself and Officer Felber. Mr . Dzen then supplied the following information . Lester (Braddock) asked us (Mr . Dzen and his crew) where the well was located . Lester (Braddock) , Mr . Natsisky and Mr . Dzen were all there at the same time. Lester Braddock was told by Mr . Dzen that the well was by the red building . This was based on information given to Mr . Dzen by Mr . Natsisky . Mr . Dzen did not tell Mr . Natsisky to say the well was located by the red shack . Mr . Dzen explained to Mr . Natsisky from the beginning that if the well was located close enough to the sewer lateral , it (the lateral) would have to be air tested . Mr . Dzen explained the regulation to Mr . Natsisky . Mr . Natsisky told Mr . Dzen that the water line ran out the back of the house to the red shack - that the well was out by the red shack . Page 3 of 4 Mr . Dzen did not go out by the shack and tell Mr . Natsisky to say the well was located there . Mr . Dzen did measure the distance from the sewer lateral location to the area by the red shack to determine if that distance was far enough away from the sewer lateral . He did this because Mr . Natsisky told him this area ( by the red building) was where the well was located . Mr . Dzen did not tell Mr . Natsisky to say that -the well was located by the red building and feed numbers 122 and 136 Newmarker Road . Mr . Natsisky told Mr . Dzen that the well that . serves 136 Newmarker Road was on the north side of the house (136 Newmarker Road ) near an out building . The cost of connecting 136 Newmarker Road was to be paid by Mr . Natsisky . Mr . Dzen connected 122 and 136 Newmarker Road to the sewers . Mr . Dzen gave Mike (Jacques) a bill (for 122 Newmarker Road) and Mr . Natsisky a bill (for 136 Newmarker Road ) . The price differed because different types and amounts of work were required at each site. After everything was all hooked up , Mr . Natsisky was satisfied . Mr . Dzen gave Mr . Natsisky a bill for 136 Newmarker Road . Mr . Natsisky thought it was fine , but that Mike (Jacques) was supposed to pay it . Mr . Dzen thought that Mike Jacques was not supposed to Page 4 of 4 pay it. Mr . Dzen went to Mike Jacques to get payment for 136 Newmarker Road . Mr . Jacques told Mr . Dzen the agreement (between Mr . Jacques and Mr . Natsisky) was that Mr . Jacques would pay only for 122 Newmarker Road and that Mr . Natsisky would pay for 136 Newmarker Road . Mr . Natsisky then thought the bill for 136 Newmarker Road was too high. Mr . Dzen said that it was very close to the estimate . Mr . Dzen tried to negotiate with Mr . Natsisky but he refused . Mr . Dzen went to his attorney and a lien was placed on Mr . Natsisky ' s property . At some time after the lien was placed on Mr . Natsisky ' s property , Mr . Dzen and a worker were parked at a Dairy Mart in Vernon . Mr . Natsisky came by in his pick-up truck , and blocked Mr . Dzen in . Mr . Natsisky waived his fist and swore at Mr . Dzen and said he would get him and make trouble for him. Mr . Dzen ' s worker witnessed this incident . I have read this document and certify that it is an accurate representation of my statements to Robert Deptula. (Date) Raymond Dzen 59 Stonehedge Lane Bolton , CT . Gantick, Director of Public Works FROM: Lester A. Braddock, Sr. Engineering Inspectorate RE: Natsisky Property; 122 Newmarker Road Sanitary Sewer Permit #4724 I inspected the Sanitary Sewer lateral construction at the above address as noted on the permit form. I believe Lynn Sadosky was with me at the site also. I asked Ray Dzen for the well location and he pointed to a small build- ing some distance to the rear of the property; perhaps 200 l.f. from the rear of the house. Therefore, I felt a pressure test of the sanitary lateral was not needed. About November 10, 1987 (this date is a guess) Mr. & Mrs. Natsisky came into this office to discuss the installation of their sewer lateral. Mr. Natsisky stated that Mr. Dzen knew the exact location of the well but did not disclose the location to me in order to avoid a pressure test. Mr. Natsisky requested I not pursue this since he has a new drive- way that he doesn't want torn up. Also, he is in litigation with Dzen and doesn't want any digging done on his property at this time. Dzen Constructions ' file has a note in it, but no date. However, the note was put in the file the day Mr. & Mrs. Natsisky were at this office. (Note indicated above is an alert to review Mr. Dzens file for possible problems or future permits. ) LAB/jsv cc: Robert Deptula, Town Sanitarian Street File December 9 , 1987 NOTE: TO FILE On December 2 , 1987 , Earl Darby reported that Mr. & Mrs . Natsisky spoke to him concerning their recently installed sewer lateral at 122 Newmarker Road. Mr. Darby informed them that he was not familiar with the sewer regulations , and he referred them to Lester Braddock . This conversation took place in the Town Hall . Mr. Darby does not recall the date . Submitted by, Robert De tula, R. S. Environmental Health Officer Town of South Windsor December 11, 1987 NOTE: To File II The followingis paraphrasing of comments made to me b Mr. Joseph P P g p Y Natsisky during a telephone conversation of December 4 , 1987. Mr. Natsisky reported that the septic tank which served #122 Newmarker Road was not crushed and filled in when the connection to public sewers was made. He also wanted to measure the distance from the sewer lateral serving #136 Newmarker Road to where he indicated the well which serves #122 Newmarker Road is. I asked him if he would dig up the well at #122 Newmarker Road to determine the exact location. He said that would require a backhoe to do the digging, and he was not willing to have it dug up. He also stated he would sue the "engineer" in the Town because he was not nice to him. (possibly because the "engineer" had no interest in the Lien on Natsisky' s property. ) Submitted by, &4Z Robert De1tula, R.S. Environmental Health Officer Town of South Windsor (All pertinent distances are indicated Diagram #4 (Page 8 of 8) of Mr. Natsisky' s statement. ) December 14, 1987 NOTE: To File Mr. Raymond Dzen currently possesses a valid P-7 (drain layers) license-#208293, from the State of Connecticut which enables him to install sewer laterals. It was also valid at the time the sewer lateral at #122 Newmarker Road was installed. The Town does not have a licensing requirement for this type of function. It does, however, require the drain layer to have a $5000. 00 drain layer bond, and One million dollars liability insurance. Mr. Dzen meets these requirements (copies attached) . The Town also requires the payment of a $400. 00 connection fee and a $15. 00 permit fee. This had been done. (copies attached) Section III, table 2-A of the Technical Standards of the Connecticut Public Health Code Regulations and Technical Standards for Subsurface Sewage Disposal Systems, states that no building sewer lines shall be installed closer than 25 feet to a private well, and if installed from 25 to 75 feet from a well, they be inspected to ensure a code acceptable pipe is used. Part II, section 6i of the Town Drain Layers Manual also refers to use of an acceptable pipe in this situation. Part II, section 10b of the Town of South Windsor Drain Layer's Manual states, in part that"the Town may, when it deems advisable, require a leakage test of the pipe . . . " . It is a common practice of the Engineering Department to require the leakage (pressure) test when a well is closer than 75 feet to a sewer lateral. In this specific instance, the Town inspector was told that the well was located approximately 80 feet from where Mr. Natsisky now states the well is actually located. Natsisky ' s statement was gathered on December 8, 1987 , with the assistance of Mr. Natsisky and Officer Felber . On that same date, Mr. Natsisky stated that the septic tank which served #122 Newmarker Road was not crushed and filled in when the connection to public sewers was made. Section 3 . 5 of the Town of South Windsor Water Pollution Control Authority Rules and Regulations states in part that the septic tank need not be crushed and filled in if it is concrete. It is believed that the septic tank at #122 Newmarker Road is of concrete construction. He was also concerned about the distance from the sewer lateral serving #136 Newmarker Road to where he indicated the well which serves #122 Newmarker Road is . This distance measures approximately 75 - 76 feet. Four Polaroid pictures were also taken on this day. Submitted by: lie 12V Robert D ptula, R. S . Havens Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Re: Town obligation to upgrCdeewmarker Road Dear Mayor Havens: In response to your request for a legal opinion regarding the Town's obliga- tion to upgrade Newmarker Road, I respond as follows: The Connecticut Supreme Court recently ruled on the issue of a town's obli- gation to maintain a road as a public highway in A & H Corporation v. City of Bridgeport, 41 Conn. Law Journal, No. 44, p. 8 (1980). Like our situation, this case involved a road where a portion was paved and used continually, while another portion was unimproved. The Court held that a town will not be obligated to up- grade and maintain a road unless the Acts of the town regarding the road have evidenced an intent to "accept" the road as a public highway. "The municipal action that may constitute acceptance include grading, paving, maintaining and improving, as well as re- moving snow from it; the street's exemption from taxation may also be significant." Meshburg v. Bridgeport City Trust Co. , 41 Conn. Law Journal, No. 42, p. 11 (1980) While the unpaved portion of Newmarker Road is not taxed, this alone will not require acceptance by the Town. Upon speaking with Mr. Shattuck of the Public Works Department, I was informed that the Town has not made efforts to maintain or keep up the unimproved portion of Newmarker Road. It has not been paved, nor is it plowed in the winter. Thus, since the Town has not in the past evidenced its intent to accept the unimproved portion of Newmarker Road as a public highway, there is no obligation to upgrade the road to Town standards. jJohn'J ly your Woodcock, III orney JJW/j lh cc: Mr. Richard J. Rittenband, Esquire Town Attorney 1734 Ellington Road South Windsor, CT 06074 RE: ABANDONMENT OF A PORTION OF NEWMARKER ROAD Dear Dick: The purpose of this letter is to confirm our meeting of October 3rd, during which we set the process of abandoning that portion of Newmarker Road -relative to the Mountainview Estates Subdivision, Sections II and III. Those procedures are: 1. Upon the approval of Sections II and III, the Planning and Zoning Commission make the approval conditional upon the abandonment of the appropriate portion of Newmarker Road by the Town Council. w 2. The Town Council then put this item on their agenda and table it. On the same agenda, the Town Council request a report on the abandonment from the Planning and Zoning Commission as per State Statute 8-24. 3. The Town Council send a copy of the resolution for said abandonment to the Planning and Zoning Commission. The pivitol point being that abandonment be effective with the posting of the bonds for public improvements for Section II and III. 4. The Planning and Zoning Commission make another report to the Town Council including the motion and vote of the Planning and Zoning Commission. 5. The Town Council then takes its appropriate action. Costs will have to be negotiated with the Contractor. The estimated cost for this work is $3,000.00. The proposed drainage will have to cross a gas main on the south side of Dart Hill Road. This will add an estimated additional cost of $500.00. It is recommended that the contract be awarded to Dzen Construction Co, Inc. Mr. Natisky and I came to an agreement that a turn-around was necessary at the location chosen so that emergency and snow re- moval vehicles could have a place to turn this coming Winter. It was not possible to construct this turn-around entirely within the Town 's right-of-way and Mr . Natisky consented to allow con- struction to be done on his land . Because of the permanency of pavement and because the pavement would be on private property, I do not intend to pave this turn-around . Past policy has been not to perform permanent construction on .y. private property without acquiring legal rights-of-way or easements . I feel that this temporary gravel area will serve the purpose intend- ed, and will not place unnecessary encumbrances on Mr. Natisky's property. At such time that this area becomes developed the turn-around can be abandoned and a permanent construction can be made . Aiad Supt . of Street Services MS/ab
