Dennis Public Works/ r / MEMORANDUM + r) Q PUBLIC WORKS DEPARTMENTP POLLUTION CONTROL DIVISION TO The South Windsor Sewer Commission FROM Melvin Edwards, Jr. - Sanitary Inspector DATE 19 May, 1976 SUBJECT POLLUTION COMPLAINT - 180 LAUREL STREET, SOUTH WINDSOR On April 13, in response to a complaint, I investigated a possible pollution nuisance at the subject address. My findings revealed definite evidence of . sewage surfacing in the rear yard. This is in direct violation of Public Health Code Section 19-13 B20b(f) which states, "No sewage shall ,be allowed to discharge or flow into any storm drain, gutter, street, roadway or public place, nor shall such material discharge onto any private property so as to create a nuisance or condition detrimental to health." That same day an Order to Abate, signed by former Town Managpr Sprenkel as Acting Director of Health, was sent by certified mail to the owners of the subject property - Robert E. & Sylvia D. Atwater. A copy of the Order is attached, along with a .copy of the receipt notice. Shortly thereafter Mrs. Atwater was in contact with Acting Town Manager Enes and, as he told me, was willing to comply; however, her husband had deserted her and she had no-'funds other than welfare, etc. At that point the matter was turned over to Peter Santarpia - South Windsor's Social. Services Adviser. This past Thursday - which, by the way, was the suspense date of the Order — Pete advised me that there is no way - on either a state or local level - by which he could obtain sufficient funds to aid Mrs. Atwater. I am, therefore, presenting the situation to you and am requesting your guidance as to our next step. There is a possible solution - one (1) which, as many of you are aware, we have employed in the past. I have spoken with Town's Attorney and have been advised that, under the provisions of Section 7-257 of the General Ststutes of the State of Connecticut, the Commission can, after a public hearing, contract for the connection of subject dwelling at Town expense and then place a lien on the property for the recovery of said expenses, An alternative to contracting the job would be for Town personnel to perform the work. Sewer Ordinance # 11-300, Section 9, defines Town employees as Drain Layers, "when they are engaged in installing...connections and appurtenances thereto under permit from the Town Manager." This, of course, would have to be coordinated through Public Works Director Young; however, depending on current workloads, it could also further delay the abatement of the pollution nuisance at subject property. y The South Windsor Sewer Commission 19 May, 1976 POLLUTION COMPLAINT - 180 LAUREL STREET, SOUTH WINDSOR, continued I thank you in advance for your attention to this matter. Also, as a post- script to this Memo, during my conversation with Attorney Dennis, I learned that our present procedure of issuing Orders for connection has, since its inception, been erroneously handled. According to the aforementioned Section 7-257, the Commission must hold a public hearing prior to the issuance of an Order. There- fore I am today getting a copy of said Section and will soon prepare, for your consideration, a revised procedure. I hope this will meet with your approval. Sprenkel Re: Laurel Lane i have received a request from property-owners on Laurel Lane to plow this access road. As you know, this property previously was owned by one individual, who rented the three dwellings on this property. As an individual property-owner, he plowed this lane as if it were a driveway. Now, the three homes are owned by three separate individuals-- one a physician. These people have requested that, since the lane now serves a small community, the Town take over plowing responsibility. * The lane is short and not difficult to plow,. and will not overburden the plow route in which it is located--and, is no longer truly a private.drive. Therefore, I do not feel it would be improper for the Town to keep this lane plowed. May I have your comments on this matter. Emi W. Lucek EWL:prb MEMORANDUM December, 7, 1973 T Terry V. Lucek EWL:prb Emil_: We cannot plow Laurel Lane under any circumstances. This is private property and not a public highway. Unfortunately; the fact that three or one families live on this private lane cannot be used as the basis of a decision to plow or maintain. Should we agree to do this private road we could set a precedent for other situations such as certain "meadow roads" or existing rights-of-ways throughout the Town. TVS - Y 10 I . Hancock 91- Laurel Street South Windsor, Connecticut ► E Dear Mr. Hancock: r This letter is to confirm to you the Town of South Windsor's ' commitment to insure that the cul-de-sac in front of your home is removed, graded, and seeded. : I realize that many years have passed since the Woodland Park I; development was built and the roads accepted. I do not know ?_ 3 how this condition of acceptance was overlooked. I do know. that s a ' t at since that time, the Town has removed several cul-de-sacs and has been specifically asked not to remove several others, since the residents find them convenient for €; on-street parking and other purposes. If you are officially requesting,at this time, that the cul-de-sac be removed, then I am officially answering you that the Town will remove this I cul-de-sac at its earliest convenience. Our present work load does not permit this work to be done immediately. However, I hope that we will be able to accomplish this project in the late summer. Very truly your , TO F SOUTH NDSOR Em 1 W.
