Young, Director of Public Works Town of South Windsor 1540 Sullivan Avenue South Windsor, Connecticut RE : Adam Wisniewski- Imperial Drive Dear Allan: I have reviewed the correspondence you submitted in connection with the problem with Mr. Wisniewski' s sewer lateral installation on Imperial Drive and have discussed the matter with Mr. Wisniewski' s attorney. There appears to be a substantial factual dispute between the parties over whether Mr. Wisniewski failed to properly restore the road surface after installation of the sewer. Mr. Wisniewski - adamantly maintains that the trench was properly repaved and his attorney has indicated that he is willing to spend whatever amount is necessary to establish this fact in court. Although I do not normally respond to threats of law suits , I feel that in this case it would not be in the Town' s best interest to pursue this matter in the courts. As you know, the original installation occurred approximately two years ago and we were somewhat remiss in allowing the matter to continue uncorrected for such a long period of time. If there is a problem with Mr. Wisniewski s work the Town forces should have insisted that he immediately correct same and should not have waited two years to take remedial action. According to my information it would not be an expensive item for the Town forces to restore the trench and would no doubt cost substantially less than protracted litigation. Accordingly, it is my opinion that we not pursue this matter against Mr. Wisniewski but rather have our own forces do the corrective work. This advice should in no way be construed as an indication that if a contractor in the future doesi-nferior work in restoring the road surface we should not use all the means at our disposal Page Two to insure that the contractor performs properly. However, these steps should be taken promptly and not after a lengthy delay such as experienced here. 1 yo s, TH MAS G. The trench shows evidence of being repaired at least twice its entire length. I asked Adam to excavate and repair one more time--at which time I would be present as representative - from the Engineering Department. If done properly, I would recommend acceptance of this patch to be maintained by the Town subsequent to completion. It is my understanding that connection of Mr. Havens' house will entail cutting his driveway in order to reach his septic system-due to the location of his well, and I am sure that: the three (3) of us will'be able to reach an agreeable solution at that time. ;I will keep you advised of further developments on this situation. f s Z hope,-that the above meets with your approval. r Respectfully submitted by, e wards, Jr' Superintendent . Thomas G. Dennis P. O. Box 52 South Windsor, Connecticut Dear Tom: Attached please find copies of correspondence regarding proper restoration of sewer lateral installation on Imperial Drive. The patching was not performed satisfactorily, and the Bureau of Engineering has tried unsuccessfully for two years to get Mr. Wisniewski to correct the situation. The Town of South Windsor must, it seems, call the bond in order to get the work completed satisfactorily. I am requesting . that we proceed with the necessary legal actions to call the bond, and have others perform the work. Please advise. Very truly yours, TOWN OF SOUTH WINDSOR Allan S. Young, Director of Public Works 1540 Sullivan Avenue South Windsor, Ct. 06074 RE: Sanitary Sewer - Imperial Drive Dear Mr. Young: This office has been consulted by Adam Wisniewski with regard to your letter of August 27, 1976. First, Mr. Wisniewski contests the premise of your letter that the road patch was improperly installed. The original work was done over two years ago, and repaired onces at the Town's request, not because of its impropriety, but for reasons of courtesy. It is felt that the problem is not with the patch, but whether or not there should be a resurfacing of the road, which is the responsibility of the Town. I have asked Mr. Wisniewsky to take photographs of similar patches throught the town. In addition, your letter indicates that you wish to proceed to call in the per- formance bond. That is certainly within your prerogative to attempt, and we will welcome an outside opinion. However, in addition to this, your letter appears to threaten the withholding of permits with regard to septic tank services of Mr.; Wisniewski. We feel that this threat in relation to a minor patch issue is improper and without standing. If this continues, we will have no alternative but to bring suit. I would suggest that you contact your Corporation Counsel as to the propriety of such a threat. If there are any questions, please contact this office. Several months ago, .Mr. Braddock met at the site with you to discuss this situation, and I felt at that time you had resolved that this repair work would be done within a week to ten days from that date. However, as of today this work has not been accomplished. Therefore, this letter will serve as a written notice to proceed immediately with the repair of this sanitary sewer trench. If the trench is not repaired by September 10, 1976, the Town will proceed to have the work done by others, and call your Performance Bond to pay for the work. I shall also request that the •Town' s Pollution Control Division withhold any future permits from your firm until the work is done to the Town's , satisfaction.
