Sartor, Town Manager, to execute the legal release document for said release. Respectfully, aCc' 8 ' C- Denise E. Sabotka Secretary to the Town Council cc: R. Sartor , ' ,. ' MEMORANDUM October 21 , 1987 TO: Michael Gantick , Director of Public Works RE: 87 Juniper Lane Mr. Brill of 87 Juniper Lane and myself , met to inspect the site and check the land records. It appears that the "drainage way" on this lot was requested of T & M Builders, but was not gotten. Therefore, it was requested of the Brills. The drainage way was on the T & M plane, but the lot was sold to the Brills before it was recorded as a restriction. A Declaration of Covenants and Restrictions was executed by the Brills, July 24, 1979 and is recorded in South Windsor Land Records, Volume 264, page 238. A letter to T & M Building Company from the Planning 8" Zoning Commission , dated June 1 , 1978, lists an item number 2, "A deed restriction shall be placed on lot #17 requiring the owner , and not the Town, to maintain the drainage structure on this lot. " Mr. Brills plot plan dated July 10, 1978, shows a 10 ' drainage way and a culvert , but does not establish a definite location. There does not appear to be any benefit to the Town, as no discharge from Town owned land or facilities goes here. There may, however , be some benefit to abutting property owners, although none is evident at the present time. The flow would be from north to south and any flow would originate on the Brills property. Melvin C. Stead, Jr. Superintendent of Street Services MCS/ds Attachments 1 October 9, 1987 Town of South Windsor RECEIVED Sullivan Avenue South. Windsor, Ct. 06074 OCT 13 198T Att: Ms. Marcia Banach SO. WINDSOR PLANNING DEPT. Town Planner Dear Marcia, Pursuant to our conversation re: Drainage Way to property 87 Juniper Lane. Since the 12" pipes were installed below my driveway ten years.ago I have not had a puddle on either side of my driveway that you could get a teaspoon of water from. In fact two years ago when South Windsor had eight days of rain and severe flooding problems, I asked Mr. Bowen Davies to inspect the area for any water, which he did. I do not maintain the pipes, in fact I am not sure I could find them now due to leaves and general growth. I therefore am asking the town of South Windsor to remove the "Drainage Way" from my property since it is completely unneccesary. Sin erely,-442t"4 n /' - Kenneth C. RE: SANITARYSEWER EASEMENT 'r' Dear Mr. Jarsen: Pursuant to our recent conversation concerning the location of a wooden shed (10 ft.x 12 ft.) at 19 Juniper Lane within the Town sanitary/storm sewer easement, it is my understanding that this shed will not be erected on a foundation, but will be built upon a wooden skid. Therefore, such a structure would not constitute a permanent structure, but could be moved in the event the Town was required to enter said easement for maintenance purposes. Under these conditions, the location of the shed within the easement would not be in violation of the easement agreement and therefore would be permitted by the Town. The Town would require that the property owner assume responsibility for moving the shed from the easement area on the occasion that the Town is required to enter the easement. Please sign below your confirmation of the above described circumstances and your acceptance of the following conditions of approval: 1. The shed will remain a non-permanent structure. 2. The shed will be moved by the owner upon the request of the Town and/or if it becomes necessary that the Town move the shed, the property owner shall hold harmless the Town and its agents from any damage resulting thereto. Very truly yours, C. F. Sh , Superintendent Bureau of Pollution Control I do hereby accept the above referenced conditions of approval. Signature dwA a,of A .
