HomeMy WebLinkAboutCollins Lane MEMORANDUM TO: Michael J. Gantick, Director of Public Works FROM: Joseph J. Perna, Project Engineer P DATE: January 6, 1998 RE: COLLINS LANE Per your request, I have investigated the issue of whether Collins Lane is a private Road or not.. Based on my review of our street file, and conversations with Mel Stead and Bo Davies, there is unfortunately, no clear answer to that question and would require, perhaps in the future, a legal opinion from the Town Attorney. As described by Mel Stead, the Town at this time does maintain Collins Lane, i.e., plowing and sanding up to the gravel drive that runs out to Sullivan Avenue (see attached map). I have included our street file for your review and would refer to Mel Stead's report dated June 17, 1986 as a good source to summarize the history of this roadway. With regards to the more pressing issue of whether a school bus can enter this roadway comes down to a safety issue. Vehicle movements would require the use of the private gravel drive that connects to Sullivan Avenue in a "Looping Pattern" with an entrance point starting at either Sand Hill Road or Sullivan Avenue. I would refer to a memorandum by Bo Davies dated November 29, 1995 to suggest that this would not be a desirable situation both from the State and Town's point of view. The other alternative would require the bus to perform a 3-point turn to exit back out onto Sand Hill Road, which is also undesirable. I hope this information will be helpful in your decision making process. JJP/jsv Attachments PRELIMINARY REPORT STATUS OF COLLINS LANE JUNE 27, 1986 This report was conducted for informational purposes, and is not intended to conflict with legal actions or precedences. Maps and other information in the Town Clerk's Office indicate that Collins Lane (so-called) and Sullivan Avenue existed as traveled ways long before any of the maps were prepared. Deed descriptions of properties to and from the Collins' family and others refer to Collins Lane (so-called) , Sand Hill Road and Sullivan Avenue only as "highways" , and not by name. Existing documents concerning this matter found to date. 1. Map showing a parcel to be acquired from Collins and land to be abandoned dated April 1, 1964 (T.C. 513B) . ✓ 2. Memo to Paul Talbot, Town Manager, dated February 6, 1978 from Allan Young, Director of Public Works. "Provide Access to the Porter Collins Driveway" . ✓ 3. Memo from Greg Turek to Allan Young dated February 3, 1978 indicating his research to determine if the Town should plow Collins Lane (so-called) . ./ 4. Memo to Planning and Zoning Commission and Allan Young, Director of Public Works, requesting report based on a request from Porter Collins. ✓ 5. Minutes of Town Council where resolutions were proposed with amendments and passed September 27 , 1965. V 6. Minutes of Town Planning and Zoning Commission approving street layout for Sand Hill Road at Sullivan Avenue, October 12, 1965 . Map not filed until 1976 (T.C. Map 713B) The agreement that was passed as a resolution by the Town Council September 27, 1965 appears to be the best evidence as to what was intended by the abandonment. Page 872 of the Council Minutes contains . a concern by Councilman Cavanaugh that the agreement was not specific as to what was being given to Mr. Collins. Another motion to amend the first was passed and carried. "That the Resolution be further amended to add that our move is also subject to the condition that the Town's Attorney, prepare in form satisfactory to him, a description for inclusion on the Town's Record of the portion of the road to be abandoned. " Preliminary Report Status of Collins Lane June 27, 1986 Page 2 Councilman Ahearn said we could have the Town Engineer draw up a map of the road that is to be abandoned, and have it and a des- cription incorporated in- the Agreement. It appears that the map approved by the Town Planning and Zoning Commission on October .12, 1965 is that map. Conclusions 1. The Town Council intended to abandon that section of street referred to now as Collins Lane. 2. That the Town Council intended also to convey the abandoned portion of roadway to Mr. Collins. 3. That the Town fulfilled its obligation to provide access to the Porter Collins ' driveway by providing an extension of his driveway to Sullivan Avenue. This conclusion is contrary to Mr. Young's opinion of how access is to be provided. Conclusion 1. There is still some gray area here and the existence of additional material pertaining to this is possible. 2. The intent by both the resolutions and the maps on file was to abandon all of the Town's right to the old pavement. 3. The portion of Collins Lane (so-called) from the realigned Sand Hill Road northerly to beyond David Collins' driveway has remained in its original condition. It was not scarified nor was it narrowed as it was from his driveway northerly to Porter's. 4. Porter Collins, in effect, then has access to Sullivan Avenue direct and Sand Hill direct. 5. The Town has, in the past; and does now, plow . that portion of this street that provides access to David Collins ' driveway, #2 Collins Lane. 6. The Town Attorney should be consulted as to clarification of the gray areas. I feel that problems in the future could arise if David Collins should sell and the new owner to claim the "abandoned road. " This would deny access to Sand Hill Road by Porter Collins at #8 Collins Lane (so-called) . I believe that the Town of South Windsor did not intend to maintain this roadway. It existed with rights of use by the Town and the Council abandoned those rights. We may, however, have an obligation to perform the normal services such as snow removal. The Town has been plowing, sanding and sweeping the first 250± feet of Collins Lane (so-called) . Street Services will continue to do this as a matter of course unless directed to do otherwise. Melvin C. Stead, Jr Acting Director of Public Works MEMORANDUM TO: Michael J. Gantick, Director.of Public Works FROM: A. Bowen Davies, Deputy Town Engineer 'i37 DATE: November 29, 1995 RE: COLLINS LANE This morning I talked to Stanley Sobieski, ConnDOT Transportation Planner, about the Collins Lane driveway to Sullivan Avenue (see attached sketch). He is quite concerned about the liability associated with the usage of the wide driveway that was put in this summer from the apparent end of Collins Lane and Sullivan Avenue. There is no delineation between where the Town's responsibility leaves off and- the Collins' responsibility begins. For an operator, it all looks like a Town street. An accident at the intersection could include the Town as a defendant. Mr. Sobieski suggests that there be a definite termination of the Town's responsibility for Collins Lane to not include the driveway and access to Sullivan Avenue. It should not be considered as a thru street in any manner. This termination an be accomplished by permanent barricading, a gate, or appropriate signing. ConnDOT has a possible problem with the permit. They will handle their issue. It is perhaps time to include the Collinses in this concern. Brown 71 Robert Drive South Windsor, CT 06074 Dear Mr. Brown: In regards to our conversation several days ago, I am enclosing a letter which states that Collins Lane is a town street according to an agreement. Therefore , anything you can do regarding the up- ' keep and maintainance of the road will be appreciated. Sincerely, Dorothy S. Collins .11 Wf': f knt b 5 T70 wn, ak ou/A %zd*-io 1540 SULLIVAN AVENUE • SOUTH WINDSOR, CONN. 06074 R-CO' AREA CODE 203/644-2511 March 20, 1978 Mr.. Porter A. Collins 8 Collins Lane South Windsor, Connecticut 06074 Dear Mr. Collins: Thank you for writing to the town regarding snow removal and upkeep of Collins Lane, which runs in front of your property. Allan Young, Director of Public Works, has advised that Collins Lane is a town street according to earlier agreements, and will be maintained accordingly. He noted that snow removal operations have included Collins -Lane during the recent snowstorms of this winter. Thank you, again, for taking the time to write. I hope this solution is satisfactory. Very truly yours, PLANNING AND ZONING COMMISSION . B y Norman Petersen, Commissioner NP/src cc: William E. Grace, Chairman Planning and Zoning Commission Paul F. Talbot, Town Manager Allan S. Young, Director of Public Works MEMORANDUM February 6, 1978 To: Paul F. Talbot Town Manager Re: Collins Lane Attached is a report prepared by Greg Turek, Administrative Aide. In my opinion, Item l.c. of the Agreement obligates the Town to "provide access to the Porter Collins driveway. " Technically, we must plow the drive which is still property of South Windsor--which was known as Nevers Road. Effective immediately, we will begin plowing the "road. " I feel you should refer this to the Town Attorney, to effect the transfer of property to Collins, as Mr. Turek recommends. Allan S . Young Director of Public Works ASY:prb Attmt. MEMORANDUM February 3, 1978 To: Allan S. Young ° Res Collins Lane Report Concerning Mr. Collins' problem, the attached material may clarify the fact that the Town of South Windsor does not maintain Collins Lane. According to an agreement made between Porter Collins and South Windsor on September 27, 1965, The Town did not agree to remove snow from the paved area now known. as Collins Lane. As a matter of record, Collins Lane does not even appear on the revised Street Map. However, at one time, Collins Lane was a part of Sullivan Avenue that was abandoned due to the dangerous nature of the curve. That change in 'the road is detailed on the attached map dated April -1964 and received for record December 5, 1966. Most of the abandoned portion was scarified, leaving a strip of :paving leading to David Collins ' house. In effect, this area is an extension of his driveway. Therefore, the Town has. never plowed Collins Lane. I believe Mr. Collins' problem lies in the fact that the Town never deeded the "old" Nevers Road, which was scarified, over to him. Also, the abandoned, portion of Sullivan Avenue may not have been deeded to him. Thus, unless there is a document on file proving otherwise, South Windsor is probably still responsible for maintaining that portion of the abandoned road. Mr. Collins, on the other hand, did deed to the Town a parcel at the intersection of Sand Hill Road and Sullivan Avenue (which probably had something to do with the reconstruction of the road. ) The map dated September 1965 and recorded . October 6, 1965, which is attached, is referred to by the deed to 'the Town found in Volume III, page 258 . In my opinion, the Town should deed the problem area to Collins, thus making him entirely responsible for maintaining the property in question. At this point, the Town crew does sand and sweep Collins Lane as a courtesy. However, no plowing is done because the paved area is too narrow for a plow. Therefore, I see two alternatives: 1. Maintain the area which was never deeded to Collins. 2. Deed the property to Collins. GregorrTurek GT/ml Attachments . PRELIMINARY REPORT STATUS OF COLLINS LANE JUNE 13 , 1986 cSAry As -SQ"L 7_1 %9e6 This report was conducted for informational purposes and is not intended to conflict with legal actions or precedences. Maps and other information in the Town Clerk' s Office indicate that Collins Lane (so-called) and Sullivan Avenue existed as traveled ways long before any of the maps were prepared. Deed descriptions of properties to and from the Collins ' family and others refer to Collins Lane (so-called) , Sand Hill Road and Sullivan Avenue only as "highways" , and not by name. Existing documents concerning this matter found to date. 1. Map showing a parcel to be acquired from Collins and land to be abandoned dated April 1, 1964 (T.C. 513B) . 2 . Minutes of the Town Planning and Zoning Commission approving same 10/12/65. Note: Map not filed until 1976 (T.C. 713B) . 3 . Memo to Paul Talbot, Town Manager, dated February 6 , 1978 from Allan Young, Director of Public Works. "Provide Access to the Porter Collins Driveway" . 4 . Memo from Greg Turek to Allan Young dated February 3 , 1978 indicating his research to determine if the Town should plow Collins Lane (so-called) . . 5 . Memo to Planning and Zoning Commission and Allan Young, Director of Public Works, requesting report based on a request from Porter Collins . 6 . Minutes of Town Council where resolutions were proposed with amendments and passed September 27 , 1965 . 7 . Minutes of Town Planning and Zoning Commission approving street layout for Sand Hill Road at Sullivan Avenue, October 12 , 1965 . The agreement that was passed as a resolution by the Town Council September 27 , 1965 appears to be the best evidence as to what was intended by the abandonment. Page 872 of the Council Minutes. contains a concern by Councilman Cavanaugh that the agreement was not specific as to what was being given to Mr. Collins . Another motion to amend the first was passed and carried. 4 nary- Report of Collins Lane , 13 1986 "That the Resolution be further amended to add that our move is also subject to the condition that the Town' s Attorney, prepare in form satisfactory to him, a description for inclusion on the Town' s Record_of the portion of the road to be abandoned. " Councilman Ahearn said we could have the Town Engineer draw up a map of theroad that is to be abondoned and have it and a description incorporated in the Agreement. It appears that the map approved by the Town Planning and Zoning Commission on October 12 , 1965 is that map. Conclusions 1._ The Town Council intended to abandon that section of street referred to now as Collins Lane. 2. That the Town Council intended also to convey the abandoned portion of roadway to Mr. Collins.. 3 . That the Town fulfilled its obligation to provide access to the Porter Collins ' driveway by providing an extension of his driveway to Sullivan Avenue. This conclusion is contray to Mr. Young's opinion of how access is to be provided. Conclusion 1. There is still some gray area here and the existence of additional material pertaining to this is possible. 2. The intent by both the resolutions and the maps on file was to abondon all of the Town ' s right to the old pavement. 3 . The portion of Collins Lane (so-called) from the realigned Sand Hill Road northerly to beyond David Collins ' driveway has remained in its original condition. It was not scarified nor was it narrowed as it was from his driveway northerly to Porter's. 4. Porter Collins in effect then has access to Sullivan Avenue direct and Sand Hill direct. 5 . The Town has , in the past, and does now, plow only that portion of this street that provides access to David Collins ' driveway, #2 Collins Lane. 6 . The Town Attorney should be consulted as to clarification of the gray areas. I feel that problems in the future could arise if David Collins should sell and the new owner to claim the "abondoned road. " This would deny access to Sand Hill Road by Porter Collins at #8 Collins Lane (so-called) . "nary Report bf Collins Lane dune' 1"3, 19 8`6 _;Page 2 . I do not believe that the Town of South Windsor has any obligation in this roadway. It existed with rights of use by the Town and we abondoned those rights . The Town, as a courtesy, has been plowing, sanding and sweeping the first 250t feet of Collins Lane (so-called) . Street Services will continue to do this as a matter of course unless directed to do otherwise. MelvinrC. Stead, Jr. Acting Director of Public Works i .Y v Mr. Donald went over his proposed. scope of services with the Commission. One of the most important first steps would- be the property line maps . They would. propose two 12--month contracts to do a complete job. The first year is basically all fact gathering, and. would generally require a meeting with the Commission once a month. Further discussion of the proposed. scope of services will be held on the 12th. A request was received to remove gravel on Belsky Property as submitted. by Attorney Kuehn.
