Re: 29 Good Hill Road Easement
Dear John and Jean,
The open pipe in the drainage easement at 29 Good Hill Road is an inlet to the storm
drainage system that takes surface runoff flowing down the hill in back of the property.
It is standard practice to install a flared end as an inlet to a shallow pipe. The Town
does not install grates over the flared ends of pipes because they may clog with grass,
leaves and other debris and cause flooding of the surrounding land. In addition, grates
are not readily available for flared pipe ends. I am not aware of any instances of
animals or children getting stuck in or injured by such openings.. However, I understand
your concern about this open pipe and your desire to cover it with a grate so animals or
children can not get into the pipe. Although the Town does not have a standard for a
grate to go over the flared end of pipes, I agree to allow you to try to build and install
such a grate provided it meets the following requirements.
1. The grate must be installed and maintained by you, the property owner. This grate
must be kept clear of grass, leaves, weeds and other debris that may clog it.
2. The grate must be bolted in place so it can not easily be removed-by a child-but — -- -can be removed by you or Town staff with basic hand tools.
3. If the Town needs to make repairs or perform maintenance on this pipe, the grate
will be removed with reasonable care not to damage it. However, if the grate is
damaged or can not be reinstalled, the Town is not responsible for replacing it.
4. The grate should be constructed of steel bars (3/8" diameter or larger) or hard
plastic and have 4 inch or less openings between bars.
5. The-grate-should_have_sufcient-support-between-bars-so-itdoes-riot-easily-bend.------ --
6. A steel grate should be painted or galvanized so it does not rust quickly.
7. A detailed sketch of this grate and the method of fastening it to the existing pipe
flared end must be submitted to the Engineering Department of the Town of South
Windsor for review and approval along with an application for a permit prior to
installation.
Please call me at 644-2511 x245 if you have any questions.
Sincerely,
effrey B. Doolittle, P.E.

Dear Mr. Wanza:
Re: #45 Good Hill Road
On Monday, December 16, the Department of Public Works was called
upon to assist in ,a sewer back-up at House #45 Good Hill Road.
- Although this street is not yet accepted by* the Town, due to
the emergency nature of the condition, Town employees did
service the problem, and removed the blockage, thereby relieving
the back-up. .
Good Hill Road was due for Town Council acceptance into the
public street system, at' its meeting of December 16. I have
requested, and .the Town Manager has agreed, that .this acceptance
be withheld until the following Council meeting, in order to
provide you with adequate time to reinspect the sanitary sewers
in this street, and to assure that no further problems exist
and that no damage was done during the process of today's
repairs.
I .would anticipate that the most efficient means of conducting
this inspection would be through the use of a television
inspection system, such as "Penetryne. "
Please contact Mr._ Edwards of our Pollution Control Division
when you are prepared to conduct this further inspection.
Very truly yours,

PUBLIC WORKS DEPARTMENT
POLLUTION CONTROL DIVISION
TO South Windsor Sewer Commission Members
FROM Melvin Edwards, Jr. -- Superintendent of Pollution Control
DATE 17 December, 1974
SUBJECT 4 GOOD BILL ROAD, SOUTH WINDSOR
Inasmuch as a request to look into the possibility of a pollution problem at
the above address was made to me at a Commission Meeting by Lincoln H. Streeter, I
herewith submit our findings to date.
On two (2) separate occasions personnel from the Pollution Control Facility
performed dye testing on the septic disposal facilities No evidence of dye has
been noted.to date.
This past Friday, 13 December, Frank J. Smith used a water service locator in
.a further effort to* locate the cause of this water overflow. His findings reveal
that the water service for this property run in a direct line from the street across
the area of overflow into the house. Based on this information Mr. Robert Hornish of
the Avery Heights Water Association was contacted, and he has advised us that he
would investigate further from his end.
To date, no additional action has been taken on this situation. When any new
developments occur you will be advised.

RE: SEWER LINE BLOCKAGE ON GOOD HILL ROAD
SUNDAY, APRIL 13, 1986
Attached hereto is a report from Facility Mechanic Lyman Cowles
relative to a blockage on Good Hill Road.
The Bureau employees on-call responded quickly and appropriately.
Mr. Miller did not require any special clean-up assistance from
the Town.
The blockage was caused by a large accumulation of feminine
napkins; such a blockage probably resulted from a single shock
load.
This section of sewer line was last cleaned on June 23, 1983.
The slope of this line is sufficiently steep, and' there appear
to be no other unusual line characteristics that would suggest
that we could expect a high incidence of blockages in this area.

RE: CLAIM FOR DAMAGES -- EDWARD MERRITT, 78 GOOD HILL ROAD
The Bureau of Pollution Control cleared a blockage in the main line
on Good Hill Road on Thursday, May 19 , 1983. The blockage resulted
from an accumulation of sticks and grease, and was removed within an -
hour of notification.
A small quantity of wastewater entered the basement of the house at
78 Good Hill Road owned by Mr. & Mrs . Merritt. Upon inspection,
damage appeared to be limited to personal papers and artifacts.
The water was removed by vacuum, and I recommended that the affected
areas be disinfected.
A claim for damages was submitted to the- Director of Public Works
(Exhibit A) and the claim was subsequently forwarded to the claim
adjuster.
The. insufance company investigated the claim and determined that
the Town was- not legally responsible for the damages.
Mr. Merritt was notified as to the insurance company' s decision
not to honor the claim in a letter dated August 29 , 1983 ' (Exhibit B) .
I reviewed this claim with Claims Representative Mr. Duperrault that I might better understand their reasoning process in makin so
g
this decision.
Mr. Duperrault indicated that their decision was based upon their
findings of ,fact that the Town was not negligent 'in either the
maintenance of the sewer line nor in response to the sewage back-up. .
If the Town had been negligent, then the Town would have been
responsible for the accident, and the claim would have been paid.
However, there was no negligence involved, therefore, the Town'was
not responsible for the accident, and the claim for damages could
not be honored. This appears to be the limitation of coverage as
cu-rrently applies in matters of this sort.

I reviewed this matter further with Paul Smith in the " Town Attorney's
Office. Attorney Smith advised that this issue could not be pursued
further with the insurance company. He suggested
does ' not require a legal opinion, but rather isa subjectl formatter
policy
decision-making. If the Town feels that it is unfair that a resident
who connects to the sewer does _so at his own risk, the Town may
purchase insurance coverage sufficient to remove the risk from the
homeowner.
In the present case, Paul cautioned against the Town making payment
for any damage claims previously rejected by the insurance company.
This would createtwo unacceptable situations--it would be a signal
to the insurance carrier that his firm would only have to reject a
claim, and the Town would settle the claim on its own; and it would
set a precedent for handling all future such claims .
I have informed Mr. Merritt, that, on the advise from the Town
Attorney' s Office, the Town cannot pursue the matter further with
its insurance carrier.

RE: CLAIM FOR DAMAGES -- EDWARD MERRITT, 78 GOOD HILL ROAD
I recently reviewed the above referenced claim with Paul Smith of
the Town Attorney' s Office. I informed him as to the insurance
carrier' s decision not to honor the claim based upon their findings .
that the Town was not negligent in either the maintenance of the
sewer line nor in response to the sewage back-up. His advise was
that the matter could not be pursued further with the insurance
company.
Attorney Smith suggested that this issue does not require a legal
opinion, but rather, a policy decision. If the Town feels that it
is unfair that a resident who connects to the sanitary sewer system
does so at his own risk, the Town may purchase insurance coverage
sufficient to remove the burden of the risk from the resident.
Furthermore, in this particular case, the Town should not pay for
any damage claims rejected by the insurance company. This would
create two situations--it would be a signal to the insurance carrier
that "his firm would only have to reject a claim, and the Town would
settle the claim on its own; and it would seta precedent for all
future such claims .
Mr.' Merritt has been informed that the Town, on the advise of the
Town Attorney' s Office, will not pursue this matter further with its
insurance carrier.

Dear Wayne:
Re: Claim for Damages - Edward Merritt, 78 Good Hill Road
Enclosed herein are copies of correspondence concerning property damage
at 78 Good Hill Road resulting from a sewer backup. Included as well is
the owner's complaint concerning the decision of the insurance company
not to honor the claim.
The insurance company apparently based their decision upon the fact that
because the Town periodically cleans the sewer lines, there was no
negligence on their part which would have caused the blockage and
resultant sewage' backup.
Please review this claim for damages and advise me as to whether there
is a sound basis for pursuing the matter further with the insurance
company.
If I can provide you with any further information, please feel free to
contact my office.
Very truly yours,

Dear Mr. Arsenault,
This is in reference to my letter of July 25, 1983 to you, submitting a
claim to the town for damage to my home resulting from a back-up in the
town sewer line on May 19, 1983. I have enclosed a copy of that letter.
We have just received the enclosed(copy) letter from CIGNA, who have re-
fused to honor this claim.
Please be advised that we feel this claim must be honored. I would suggest
that the town attorney pursue this matter further with your insurance
company to rectify the situation. The CIGNA letter states ''---It is our
opinion that the responsibility for your accident noes not rest on our
account." Certainly the town is responsible for keeping sewer lines clean
and preventing such accidents to occur.
I trust we will have prompt resolution to this situation.
Sincerely,
Edward H. Merritt

RE: SEWER LINE BLOCKAGE ON GOOD HILL ROAD
The Bureau of Pollution Control cleared a blockage in the line on
Good Hill Road on Thursday, May 19 , 1983. The blockage resulted from
an accumulation of sticks and grease, and was removed within an hour
of notification.
A small quantity of wastewater entered the basement of the house at
78 Good Hill Road owned by Mr. and Mrs. Edward Merritt. Upon
inspection, damage appeared to be limited to personal papers and
artifacts. There was no damage to home furnishings.
The water was removed by vacuum, and I recommended that the affected
areas be disinfected.
I advised Mrs. Merritt to forward any claim for damages to my
attention.
