RE REQUEST OF MR. HARVEY FINE, 113 GORDON DRIVE
RELATIVE TO A CHANGE IN WATER COMPANY SERVICE
I have researched the question pertaining to the possibility of
changing certain areas of Town from Connecticut Water Company
service to the Metropolitan District Commission System. Contacts
were made with personnel from both the M.D.C. and the Connecticut
. Department of Utility Control (D.P.U.C. ) . The facts presented in
this report were obtained from these two sources .
The attached map indicates the approximate boundaries of present
water systems as set by franchise. The franchise areas belonging
to the Connecticut Water Company were established before the
existence of the D.P.U.C. , and were in all likelihood granted by
the State Legislature. Apparently, some of the franchises were
purchased from the Connecticut Light and Power Company many years
ago. In my discussions with both the M.D.C. and D.P.U.C. , I
received the impression that a change of franchise in favor of
the M.D.C. would be very difficult to accomplish. The D.P.U.C.
guidelines for establishing or revising existing franchise areas
are based on the ability of a utility to provide adequate service
and not on rates charged to customers. As long as the Connecticut
Water Company is able to adequately provide the service for which
they received a franchise, then the D.P.U.C. would not attempt to
alter the franchise against the wishes of the Connecticut Water
Company. Also, the M.D.C. would not attempt to acquire
additional franchise areas unless formally requested to do so by
the Town of South Windsor. If the Town chose to make such a
request, we probably would not have the support of the D.P.U.C. ,
and the Town could be open to legal action initiated by the
Connecticut Water Company.

The possibility that the M.D.C. would not be physically able to
service the Connecticut _Nater. Company _area also .exists . The
present M.D.C_--syst=;may mo .be;=.,de,--;scjned,#o-F_,accommodate all of
South Windsor. A the M.D.C.
and Connecticut Water Company systems would be required to make a
final determination. However, the M.D.C. would not consider such
an investigation due to the time and cost involved, unless the
Town chose to formally pursue this matter.
Summary
Apparently, both the M.D.C. and D.P.U.C. would be reluctant to
pursue the elimination of the Connecticut Water Company franchise.
The changeover, if pursued, would be very costly, if it is even
physically feasible. Also, the Connecticut Water Company could
in all probability seek legal recourse against the Town, if the
Town were successful in accomplishing such a change.
