I discussed this request informally with your predessor, Richard Sartor and corresponded with him about it. I am enclosing copies of three 1988 letters between myself and the South Windsor Planning and Zoning Commission, together with my informal request .of June 5, 1988 that Mr. Sartor take action to complete Kennedy Road. Last year the South Windsor Planning and Zoning Commission denied the application of Paul Tosi, Application #88-42P which provided for the creation of a new lot on Kennedy Road where the freezer warehouse is. The Planning and Zoning Commission denied the subdivision and I enclose a copy of their September 13, 1988 letter to Attorney Dominick Squatrito who represented the applicant. The denial was based -on the fact that the subdivision plan did not indicate that Kennedy Road would be built and that the subdivided lots would not have the necessary road frontage in accordance with the. Town's subdivision regulations. Since that time, other business opportunities have presented themselves to me regarding Kennedy Road but due to the Planning and Zoning Commision's decision, which I am not arguing with, I have not been able to respond to those business opportunities. As I indicated at the outset of this letter, this letter should serve as a formal request that the Town of South Windsor complete Kenn% Road. Please advise. - ! Very tr y urs RCEI IJ 3Z J J. I was unaware of the fact that subdivision approval was necessary prior to Mr. Bayer's application. On March 14, 1988 I met with Town Manager, Richard Sartor and my attorney, John J. The denial is based on the following. 1 . The proposed application does not conform. to the subdivision regulations. Section 2 .5 requires that "where the land to be subdivided does not abut an accepted Town street . . . the subdivider shall provide and construct a street from the subdivision to such a Town or State road to be built in compliance with the requirements and specifications applying to the construction of streets within the subdivision. " The proposed Lot 5 does not abut an accepted, constructed Town street and the application did not contain a proposal to construct such street. Section 2 .5.e requires that "dead-end streets shall terminate in a circle not less than 55 feet in radius [and) shall be paved to an outside radius not less than 42 feet . Kennedy Road currently does not conform to this requirement, and the application did not contain a proposal to construct such a cul-de-sac. The lack of an adequate cul-de-sac forces Town maintenance vehicles to utilize private properties to execute turn-around movements, thus creating an unacceptable maintenance situation. Atty.
