February 13 , 1996 .
Our anxiety continues to mount as we once again approach the wet

Dear Mr. Girardin:
Recently you contacted this office regarding a drain which runs
from your house to a drain in the street installed by the Town a
year or two (2) ago.
The drain from your property was installed several years ago, prior
to the Town's installing a perforated drain in the street. .
When this work was done in the street, connections were made for
each house, and these connections went back ten ( 10) feet from the
curb line.
The Town believes your stoppage or pipe failure is more than ten
( 10) feet back from the curb line and repair is your responsibility
and not the Town's .
Cordially,
Dana Whitman, Jr.

Dear Mr. Mayor,
Subject: Farnham Estate Drainage Improvement - Phase Ix
Congratulation! I hope your "tour" is successful . Hart my
reason for writing to you.
The following is what I Wrote to Mayor Ryan:
"I recently discussed my letter of April 5, 1995, to you,
concerning the above with your fellow Republican Roy Normen.
x asked him to remind you that you had not replied to my letter.
I neglected to mention in my letter that was hospitalized while
work was being done to my connection. fly information from my
wife, neighbors, and contractor indicate that the pipe from my
house to the drainage connection was clogged, yet a check valve
was placed on a blocked pipe! Your Field Engineer stated at the
time that the pipe had dripping water and that the work crew was
to fill-in the hole after the check valve west place.
Why would anyone do such a thing? Was it because I was not
available to comment? Was it because I was not available to have
the clogged pipe isnblocked? or was it simply a desire to get the
job done?
I have attempted to clear the pipe without success . A job I 'm
told whould have been very simple if the and of the pipe is
exposed. The error was buried by the work craw along with a new
check valve which is totally useless !
The contractor gave me a drawing indicating exactly where the
chock valve is 'located. He dial this knowing the job had been
'BOTCHED' . .
My request is for the Town Engineer to do the right thing
and correct the error.

Mr. and Mrs . Norman Yvon
44 Farnham Road
South Windsor, CT 06074
Dear Mr. and Mrs . Yvon:
Pursuant to my recent meeting with Mrs . Yvon in the Town Hall, I
have reviewed the file concerning your claim that in 1978, the
Town's sewer contractor damaged your basement storm drainage pipe
while installing the sewers on Farnham Road.
I regret to inform you that I have no basis upon which to proceed
further in this matter. There is no demonstrable evidence that
the sewer contractor was responsible for the problems you have
described.
The sewers were constructed in 1978, and the first notification
of a claim was received by the Town four years afterwards in
1982 . The opinion of a Roto-Rooter employee concerning a pipe
blockage "which. he cannot see is not the evidence that I need to
proceed farther and dig up the road.
The Town's policy regarding such storm drainage structures is
that the property owner is responsible for the maintenance and
repair of the entire length of pipe extending from the house out
to the Town's storm drainage system.
It is my understanding that the drain pipe was of the type
called--orangeburg; such a pipe is no longer used because of the
brittleness and poor quality of the material . It is not
difficult to suppose that such a pipe installed in 1958 when the
house was built is now in need of replacement.
In any event, I am left with no other option than to repeat my
advice to you detailed in my letter of December 19 , 1988: any
repair of the foundation drain is the property owner' s
responsibility, and I encourage you to -secure the services of a
qualified plumber.

Mr . Norman Yvon
44 Farnham Road
South Windsor, CT 06074
Dear Mr . Yvon:
As follow-up to our meeting and discussion on November 17, 1988 -
regarding the basement drainage at 44 Farnham Road, I would like
to repeat hereinafter the advise I gave to you in 1983 .
In order to resolve your concerns about adequate foundation
drainage, and proper sump pump operation, I encourage you to
secure the services of a qualified plumber . It was not possible
to obtain, in 1983 , sufficient proof that the sewer contractor
caused any damage to your foundation drain. Therefore, in
accordance with Town policy, this repair of the foundation drain
continues to be your obligation and responsibility.
Very truly yours,
