Re: Ferry Lane Culvert Replacement
Dear Mrs . Burnham:
We have tried several times to reach you by telephone to discuss
a project that the Town of South Windsor is proposing to
undertake. The Town is proposing to replace the existing pipes
under Ferry Road, located approximately 1, 000 feet from Main
Street. These pipes have deteriorated and need to be replaced
before a problem occurs .
In order to proceed with this work, the Town will need to obtain
an easement from you, the land owner. We have enclosed two ( 2)
copies of our standard easement forms for you to execute. Please
execute both copies of the easement and return them to me for
final execution. I will forward one copy to you once the
easement has been fully executed. The plan attached to the
easement document as Exhibit A shows the extent of the proposed
work.
If you wish, we can meet with you to discuss the proposed work in
detail. We anticipate that the construction will take place this
summer and the duration of activities should take less than one
(1) week.
If you have any questions, would like additional information, or
wish to make an appointment to discuss this project, please call
me at 644-2511, Ext. 245 .

RE: EPRI Pole Study
Atlantic Project No.: 1309-02-100
Dear Mr. Gantick:
Northeast Utilities has given us permission and provided assistance in conducting a study
for the Electric Power Research Institute (EPRI) in Palo Alto, California. The research being
conducted deals primarily with utility poles. Part of the study includes retrieval of soil samples from
around utility poles.
We have identified a pole on Ferry Road in South Windsor for potential use in this study.
It is approximately 900 feet west of the intersection of Main Street and Ferry Road. It is CL&P
pole #25982. Retrieval of samples will take place with a small hand auger and come from depths
no greater than ten feet. This will be the third pole in a nationwide study of over 200 poles. The
study is expected to take more than two years to complete.
I have already placed a request with the Connecticut "Call-Before-You-Dig" service for
inspection of possible underground utilities. I expect clearance by the morning of Friday,
January 10, 1992.
My contact at Northeast Utilities is Rick White. He is an engineer with Construction, Test
and Maintenance. His number is 665-6616. I am awaiting a bit of information from him regarding
the pole.
Assuming clearance from "Call-Before-You-Dig" and appropriate information from
Mr. White,we will begin our work on the morning of January 13, 1992. I expect that we will finish
the following morning.
Please call me if you have any questions or concerns.
Sincerely,

)EPARTNIENT OF
Mr. Terry V. Sprenkel
Town Manager
Town Hall
So. Windsor, Conn.
Dear Terry:
This is in reply to your letter of .May 31, 1968 in reference to public
road6 and private rights of way running west from Main Street to the
Connecticut River.
I spent a full day on the land records in East Windsor (including those in
the State Library) and have also done some research in the South Windsor
land records.
In addition, I have talked with lawyers in the State Highway Department,
and with various citizens of thextown who have done research on this problem,
including Mrs. Hildreth Raymond, Mr. Joseph Vibert, Mrs. B.O. Pelton, and
.Ir. Harry Odlum.
Without attempting to relate in detail all of the source material on which
I am relying, I will say that I am satisfied that the following are town
roads from Main Street to the River:
1. The road at E. Windsor Hill, now known as Sperry Road.
2. The road at Station 31, now known as Vibert Road.
3. The road just North of Mr. Carney's house, commonly referred to as
Strong Road.
Map #33 in Drawer 3 of South Windsor Land Records shows that in 1803, Sperry
and Strong existed as town roads.
All three roads are shown as town roads on maps contained in an Atlas pub—
lished in 1869, which is on file in the Windsor Town Clerk's office,' entitled
"Atlas of Hartford City and County, prepared by actual survey by Baker and
Tilden."
Mr. Terry V. Sprenkel 2. June 11, 1968
The above three roads are also shown in a second Atlas (Circa 1900-1910)
on file in the Windsor Town Clerk's office, entitled "Atlas of Hartford
County and parts of New Haven, Middlesex and Litchfield Counties."
In the maze of old land records of the Town of Windsor, I was unable to
locate the survey and grant of Sperry Road, but as this has been an improved
town road for many years and for at least two centuries has been essential
as a connector between Main Street and the ferry from Windsor, I think it
safe to assume it is a public town road.
The original surveys and grants of Strong Road and Vibert Road are filed in
the Windsor land records at the State Library, Volume 7, pages 139 and 140
and in the East Windsor land records at Volume 12, page 244.
The only other road west of Main Street which may, in whole or in part, be
a *town road is- the one at Station 31, known as King Street. The 1.869 Atlas
referred to above shows this as a short road running west from Main Street
as far as a house on said King Street located only a short distance from
Main Street. Presumably the house on the old map is the one that was in
recent years located just west of Mr. Odlum's house and which, I understand,
has burned in recent years. On the other hand, the other Atlas (the one of
1900-1910) .referred to above shows this road as running from Main Street all
the way to the river.
The fact that King Street is shown on these old Atlases does not establish,
as a matter of law, that it is or ever :aas a town road. But it does, perhaps,
give the adjacent property owners some "basis in history for claiming that
the town should not now raise technical objections to recognizing the road
as a town road, and that if there are any flaws in its legal status as a
town road, these flaws should now be corrected by action of the Town Council.
From the forgoing observations, I offer the following recommendations:
1. The Town Council should start from the premise that there are at present
only three- legally established town roads west of Main Street, and that
each of the three roads runs from Main Street to the river. These roads
are Sperry Road, Strong Road and Vibert Road.
2. The town should take the necessary action to lay out and acquire King
Street as a public town road from Main Street to the river pursuant
to Section 13a-61 of the General Statutes. Some will probably argue
that this is now a town road, but unless they can produce deeds to the
town or a vote at a town meeting accepting the road, I believe the
Council should proceed on the basis that this is not now a town road
but should be one.
Mr. Terry V. Sprenkel 3. June 11, 1968
3. Newberry Road, and possibly other similar paths west of Main Street,
could, if desired, be established as town roads from Main Street, some
specified distance west toward the river, all in accordance with the
above section 13a-61.
4. After having established which, if any, roads other than Sperry, Strong
and Vibert are to be town roads hereafter, and after having taken the
necessary steps to- lay out and establish the same as town roads, a map
should be prepared of all roads west of Main Street, and the Town Council
should then, by ordinance, declare that the same constitute all of the
town roads west of Main Street.
5. Finally, by ordinance, the town should regulate the use of these town
roads, establish means of notifying the public of such regulations and
provide punishment for violations. It may, for example, be decided
that some or all of these roads should be closed, except to abutting
property owners one hour after sunset each day.
Possibly the Town Council will want to appoint a committee of Main Street
residents to study and report back to the Council on this problem. The
committee might, for example, be asked to make recommendations as to whether
or not Strong Road should be retained, in whole or in part, as a town road;
whether or not King Street should be established, in whole or in part, as a
town road; whether or not Newberry Rogd or other similar ways should be
establishedin whole or in part, as town roads. In addition, the committee
might be asked to make recommendations as to control and use of each of the
town roads.
In any case, I would think that steps to control the dust problem on Strong
Road near Main Street should be taken without dalay.
Yours truly,
L
