As homeowners abutting the troublesome town property, we will not be held responsible for any damage, claims or liability for the continued sinkage that has occurred in the area of 141-148 Lisa Drive. This sinkage has been ongoing for ten years and has shifted sidewalks, damaged lawns and caused huge sinkholes in the street. The most recent sinkage was spotted on March 10, 1998, by a neighborhood boy who by accident almost fell into the hole. Attached for your records is our previous correspondence from our files. Sincerely, Gerald A. Baseel ► Jean M. Baseel (860) 644-3035 MAR 18 1998 q► w SOUTHWWSM 6 November 11, 1991 Ms. Jean E. Zurbrigen Town Manager Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Dear Ms. Zurbrigen: My wife, Jean Marie Baseel and I, Gerald A. Baseel, are property owners of lot 65, subdivision of Mountainview Estates, located at 141 Lisa Drive, in South Windsor, Connecticut. I am writing this letter to notify you and to state for the record, the continuing occurrence of land sinkage and damage resulting to the sidewalks and street abutting our property. Town records should disclose that we purchased the newly constructed residence and land parcel in October of 1987. Since that time, JMJ Construction Company, builders of our residence and general contractor for the construction of the sidewalks and street, have under the watchful eye of the Town's Engineering Office, made major repairs to both the sidewalks and streets abutting our land, seven (7) times in the last four (4) years. The most recent repairs after notifying the Town Engineer occurred on October 14 and 15, 1991. The necessary repairs were a result of large "sinkholes", some as deep as 4-6 feet. In addition, JMJ has on several occasions, brought in additional "fill" to reoccurring sinkholes appearing in the apron located between the street and the sidewalk. Mr. "Bo" Davies of the Town's Engineering office has informed us that JMJ Construction Company, no longer has maintenance responsibility for repair. Upon inspection of the area by Mr. Davies as recently as November 5, 1991, we are alarmed and concerned that the Town accepted the conveyance of this road and sidewalk in its defective condition from the builder. A final inspection would have disclosed major faults that continue to exist in this isolated area. Mr. Jean Marc Jacques of JMJ Construction Company told us that the problems are a result of "blasting" that was necessary to install the storm and sewer drains. Mr. Davies informed us verbally that after the blasting was done, JMJ should have installed "netting" to prevent soil seepage and movement. According to Mr. Davies, this was never done. It is evident, by further inspection of the property, that it is a matter of time before further sinkage will result in more damage to the sidewalks and street. Even Mr. Jacques admitted that this problem would probably continue to surface. Mr. Davies' informed us that the town has assumed responsibility from the builder and we, as abutting landowners, will be responsible for the future repair or replacement of the sidewalks, according to the Town Ordinances under Article IV, sections 159-18 and 159-19. Without admitting any liability under those ordinances, nor their enforceability in general, we find that their enforcement in this instance would be grossly unfair, unwarranted and _ discriminatory. We will assume no responsibility for repair or liability claims resulting from the continued "sinkage and settling" of this area. As a result of what appears to be construction negligence and a lack of a proper final inspection, the Town. and/or JMJ should eliminate its patchwork approach and properly reconstruct the street and sidewalks with appropriate netting and fill. This should alleviate the dangers that exist to all families and owners of property in this area of Lisa Drive. In the meantime, we want some assurance and acknowledgement from the Town, that the repairs that have been made to date, are appropriate and acceptable to the Town and have completely eliminated the underlying cause of the continued sinkage and settling to the sidewalk and apron.. From Mr. Davies statements, concerning the failure to require the appropriate netting to be installed after the blasting in this area, this problem could have and should have been avoided or eliminated by the Town before it accepted the sidewalk. My wife and I cannot and will not be liable for the results of that failure. Please acknowledge in writing that the Town accepts all responsibility and liability for any and all repairs, and/or replacement necessitated by the sinkage and settling of this sidewalk today and in the future, as well as the liability for any and all damages or inquiries resulting from such defects. Basee l 747 Lisa Drive South Windsor, CT 06074 Dear Mr. & Mrs. Baseel: We received your letter concerning the sidewalk problem in front of your house at 747 Lisa Drive. It is understandable that you are concerned about the reoccurrence of the "sinking" problem, and the repair of it becoming your responsibility. Presently, JMJ Cons truct ion Co. is responsible for making any repa i r/correct ions necessary through October 31, 7992. In response to your letter, on November 21, 1991, Mr. Davies inspected the area in front of your house and noticed further settlement. JMJ Construction was contacted; and, on December 2, 7997, an exploratory excavation was undertaken with representatives of the Town of South Windsor Engineering Department present. The results were inconclusive in determining the cause of the settlement. With the proper backfilling and compaction of this area, it is anticipated that this settlement problem has been reso 7 ved. However, we w i 7 7 be monitoring the situation at 747 Lisa Drive; and, if necessary, wi 7 7 have JMJ Construction make any needed repairs. Iazzetta, Town Engineer e September 11, 1992 Mr. Jerry Iazzetta Town Engineer Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Dear Jerry, I am the abutting landowner to the property located at 141 Lisa Drive, lot 65 subdivision of JMJ's Mountainview Estates. As you are aware, over the past 4 1/2 years, the property in this area has experienced major patches of repair, resulting from continued land sinkage. Since May of this year, I have been confronted with barracades, cones and dirt piles surrounding new faulty areas still yet to be repaired. The latest location blocks 1/2 of my driveway. In correspondence between the Town and JMJ, the Town has requested JMJ to derive an acceptable plan to alleviate the causes of the sinkage. My understanding is that this report/plan was due on August 30th. I did not buy a new home to be confronted with patchwork to my driveway, entrance and yard. For the record, I will accept nothing less than a complete restoring/repaving of my driveway and entrance to its original condition at the time of occupancy with the submitted plans to alleviate the sinkage condition. Jerry, I appreciate your consideration to this unfortunate situation. I am confident that the town will work with JMJ to ensure proper reconstruction of this area. Sincerely71 Gerald A. Inspection of the area as recently as March 285 1992 indicates fUT-thee settling with several =-I nk holes in the apron. Over the past four years, temporary repairs have been made by putting in fill of clay, gravel and stone without proper excavation. This has resulted in an unsafe, unattractive apron littered with patches of repair. A temporary warning barier now stands by a section of sidewalk:: that has sunk and will have to be replaced. This will result in more patchwork to an area already unsightly. At this point, without the complete reeucavation of the "entire" apron, properly tampered, filled with soil and sodded, this property remains a hazard and a liability. We expect JMJ Construction Company to reexcavate the entire apron to its original appearance and condition, including replacing the sections of sidewalk that have not yet been replaced. As abutting landowners, we will assume no responsibility for repair or liability claims that have resulted from this area. Furthermore, if necessary, we will pursue legal action for any damages, injury or harm that results from the property being left in its current condition. Very Truly Yours, Gerald A. Haseel Jean M. Marcia Banach Town Planner Town of South Windsor South Windsor, CT. 06074 Dear Marcia, After six months of barecades, construction vehicles and limited access to our property, the town and JMJ Construction Company have completed the "temporary" repair work located at 141 Lisa Drive. As evidenced by the Town Engineering Office, major voids and improperly sealed sewer lines were uncovered in the small section of repair area. Water was flushed into the dug areas at one time for four hours with no clue as to where it was going. Further street sinkage around Jessica and Lisa Drives may only be the beginning of major repair work that will have to be done. Again, as abutting landowners, we clearly state for the record that we will not be held liable or responsible for any further sinkage resulting from the original construction negligence. On the positive side, Bo Davies of the Town Engineer' s Office was instrumental in overseeing the repair effort. He kept us the homeowners, fully informed and showed a real caring concern which helped ease the inconvenience. For his support and knowledge we are deeply grateful. If, in the course of the pencil vibrator compaction, adjacent areas start showing areas of settlement, those areas shall be opened up and compacted until stabilized. The procedure to be followed is as indicated in Dr. Clarence Welti's letter of November 5, 1993 . These are as follows: 1 . Excavate to 3 feet below existing grade to expose sandy fills . Do not excavate more than 1,000 s . f. or the amount that can be stabilized in one day. The first day the area should be limited to 500 s. f. 2 . Provide sufficient water (from hydrant) to maintain light flooding. Penetrate with concrete pencil vibrator to 7 to 8 feet below grade. Move up and down for about 10 seconds . Pull up vibrator. Repenetrate until resistance to further penetration occurs . 3 . Vibratory penetration to be accomplished at 18" centers over the entire exposed area. 4 . The borings were located by representatives of the town and are believed to generally cover the areas of concern, as regards the erratic settlements occurring under and in proximity to the sanitary. sewer under Lisa Drive. The borings vary somewhat, . but there are zones of very loose Fine Sand and Silt, notably at Holes 3 and 4 . Such looseness is probably not the result of lack of compaction, but rather the possible migration of some fine soils into the rock fractures . The area of such migration is difficult to clearly define, but sample blow counts in the range of 2 to 4 per 6" are clearly not possible within 3 feet of grade without some loss of material below that level . Low blow counts at depths below 6 feet are possibly attributable to lack of compaction. The process of soil migration usually occurs as a result of ground water movement. Heavy rainfall infiltration on the grassed areas contiguous to the trench would cause such migration. Normally the backfill within a rock cut should be either a coarse gravel or crushed stone ( 1/2" to 3/411 ) , which would preclude migration. Considering the existing condition, the .probable remedy would be localized use of water, combined with concrete pencil vibrators . This process would provide a localized force to accelerate the movement of fines into the voids without causing excessive effects on the roadway outside the trench area. This process would only be carried out after an initial excavation of about 3 feet to minimize effects on other utilities . y _ Page 2 As regards the possibilties of more extensive areas of similar conditions, the condition would be generally limited to areas, where the rock was blasted. Furthermore, if the soils are medium compact to at least 6 feet after 5 years of being in place, it is not probable that future settlement will occur. This is not to exclude settlements in areas outside the area studied, but rather to define the probability of such occurrences . If you have any questions please call me. Mr. Jean Marc Jacques JMJ Construction Co. 658 Ellington Road South W' , Re Lisa Drive - Vicinity of Lot 141 Dear Mr. ues : Regarding the above, here re results of borings made at the above site. The borings were located by representatives of the town and are believed to generally cover the areas of concern, as regards the erratic settlements occurring under and in proximity to the sanitary sewer under Lisa Drive. The borings vary somewhat, but there are zones of very loose Fine Sand and Silt, notably at Holes 3 and 4 . Considering the existing condition, the probable remedy would be localized use of water, combined with concrete pencil vibrators . This process would provide a localized force to accelerate the movement of fines into the voids without causing excessive effects on the roadway outside the trench area. This process would only be carried out after an initial excavation of about 3 feet to minimize effects on other utilities . page Z As regards the possibilties of more extensive areas of similar conditions, the condition would be generally limited to areas, where the rock was blasted. Furthermore, if the soils are medium compact ,,to at least 6 feet after 5 years of being in place, it is not probable that future settlement will occur. This is not to exclude settlements in areas outside the area studied, but rather to define the probability of such occurrences . If you have any questions please call me. Construction 658 Ellington Road South Windsor, CT 06074 Re: Ground-Penetrating Radar Survey Lisa Drive / South Windsor, CT Dear Mr. Jacques: A ground-penetrating radar (GPR) survey was performed by Fuss & O'Neill, Inc. (F&O) at the above-referenced site to attempt to detect any further voids that may be developing beneath the existing asphalt. The depth of interest was between the surface of the roadway to 4 feet. The GPR survey was conducted on June 22; 1993 using the Geophysical Survey Systems, Inc. (GSSI) Subsurface Interface Radar System (SIR-3 consisting of a Model PR-8304 Profiling Recorder utilizing a Model 3102-500 mHz transceiver. The 500 mHz transceiver was used as it has an ideal depth capability window of six inches to ten feet. The ground penetrating radar (GPR) instrument emits electromagnetic (EM) waves in the 80 mHz to 1000 mHz frequency range. These waves are emitted in high- repetition pulses generated at a transmitting antenna. This pulse of electromagnetic energy, upon entering the subsurface, travels until it encounters a change in the electrical properties of the subsurface, i.e., dielectric properties. A dielectric change will produce the following results: 1) some of the energy is reflected back to the antenna; and 2) some of the energy continues downward to be further reflected at additional interfaces. A change in electrical properties is a function of many conditions, the two most important of which are moisture content and soil composition or type. The reflected waves are received by an antenna on the ground surface. The signal received is converted to an audio frequency range signal and is sent to a graphic recorder. The graphic recorder produces a continuous, permanent gray-scale record on electro-sensitive paper. 93251 V\1\PA G0702A.WP Corres. recycled paper Fuss&O'Neill Inc. Consulting Engineers Mr. Michael Jacques July 9, 1992 Page 2 The field results constitute a representative sampling of data which may include multiple reflections. Such multiple reflections indicate many changes in dielectric properties. A lack of reflections indicate no changes in dielectric properties. The intensity of the record- is indicative of the strength of the reflection. Using representative two-way travel times for various earth materials, approximate depths to observed features can be calculated. Travel velocities for the GPR signal vary in different materials. Consequently, the accuracy of the depth determination can be affected if varied materials are encountered as is the case at this location. The area of study was the roadway and the grassy area to the north and west of the road. The study area (see attached field sketch) began 39.5 feet east of the lightpole and catch basin located at the approximate west property line of Lot 105 on Lisa Drive. The study area was in an easterly direction from this location around the corner to the approximate south property line of Lot 155 on Lisa Drive. The total length of this area on the roadway was 425 feet. Horizontal scaling was accomplished using known points measured by a calibrated wheel and marked on the roadway every 25 feet along the subject area. Each time the antenna passes a point, a 'mark' is electronically placed on the paper record (vertical dashed line). The location of any features of interest can be determined by calculating the distance from the feature to the nearest 'mark'. The effectiveness of GPR depends on the physical characteristic's of the materials to be penetrated. In general, GPR is most effective in materials with low conductivity (high resistivity) such as sand and concrete. The GPR signal is attenuated by highly conductive materials such as clay and metals. The effective depth was determined to be approximately 4 to 5 feet on this survey. This was based on running a transect over a drain pipe of a known depth near a catch basin. From this the approximate travel-time and subsequently the depths can be determined. The GPR transect printouts for this survey were produced as analog records. There has been no further processing, enhancing, or manipulation of the GPR data. The original GPR transect records are available for review at Fuss & O'Neill. 9325M11PAG0702AMP Corns. recycled paper 'RQ Fuss&z O'Neill Inc. Consulting Engineers J :V Mr. Michael Jacques July 9, 1992 Page 3 There were 12 transects run parallel to each other 2 feet apart along the roadway in the subject area. An additional transect was run parallel to the roadway transects 4 feet from the curb. A field sketch was produced by F&O (see attached) showing the areas of concern based on the field interpretation of the GPR records. The GPR records represent the conditions that are present on the day the survey took place. The field interpretations provided by F&O are based on the data acquired and are performed with our best professional efforts. F&O cannot accept liability or responsibility for the resulting interpretations should any loss, damage, or expense be incurred from work performed. The areas of concern were marked in paint on the road surface in the study area. The areas of concern are those that are field interpreted to be inconsistent with the data of the surrounding area along a transect. The identified areas of concern appear to indicate a change in the subsurface conditions that may represent voids. Thank you for the opportunity to conduct this work. The contractor was using a payloader and was in the area of the pavement near the mailbox when the failure occurred. I was called and relayed the message to you. Your inspection indicated a hole the size of a "wheel barrow" in ::the shoulder of the pavement in front of the rnai ).bo . The hole necessitated immediate attention. A crew was dispatched to make a temporary repair with bituminous concrete. On April 27, I made a re—evaluation of the area to check: the integrity of the repair. Settlement was evident in the patch, and new failure in the pavement of the shoulder 10 feet to the east , in front of 141. Lisa. A crew was sent to make this second temporary repair. The Street Department at this point is concerned about road base deficiencies since. Could you advise the contractor of this situation. Pavement undermining is susceptible to heavy traffic , (i . e. , mechanical sweepers, school buses, refuse trucks, mail trucks and snow removal equipment) , and all use the shoulder of the road. As you have indicated, this has been a recurring problem which has been repaired each time by JMJ Construction Co. The cause of this sinking is unknown at this time, and any conclusion as to why it happens would be speculation. If Mr. Davies conclusion as to why this happens is correct, his suggestion may work , for a short time, however the material would still migrate through the filter fabric but would do so at a slower rate. If this "sinkage" does occur before October 31, 1991, the Town's Engineering Department will have JMJ Construction at this location to repair the problem. We will, with JMJ, do some exploratory investigation to discover the actual cause. A method of repair will then be decided upon and implemented. My findings revealed four sections of sidewlak and a hole the size of a baseball are clear evidence of the reported undermining. This isn 't the first incident we've had to respond to. April 1990 a contracted street sweeper broke through the pavement in the same area. After inspecting the baseball sized hole that has developed in the roadway surface, a cavity of 2 1/2 to 3 feet deep lay beneath the road. The severely fractured subbase displayed evidence that serious pavement failure was eminent. The sections of sidewalk in question are experiencing the same type of fatigue. The two sections of walk to the west of the driveway at 141 Lisa are the most dangerous to pedestrians. The cavity that lay beneath the sections displayed no base present after, the recent rain storms. It is conceivable one more heavy rain storm more than 1 inch could collapse the two sections leaving the walk unpassable and hazardous to area residents. I spoke with the residents from 111 and 141 Lisa during my inspection. Both residents are concerned that the repairs made many times in front of ther properties are still showing signs of failure. Because pavement failure exists our department has temporarily barricaeded the areas in question. ' Please investigate JMJ ,s status in making these repairs. If repairs aren 't made swiftly pavement failure could jeapardize travel of vehicles using the shoulder of the road daily, (i . e. , snow removal ~ equipment , school buses, refuse trucks, etc. ) RA/ds cc: Bo Davies Mel Stead November 11, 1991 41 Ms. Jean E. Mr. Jean Marc Jacques of JMJ Construction Company told us that the problems area result of "blasting" that was necessary to install the storm and sewer drains. Mr. Davies informed us verbally that after the blasting was done; JMJ should have installed "netting" to prevent soil seepage and movement. According to Mr. Davies, this was never done. It is evident, by further inspection of the property, that it is a matter of time before further sinkage will result in more damage to the sidewalks and street. Even Mr. Jacques admitted that this problem would probably continue to surface. Mr. Davies informed' us that the town has assumed responsibility from the builder and we, as abutting landowners, will be responsible for the future repair or replacement of the sidewalks, according to the Town Ordinances under Article IV, sections 159-18 and 159-19. Without admitting any liability under those ordinances, nor their enforceability in general, we find that their enforcement in this instance would be grossly unfair, unwarranted and discriminatory. This should alleviate the dangers that exist to all families and owners of property in this area -of Lisa Drive. In the meantime, we want some assurance and acknowledgement from the Town, that the repairs that have been made to date, are appropriate and acceptable to the Town and have completely eliminated the underlying cause of the continued sinkage and settling to the sidewalk and apron. From Mr. Davies statements, concerning the failure to require the appropriate netting to be installed after the blasting in this area, this problem could have and should have been avoided or eliminated by the Town before it accepted the sidewalk. My wife and I cannot and will not be liable for the results of that failure. Please acknowledge in writing that the Town accepts all responsibility and liability for any and all repairs, and/or replacement necessitated by the. sinkage and settling of this sidewalk today and in the future, as well as the liability for any and all damages or inquiries resulting from such defects. Baseel - 141 Lisa Dri e I have reviewed Mr. & Mrs . Baseel's November ll, . 1991 letter to Ms . Jean Zurbrigen concerning the sidewalk situation in front of their house at 141 Lisa Drive. As indicated in this letter, there has been a problem of "seepage" for a few years . Each time this problem occurred we have requested that JMJ Construction Co. repair the broken sidewalk or fill the holes and he has complied. There are some theories as to why this sidewalk area has had so much "seeping" . One is that the fine material used to backfill this area gradually migrate into the large voids in the rock caused by blasting for the road and utilities . Another is that the backfill was never compacted and gradually settles . It would appear, based upon the size of the holes encountered, that the first theory has some merit. I have talked with both Mr. Davies and Mr. Jean Marc Jacques about this situation today (11/19/91) . Mr. Jacques indicated that some of the problem was caused by a broken pipe and that some may be the result of further compaction. He does not remember telling Mr. or Mrs . Baseel that he feels this problem will continue to surface. Mr. Davies indicated that the Baseel's asked him pointed questions as to what could be done. Mr. Davies indicated to them that a solution might be to place a filter fabric over the rock to ,mitigate infiltration of the finer backfill material into the larger voids in the rock. He also indicated that this method was not part of the original specifications for this project and that the contractor was not obligated to utilize this method. The maintenance bond for Lisa Drive has expired and we therefore requested that JMJ Construction take out an excavation permit for the latest repair work on this sidewalk. On October 30, 1991 this permit was issued. Our regulations state that the 'permittee is responsible to maintain any work performed under this permit for a period of one year. Based upon this, JMJ is obligated until October 31, 1992 to make any repairs if this sidewalk does sink or break prior to that date.
