We came from East Hartford, having sold our home there. We chose South Windsor as we felt it had much to offer in the ways of an excellent school system, and community among other things. During construction of our new home we encountered very little in the way of problems. We frequently saw town inspectors at the development, and our house progressed rapidly to completion. On September 1,1994 we closed on our home an excitedly began moving in! Unfortunately, one month later problems began popping up. In October 1994 JMJ's Construction Company phoned us to say that there was a problem with our driveway. It violated zoning. We could not understand this at first, because we had closed, and received our certificate of occupancy. Apparently errors were made during the "rush"to close,by both the construction company and town inspectors. Needless to say we no longer have the beautiful U-shaped driveway in front of our dream home. In April 1994 we went to obtain a permit for our pool, fence and a shed. We were stunned to learn that we could not build any permanent structure closer that fifty feet in from the back of our property(which is Hilton Rd. )It was an odd situation, with three roads involved on the front, side and rear of our property. We applied for and received a variance for our shed. However, during this action we encountered yet another surprise. Our property boundaries were not what we were told by JMJ. Apparently approximately 50' in from the corner of our back yard, and angling out, is in reality town property! Imagine our surprise to learn that someday Hilton Rd.will be fifty feet closer to our home! All this time we truthfully believed this property was ours. We put topsoil there, we graded, seeded and maintained it- at our expense, with nobody informing us otherwise. In May of 1995 I was told by JMJ(Mike Jacques )that I am required to place two trees, maple variety, 2 1/2 " in diameter, in my front yard.Apparently this is a town requirement. Again, we were not informed of this prior to closing. A waiver is being applied for by JMd on behalf of the homeowners who took landscaping credits in this development, not to require these two trees. It is now June, a year after beginning our home, and it seems the major problems have just begun to surface. Yet another error has been made. This one in regard to our property. As marks were made for monuments and points, (by Design Professional Inc. )one mark appeared in the middle of our sidewalk, another about 3" in on the sidewalk. The sidewalks in front of our house were installed on our property due to the fact that the curbline is off, thus the road (Cody Circle) is incorrect. According to JMJ the easiest was to remedy this is for us(the home owners)to sign an easement over to the town . It seems we are once again on the losing side, of which we have no control over, for the third time. So far, these have all been land issues. However, we now have a structural concern. We noticed birds nesting in the eaves on one side of the house. We called JMJ, and they sent someone out to close the gap. We realized after it was repaired that we did not remember those gaps during construction. We did all the exterior, as well as interior painting. Upon closer examination we find that a portion of our roof is falling inward, toward the center of the house. Our dream home is fast becoming a nightmare! We are an average family, with limited knowledge of construction. We are not engineers, and do not understand why this is occurring. We blindly placed our faith in JMJ.construction, and the Town of South Windsor engineers and inspectors to ensure our home was built safely, and to the proper codes and requirements. While we do not seek to place blame, we do feel that the towns building department should shoulder some of it, along with JMJ. There are other minor errors we encountered during our investigations. Among them; Plumbing permits that show three bathrooms in,our home (we only have two) , and an electrical permit for 100 amp service(we have 200 amp.) Due to the numerous problems we have encountered after closing,we have a request of the Town of South Windsor. We would like a review of the inspections of our home. We would also request the assistance of the towns engineers with our latest roof dilemma, at no cost to us. We want to ensure the safety of our family, in that the roof is correctly repaired, not just easily fixed. As we do not have the knowledge and expertise to make this judgment,we ask that the engineers review this problem, and help us formulate the best avenues of repair. We would also hope that during this review any other problems or concerns would surface and be taken care of. We would greatly appreciate an expedient reply to our requests, and thank you in advance for your cooperation. Sincerely, John and Doreen Blondin 7 Cody Circle 289-6112
